"That's not true!" pagdidiin ng kampo ni Nadia Montenegro sa "attempted kidnapping" complaint ni Annabelle Rama laban sa kanila.

Noong December 13 nagsumite ng complaint-affidavit si Annabelle sa Quezon City Prosecutor's Office, kung saan inilagay ang pangalan ni Nadia, ang abugado nitong si Atty. Marie Glen Abraham, at lima pa nilang kasama bilang respondent.

Sa pakikipagpalitan ng text ng PEP.ph (Philippine Entertainment Portal) kay Atty. Abraham ngayong araw, December 17, bandang 10:46 ng umaga, kinuwestiyon ng abugado ang naging basehan ng reklamo ni Annabelle.

Sinabi rin nitong naaayon sa batas ang kanilang ginawang pagpunta sa opisina ng Royal Artists Management sa Imperial Palace Suites noong December 6.

Aniya, "Is that the basis of the attempted kidnapping case?

"Even a non-lawyer would know that said acts did not constitute the crime of kidnapping.

"With media and the police, paano naman magiging kidnapping yun?

"We acted under the purview of Section 5, Rule 113 in relation to Section 7 Rule 112 of the revised rules on criminal procedure."

Ayon sa Supreme Court E-Library, ang nakapaloob sa Section 5, Rule 113, ay: "A peace officer or a private person may, without a warrant, arrest a person:

"(a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense;

"(b) When an offense has just been committed and he has probable cause to believe based on personal knowledge of facts or circumstances that the person to be arrested has committed it; and

"(c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or is temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another.

"In cases falling under paragraphs (a) and (b) above, the person arrested without a warrant shall be forthwith delivered to the nearest police station or jail and shall be proceeded against in accordance with section 7 of Rule 112. (5a)"
