Why AGB Nielsen released ratings bulletin despite TRO

Palaisipan pa rin hanggang ngayon kung bakit "nilabag" ng AGB Nielsen Media Research ang Temporary Restraining Order (TRO) issued by the Quezon City court noong December 19. Ang inaasahan ng karamihan ay hindi magkakaroon ng ratings bulletin in the next 20 days, subalit naglabas pa rin ang nasabing firm ng overnight ratings for Mega Manila, December 17-21 .
Noong December 21 nga ay nag-release ang ABS-CBN Corporate Communication office ng maikling statement: "With the decision of AGB Nielsen Media Research Philippines to disobey the clear terms of the temporary restraining order, it made a narrow and self-serving interpretation of the TRO. As a result of this, we will hold them liable for contempt of court."
Nakausap namin ang isang source tungkol dito at ang explanation niya, baka ang pagkaka-intindi ng AGB Nielsen ay sa affected district lang enforced ang nasabing TRO.
Ayon sa order handed out by Judge Charito Gonzales, "Wherefore, as prayed for, the dependant [AGB Nielsen], its employees, agents or representatives and those acting for and in behalf are hereby ordered to cease and desist for pursuing its nationwide TAM [television audience measurement] data gathering activities from corrupted home panels and delivering, releasing or making known the resulting TAM data to its clients or the general public within twenty (20) days from the issuance of this order."
Ang pagkaka-intindi ng source na kausap ng PEP (Philippine Entertainment Portal), the operative phrase is "pursuing its nationwide TAM data gathering activities from corrupted home panels."
"Mega Manila ang ini-release ng AGB last Wednesday and Thursday [December 19-20], hindi ito nationwide. Isa pa, ang problema ng ABS, sa Bacolod, so ito ang sinasabing corrupted home panels, not the Mega Manila homes," ang paliwang pa ng source.
Nagtataka rin ang GMA insider kung bakit sinasabi ng ABS-CBN sa complaint nila that there is a "15 per cent gain" daw na natamo ang GMA-7 sa Bacolod.
Aniya, "Before GMA went full blast sa regional activities, number one ito sa Iloilo and Bacolod. Ang nakakapagtaka, nang na-introduce na ang GMA doon, saka ito natalo ng ABS-CBN and with a wide margin.
"Talo ang GMA sa ABS sa Bacolod ngayon, wide margin. So nasaan ang 15 per cent increase? All the data are there na walang itinaas ang GMA during the past months in question. 'Di dapat nagdikit ang ratings ng dalawang stations, pero hindi nga."
Meanwhile, ayon na rin sa ating source, desididong ituloy ng GMA-7 ang demanda laban sa DZMM reporter na si Junrie Hidalgo. Nai-refer na raw ito sa external lawyers ng GMA-7 na Belo, Gozon, Parel Law, last Thursday, ika-20 ng Disyembre. Kung hindi man ito nai-file last Friday, being the last working day before Christmas, tiyak na ito raw ang priority after the holidays.
