"Lack of probable cause" ang ibinigay na dahilan ng Dept. of Justice (DOJ) sa kanilang desisyon na i-dismiss ang kaso ng acts of lasciviousness (Under Article 336 of the Revised Penal Code as amended in relation to R.A. No. 7610 also known as "Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act") na inihain ni Rachel Saludo laban sa young actor na si Aljur Abrenica. Si Rachel ang ina ni Michelle Denise, ang 15 -year old aspiring actress na nagbintang kay Aljur ng pang-aabuso nang magkita at magkakilala sila sa Puerto Galera noong April 10, 2009.

Nakalagay sa sworn affidavit ni Michelle na pinilit diumano siya ni Aljur na painumin ng alcoholic drinks at nakaranas siya ng mga panghuhusga mula sa kanilang mga kapitbahay at ibang tao nang i-deny ni Aljur na siya ang babaeng ka-date ng aktor sa Puerto Galera.

Isinalaysay rin ni Michelle sa kanyang affidavit na masyado siyang naapektuhan ng mga mensahe na natanggap niya mula sa fans ni Aljur na nagsasabi na "pokpok" siya, "nag-iimbento ng kuwento," at layuan niya ang aktor.

Idinagdag ni Michelle na hindi na appropriate ang mga paghawak ni Aljur sa kanyang beywang at dibdib nang magkasama sila sa Puerto Galera.

Diretsahang itinanggi ni Aljur ang mga akusasyon ni Michelle. Para patunayan na totoo ang mga sinasabi niya, inihain ng aktor sa korte ang mga affidavit ng walong saksi na kinabibilangan ng kanyang ama, kapatid at mga kaibigan, pati na ang group pictures na kuha sa Puerto Galera. THE RESOLUTION. Si Prosecution Attorney Amanda Felipe ng DOJ ang author ng resolution na nag-abswelto kay Aljur.

Ayon kay Atty. Felipe, wala siyang nakitang probable cause para kasuhan si Aljur dahil sa mga sumusunod na dahilan:

"It is apparent that what Rachel and Michelle are complaining about is the public denial of Aljur that he met or dated Michelle in Puerto Galera. The denial caused embarrassment to Michelle who posted her pictures with Aljur on the Internet. It also resulted in Michelle becoming the subject of nasty rumors and comments, which had a negative effect on her.

"It is important to point out that the allegation that Aljur inappropriately touched Michelle did not crop up while Michelle and her family was still in Puerto Galera or immediately after they returned home from Puerto Galera.

"It was only after Aljur publicly denied that he met or dated Michelle in Puerto Galera that the allegation against him for acts of lasciviousness came to life.

"The motive behind the filing of the instant complaint against Aljur is highlighted in paragraph 10 of the Karagdagang sinumpaang salaysay of Michelle dated June 1, 2009, to wit:

   T: Pansamantala ay wala na akong tanong, meron po ba kayong nais idagdag, alisin, o baguhin dito sa salaysay mo?

   S: Dahil po naapektuhan ako sa pagtanggi ni Aljur sa national TV, gusto kong ipakita at ipaglaban ang karapatan ng kababaihan, menor de edad, at karaniwang tao. Ipaglalaban ko din ang moral ko at ng pamilya ko dahil sa sobrang naapektuhan kami sa mga malalaswang komento ng ibang tao, lalo na sa media at Internet.

"The complaint of acts of lasciviousness against Aljur is plainly an afterthought to save the besmirched reputation of Michelle. If it is true that Aljur inappropriately touched her in Puerto Galera, she should have immediately said something to Melrose, Jake or Rachel who were with her in the said place, or stayed away from Aljur while they were there. However, instead of doing those things, she did the exact opposite.

"The actions of Michelle are totally uncharacteristic of a person who had just been inappropriately touched by Aljur.
