Two interesting developments transpired today, September 4, in what was supposed to be the preliminary investigation of the case of Reckless Imprudence Resulting in Homicide filed by Lorayne Pardo against actor Richard Gutierrez, 25. Lorayne, 29, is the widow of Nomar Pardo, 42, who was Richard's personal assistant—better known in the entertainment business as a P.A.—and who died from a car accident last May 22 where the actor was the driver. One, Cavite Provincial Prosecutor Emmanuel Velasco announced to the press that the two parties were "open to settlement." At the same time, having issued a gag order prohibiting Lorayne and Richard from talking about the case, the two parties were unable to confirm or deny this.
Two, Lorayne's legal team says it finds the day's procedure "disturbing," saying that no hearing transpired, yet they had been called precisely to attend a preliminary investigation. Instead, what it got was a session on amicable settlement.
"OPEN TO SETTLEMENT." Cavite prosecutor Emmanuel Velasco told the press today, September 4, that the two parties in the Reckless Imprudence Resulting in Homicide case filed against actor Richard Gutierrez were "open to settlement."
After more than two hours of a closed-door mediation, which began at 10 a.m. at the Imus City Hall of Justice, Prosecutor Velasco told complainant Lorayne Pardo and Richard Gutierrez to take 15 days to think about an amicable settlement.
At the same time, Velasco issued a gag order preventing the two parties from talking to the media. There was thus no way of knowing whether the two parties, who had earlier made public avowals of not backing down, were actually inclined to settle.
Accompanying Lorayne to the prosecutor's office were her father-in-law Ramon Pardo and her lawyer Atty. Datu Ombra Jainal. Richard was accompanied by his mother Annabelle Rama, father Eddie Gutierrez, sister Ruffa Gutierrez, half-brother Ramon Christopher, Pilita Corrales, and his two lawyers Atty. Sheryll Mallari and Atty. Gener Asuncion.
Prosecutor Velasco, who is the son of former National Bureau of Investigation chief Epimaco Velasco, told PEP (Philippine Entertainment Portal) that his office was optimistic that the two would concur with the offer.
"Everybody's open naman, e. We're positive naman, e. We're optimistic," he said. "After that, kung walang mangyari, idi-decide na yung kaso. Pero hopefully... both parties naman are open."
Velasco said his office had brought up the idea of an amicable settlement because he didn't want the court to be used as a "collection agent."
"Kasi diyan din pupunta yan e, ha? Pag ganyang kaso, ganoon," Velasco asserted, referring to how these cases usually end up being settled by the parties.
The gag order, he explained, will prevent the Pardos and the Gutierrezes from airing negotiation details to the public.
"Para wala na munang marinig muna. Para makapag-usap sila. Kasi mahirap yung magsasalitaan sila sa press, baka mamaya, ganoon, ganyan," Velasco said.
But he said his office will not impose a penalty if any party should break the order.
"We believe naman na they will follow our gag order. Gentleman's agreement yon, para makapag-usap nang maayos," the prosecutor asserted.

Mali pala tayo. Lunod daw pala at di pagkabagok sa bato ang ikinamatay ni JB. Nonetheless, the rest of our arguments still hold up...it is man's responsibility to avoid accidents.
Sana nga mapanagutan na ni Richard ang pagkakamali nya sa aksidenteng ito...
From the ABSCBN site - I stumbled upon the news that Lorayne has approached the DOJ for assistance today the 11th of September. The entire article has been posted on the thread for Lorayne here at PEP or you can also view it from the ABSCBN website.
I am glad that Lorayne and family have decided to move out of the Cavite region to seek justice. Anyway, hopefully - it will for the best.

Huwag nyo po sana masamain ang pagsisi ko sa nangyaring aksidente sa kapabayaan din ng namatay. Nangangatuwiran lang po ako na tao ang may pananagutan sa mga aksidente.

Whether it says that he cannot think for himself, I cannot say. Who knows? Baka sya pa ang nagsulsol sa mommy nya na gawin ang mga yon?
That he lacks humility, possibly. Pwede rin kasing ignorance lang sa batas. Alam din naman kasi nating di sila nakatapos sa pag-aaral e. Maaaring kulang lang sa comprehension or sa logical reasoning skills?
He is an idol - 'yan lang ang point ko.
Whether he deserves to be idolized is another matter that I think I already clarified in detail.
Ihiniwalay ko lang ang paghusga sa behavior nya sa accident at dun sa pagkatao at advocacies nya. I just want to be fair also.
I agree with you that Richard 'handled his mess' immaturely. Isa pa pala 'yang dapat nyang ihingi niya ng sorry. Sa tingin ko ang iba pa nyang mga pagkakamali ay:
1. He deceived the public when he said 'I am not responsible' sa PR nya. Kasinungalingan 'yan kung pagbabasehan ang batas.
2. He tolerated - or maybe he encouraged - his mom's crass behavior against the deceased and his family eg. saying derogatory remarks, saying Nomar doesn't deserve a tribute, stopping check donations.
3. He refused to talk to Lorayne even just to tell the story of what happened. This is just plain rude.
Notwithstanding all these examples of poor judgement, Richard IS still a role model obviously because people like phinx and tigasin09 still idolize him. We cannot deny that fact. What that says about these people, is another matter I would not care to elaborate on...hehe.

To illustrate further:
1. Si Richard ang kumabig sa manibela kaya natamaan ang poste ng kuryente; hindi lang basta sumulpot ang poste sa harapan nya. Bat natin isisisi sa poste ang aksidente?
2. Si Richard ang may kontrol sa bilis ng takbo ng sasakyan nya. Hindi naman ginusto ng mga puno na masagasaan sila para sila ang masisi, di ba? Hindi rin naman siguro gusto ng sasakyan na mayupi para yon ang masisi, di ba?
3. Si Richard din ang nagdesisyong magmaneho kahit pa pagod sya o walang tulog.
4. Si Richard din ang nagpumilit na magmaneho imbis na gamitin ang van at driver na alok ng mommy nya.
To conclude, Richard should say 'sorry' for his 'wrong' actions and decisions that resulted in Nomar's death. His sympathies and condolences are not enough. He should still say 'I'm sorry' and accept that 'he was responsible' for the accident. And preferably, he should mean what he should say.
The traffic law RA4136 was created so that only those that have control are blamed for accidents. We cannot blame the weather or the road condition or even God for this accident because no one can control these factors when travelling. Kaya driver ang sinisisi. And for public vehicles, pati yung nag-hire ng driver - the vehicle owners ang sinisisi.
What is so 'rude and utak barbarik' about this line of reasoning? I am not a legislator nor a lawyer but I understand the logic behind the law. I think that our laws are reasonable and fair and if only they are strictly implemented, our drivers will show more discipline on the road... and in general, our country will be more progressive.
I disagree with you on the point that the tragedy involving Dennis and JB is due to 'nature'.
While JB's death is indeed a tragedy and I would not wish for this to happen to anyone, his death is a result of his own negligence. It is dangerous for anyone to swim near rocky surfaces. It is his decision to swim despite the apparent danger that caused the accident.
And tigasin09, since it is his own negligent behavior that resulted in his death, no one should blame his swimming buddy Dennis for this accident.
Same as humanright and thehunks100 position... there is no law that says that you are responsible for the accidental death of a person you are swimming with.
Look up and read RA4136 so you could understand why we think Richard is responsible for Nomar's death.
Kung tamad ka, I'll spell it out for you... The land transporation and traffic code says that the driver and vehicle owners are responsible for any damage or death resulting from an accident.
In short, it is the law that says Richard is responsible for his passenger's death. It is not just some 'principle' that we imagined and used as the basis for our judgement.
If they want to appear as socially responsible citizens - they should start with the people they have wronged.

I hope that nothing more disturbing is happening with this case. If the lawyers of the Pardo's are disturbed with the turn of events - how do you think we feel then? Their camp is so quiet - it is really disturbing...
