The Department of Justice (DOJ) has ordered the filing of parricide against Manuel "Third" Jimenez III. He is the husband of Ruby Rose Barrameda-Jimenez (inset), sister of actress Rochelle Barrameda. Ruby Rose was reported missing in 2007. On June 10, 2009, her corpse was found stuffed in a steel drum inside a metal casing deep in the Navotas Fishing Port waters.

Naglabas na ng kautusan ang Department of Justice (DOJ) Secretary Agnes Devanadera para pormal nang kasuhan ng parricide ang mister ni Ruby Rose Barrameda-Jimenez na si Manuel "Third" Jimenez III.
Si Ruby Rose ay kapatid ng aktres na si Rochelle Barrameda. Noong Agosto 2009, naghain ng Petition for Review ang abogado ng mga Barrameda na si Atty. Rowena Guanzon para maisama sa mga nauna nang nakasuhan ng kasong murder si Jimenez III. Sa rekomendasyon kasi ng DOJ noong taon ding iyon, tanging sina Atty. Manuel Jimenez Jr., Lope Jimenez, Manuel Montero, Eric Fernandez, Leonard Descalso, at Robert Ponce ang pinapakasuhan kaugnay ng kasong pagpatay kay Ruby Rose.
Ayon sa Revised Penal Code, Sec. 1, Art. 246: "Parricide - Any person who shall kill his father, mother, or child, whether legitimate or illegitimate, or any of his ascendants, or descendants, or his spouse, shall be guilty of parricide and shall be punished by the penalty of reclusion perpetua to death." THE CASE OF RUBY ROSE. March 14, 2007 ang iniulat na petsa ng pagkawala ni Ruby Rose. Bago ang kanyang pagkawala, nasa isang custody case para sa dalawa niyang anak na babae si Ruby Rose laban sa kanyang hiniwalayang asawa na si Jimenez III.
June 2009 nang makatanggap ng tawag si Rochelle mula sa isang informer—si Manuel Montero na kalaunan ay umaming isa siya sa mga may kinalaman sa pagpatay kay Ruby Rose at nagturo kung saan matatagpuan ang labi ni Ruby Rose.
June 10, 2009. Nakuha mula sa ilalim ng dagat, 1.85 kilometers mula sa Navotas fish port, ang isang metal box na kinapapalooban ng isang drum, kung saan nakasiksik at nakasemento sa loob ang bangkay ng isang babaeng nakatali at nakaplastik pa ang ulo.

Jimenez Jr., tiyuhin nitong si Lope Jimenez, at mga tauhang sina Montero, Discalzo, Fernandez, Ponce, at Rudy dela Cruz.
August 25, 2009. Base sa resulta ng imbestigasyon ng DOJ prosecuting panel na pinamumunuan ni Senior State Prosecutor Theodore Villanueva, naglabas ng 19-page resolution ang DOJ na nagrekomenda ng pag-file ng murder charges laban sa magkapatid na Jimenez (Lope at Atty. Jimenez), kina Montero, Fernandez, Discalzo at Ponce sa Navotas-Malabon Regional Trial Court. Absuwelto naman sina Jimenez III at Dela Cruz dahil sa "insufficient evidence on hand."
Pagkatapos ng rekomendasyon ay inilakad naman ng DOJ prosecuting panel na maging state witness si Montero, habang nag-file naman ng Motion for Judicial Determination si Atty. Mario Aguinaldo para sa kliyente niyang si Atty. Jimenez Jr.
September 4, 2009. Sumuko si Jimenez Jr. sa Angono police ngunit agad na nagpa-hospital arrest matapos na magreklamo ng pananakit ng dibdib. Una'y sa Angono Medics Hospital naipasok si Jimenez Jr., pagkatapos ay inilipat sa Philippine Heart Center noong Oktubre, sa utos na rin ng presiding judge na si Judge Hector Almeyda ng Branch 170 ng Navotas-Malabon RTC. At large o wala sa kustodiya ng batas naman sina Lope, Fernandez, Descalzo, at Ponce.
Umapila ang pamilya Barrameda sa inilabas na resolusyon ng DOJ na nag-aabusuwelto kay Jimenez III at nagsampa ng Petition for Review si Atty. Guanzon sa DOJ. Nag-file naman ng Petition for Review ang abogado ni Lope Jimenez na si Atty. Ferdinand Topacio.
Nagpalit naman ng abogado ang isa sa akusado't witness na si Montero. Mula sa mga abogadong bigay ng Public Attorney's Office (PAO) ay kinuha niya ang serbisyo ni Atty. Arturo Paglinawan na agad na nag-file ng guilty plea at Motion to Discharge sa korte. Ani Atty. Paglinawan, isa sa mga requirement sa court proceedings ang pag-amin ng akusado ng guilt para maging state witness.
DEVELOPMENTS SO FAR. Noong Lunes, March 1, inilabas ng DOJ ang 12-page resolution na nagrerekomenda ng kasong parricide laban kay Manuel Jimenez III at nag-aabsuwelto naman kay Lope Jimenez.
Ayon sa resolution sa rekomendasyon nitong sampahan ng kaso si Jimenez III: "The statements made by Montero as to the participation of Manuel Jimenez III to the killing coming from what he heard from Spyke (Jimenez III's bodyguard) cannot be simply considered as hearsay. They are independent, relevant statements."
Diin pa ng DOJ kung bakit dapat kasuhan si Jimenez III, "[He] has every motive to participate, if not plan, the murder of his wife" dahil sa buhay pa ring child-custody case nila ni Ruby Rose para sa dalawa nilang anak na babae.
Sa pag-absuwelto naman kay Lope Jimenez, sinabi sa resolusyon na "lack of probable cause" ang isa sa mga dahilan kaya hindi siya dapat kasuhan. Wala rin daw bigat ang statement ni Montero na si Lope ang nag-utos sa kanya na kidnapin at patayin si Ruby Rose, sa utos ni Atty. Manuel Jimenez Jr.
Ayon sa DOJ, "inadmissible" o di katanggap-tanggap ang statements ni Montero laban kay Lope dahil nasasaad sa Rules of Court (Rule 130, Section 28) na ang pag-amin sa isang krimen ng akusado ay katanggap-tanggap para sa akusado lamang at hindi sa iba.
Sabi pa sa resolusyon tungkol sa pag-absuwelto kay Lope, "The inadmissible confessions or admissions of Manuel Montero... are utterly devoid of any evidence that would separately and independently prove conspiracy between Lope Jimenez and other respondents... The inadmissible and utterly insufficient evidence cannot stand when measured against the constitutional right of the accused to be protected against hasty, malicious and oppressive prosecution."
LAWYERS' REACTIONS. Kaugnay nito, kinuha ng PEP (Philippine Entertainment Portal) ang reaksiyon ng mga abugado ng pamilya Jimenez at ng pamilya Barrameda sa pamamagitan ng phone interviews ngayong araw, Marso 12.
Ayon kay Atty. Ferdinand Topacio, abogado ni Lope Jimenez, masaya ang pamilya Jimenez sa resolusyon ng DOJ: "The family is very elated and we believe justice has been served."
