Sa ikalawang pagkakataon ay hindi natuloy ang nakatakdang court hearing sa kasong isinampa laban sa aktor na si Richard Gutierrez at sa kapatid niyang si Eduardo "Rocky" Gutierrez.

Kinasuhan ang magkapatid nina Arnel Cruz at Ram de Vera ng kasong serious physical injuries at malicious mischief.

Ito'y matapos sila diumanong bugbugin ng magkapatid at ng iba pang mga kasama nila sa birthday party ni Richard noong January 30, 2005, sa parking lot ng The Fort, Taguig City. (CLICK HERE for related article,)

Hindi natuloy ang pagdinig sa naturang kaso ngayong araw, September 1, sa Taguig Metropolitan Trial Court, Taguig City dahil na rin sa hiling ng kampo ng mga complainant.

Sa eksklusibong panayam ng PEP.ph (Philippine Entertainment Portal) kay Atty. Javier Flores, ang legal counsel ng complainants, sinabi niyang ang consolidation ng kanilang isinampang mga kaso ang dahilan ng paghiling nilang i-reset ng naturang hearing.

Aniya, "So, what the court said on its order of July 19, pagsamahin na yung physical injuries, yung trial ng physical injuries... Serious 'yan, physical injuries at malicious mischief.

"So, pinagsama na siya under the regular procedures. The case for serious physical injuries is now going to be tried at the same time with the malicious mischief.

"The malicious mischief concerns the damage to the automobile of the private complainant."

MARKING OF ADDITIONAL EVIDENCE. Sa September 13 nakatakdang mangyari ang marking ng additional evidence ng magkabilang kampo.

Ang mga ebidensya lang kasi para sa serious physical injuries ang naihanda nina Atty. Flores, dahil dati'y magkahiwalay na hearing dapat ang magaganap sa naturang mga kaso.

Aniya, "September 13, that will be the marking, additional marking of documents for both the complainants and Richard Gutierrez.

"So, now they are going to be tried at the same time, but on the initial marking of evidence we were only able to mark documents for serious physical injuries.

"It means that, hindi pa kasi sinama yung malicious mischief nung una. But right now, since the judge issued an order saying that the cases should be tried jointly, we are going to have documents for the other case also marked."

Kaugnay nito, ipinaliwanag din ni Atty. Flores kung papaano ang magiging takbo ng kaso bunga ng consolidation na ito.

"Kasi dun sa order ng korte nakalagay lang kasi serious physical injuries.
