Libel ang kaso na isinampa ni Richard Gutierrez laban sa PEP (Philippine Entertainment Portal); partikular na ang editor-in-chief nitong si Ms. Jo-Ann Maglipon, ang managing editor na si Karen Pagsolingan, at ang staff writer na si Ferdinand Godinez.
Nagsadya kanina, April 13, si Richard sa Makati City Regional Trial Court para pormal na isampa ang kaso. Past 2 p.m. nang dumating siya sa Prosecutor's Office. Kasama niya ang mga magulang na sina Eddie Gutierrez at Annabelle Rama, ang mga kapatid na sina Ruffa at Raymond. Present din si Bubbles Paraiso, ang witness ni Richard sa kaso, na alaga ng kanyang ina.
Si Atty. T. Angelica Y. Santiago ang legal counsel ni Richard at siya ang nagsabi sa media na P25 million ang halaga ng damages na hinihingi ng kanyang kliyente mula sa mga respondent. Fifteen million pesos (P15M) para sa moral damages at ten million pesos (P10 million) para sa exemplary damages.
Sa interview kay Richard, sinabi nito na itinuloy niya ang pagsasampa ng kaso dahil hindi naman daw binawi ng PEP ang kuwento na nagkaroon diumano sila ng engkuwentro ni Michael Flores sa birthday party ng direktor na si Mark Reyes noong March 28.
Ayon kay Richard, "Maraming artista ang nabibiktima ng ganitong klaseng false journalism at nagkataon lang na nangyari ito sa akin. Nakakalungkot na kinailangan na mangyari ito, pero I just want to get to the bottom of this and we wanna find out the truth kung sinong tao ang nasa likod nito. That's why we're doing this. We already gave them a second chance that's why we are here.
"Hindi ako galit. I feel bad and it saddens me na kailangang mangyari ito. Kasi kaming mga artista, nagtatrabaho kami. You know, ang goal namin, magbigay-ligaya. Magbigay ng entertainment sa mga tao, tapos bigla na lang kami sasagasaan nang ganoon. Wala naman kaming ginagawang masama.
"Sa totoo lang, galing kami sa Bagac, Bataan. Nagte-taping kami doon. Isang beses lang akong lumabas, natsismis pa ako na gumawa ng ganoon. Ang sama lang ng ginawa nila. Ngayon, we have no option but to do this legal action. We want to get to the bottom of this. Sino ba talaga yung taong behind this? Sino ba talaga ang source? Yun lang naman.

"Sana kahit ano ang mangyari, nandiyan pa rin sila sa likod ko, kahit medyo damaging sa akin yung nangyari. Yung mga fans ko, naniniwala pa rin sa akin at nagtitiwala sa akin at gusto kong magpasalamat sa kanila."
