Host Willie Revillame celebrates with a public statement on Willing Willie

Ngayong gabi ay ipinagdiwang ni Willie Revillame, live, sa kanyang programa ang isang desisyon ng Court of Appeals (CA) na paborable sa kaniya sa kasalukuyang mga demanda at kontra-demandahan nila ng ABS-CBN.

Ito ay kaugnay ng petisyon ng ABC Development Corporation para sa pag-isyu ng korte ng writ of preliminary injunction sa pagdinig ng kaso sa Makati Regional Trial Court ng hinihinging TRO (Temporary Restraining Order) ng ABS-CBN Corporation laban sa Willing Willie

Ang ibig sabihin nito ay magpapatuloy sa ere ang Willing Willie. "Status quo" ang mangyayari sa ngayon.

Layunin ng reklamo ng ABS-CBN na ipatigil ang pag-ere ng Willing Willie sa TV5.

Dating host si Willie ng ABS-CBN noontime variety-game show na Wowowee, subalit nagkaroon ng hindi pagkakaunawaan ang dalawang partido matapos palitán ng istasyon ang programa nung nakaraang taon, na nauwi sa paglipat ni Willie sa bakuran ng TV5.

Ikinatwiran ng ABS-CBN sa kanilang reklamo na nilabag ni Willie ang nilalaman ng kanyang kontrata dahil sa biglaang paglipat nito.

Ang patuloy na pag-ere raw ng Willing Willie ay magdudulot ng "irreparable injury" sa Lopez-owned network.

Kahapon, March 10, isang Resolution ng Court of Appeals ang lumabas. Pirmado ito ni Associate Justice Japar B. Dimaampao, at sinasang-ayunan naman nina Presiding Justice Andres B. Reyes, Jr. at Associate Justice Aurora C. Lantion.

Pinaboran ng mga justices ang petition for a writ of preliminary injuction ng ABC Development Corporation at ni Atty. Ray Espinosa (presidente ng korporasyon).

Ang Resolution ay nagpapatigil kina Judge Joselito Villarosa (presiding judge ng Regional Trial Court ng Makati) at ABS-CBN Corporation na gustong magpatuloy sa pagdinig ng petisyon ng ABS-CBN para sa TRO (temporary restraining order) sa Willing Willie.

Ito ang inilabas sa ere ni Willie ngayong gabi.

EXCERPT FROM COURT RESOLUTION. Isang bahagi ng Resolution (na hindi binasa ni Willie) ay nagsasaad: "We discern compelling justifications to issue the writ of preliminary injunction."

Sa pagpapatuloy nito: "Injunction is the strong arm of equity which must be issued with great caution and deliberation, and only in cases of great injury where there is no commensurate remedy in damages.

"In light of the factual milieu obtaining in this controversy, We are convinced that there is an extreme urgency and imperative need to preserve the status quo of this case until the merits of the Petition have been fully adjudicated upon. The crucial queries brought before Us ought to be resolved first before the court a quo could press on with the hearing for the issuance of the TRO. Our eventual decision on these issues may be put to naught if the court a quo is allowed to receive the parties' respective evidence and upon which, decide the case on the merits."

Ang isa pang parte ng Resolution (na binasa ni Willie) ay nagsasaad: "We cannot turn a blind eye to the incalculable losses that petitioners may suffer once the airing of Willing Willie is enjoined. Their contractual obligations to sponsors and advertisers, as well as to Willing Willie's production crew and staff, would certainly be put in jeopardy. The opportunity to offer joy and consolation to the millions of Filipinos who eagerly watch the show, with many actually joining and winning the contests, would dissipate into thin air. In the higher interest of justice, We are of the considered opinion that an injunctive writ is necessary to forestall this irreparable injury that may be suffered by petitioners."
