ELECTION WATCH. Aga Muhlach and Charlene Gonzalez ask Court of Appeals not to remove their names from voters’ list in CamSur

Aga’s legal counsel insists both have complied with the 6-month residency registration requirement.

Aga Muhlach, who is running for congressman in Camarines Sur, and his wife Charlene Gonzales asked Court of Appeals on Thursday to issue temporary restraining order to stop the removal of their names from the voters’ list of San Jose, Camarines Sur.

Hiniling ng mag-asawang Aga Muhlach at Charlene Gonzalez sa Court of Appeals (CA) kanina, January 3, na ipawalang-bisa ang kautusang alisin sila sa listahan ng mga botante ng San Jose, Camarines Sur.

Ayon sa ulat ng Interaksyon, humiling ang mag-asawa ng Temporary Restraining Order (TRO), sa pamamagitan ng kanilang abugadong si Atty. Romulo Macalintal, para pigilan ang Election Registration Board (ERB) sa pagtanggal ng kanilang mga pangalan sa voters’ list.

Matatandaan na noong Disyembre 2012, kinatigan ng Camarines Sur Regional Trial Court (RTC) ang naunang desisyon ng Municipal Circuit Trial Court (MCTC) ng San Jose, Camarines Sur, na alisin na sina Aga at Charlene sa listahan ng mga botante.

Ang desisyong ito ay kaugnay sa isinampang reklamo sa diumano’y di pagsunod nina Aga at Charlene sa six-month residency requirement para maging lehitimong botante sila ng nasabing lugar.

Si Aga ay tumatakbo bilang kongresista sa ika-apat na distrito ng CamSur sa ilalim ng Liberal Party.

Samantala, bilang depensa, sinabi ni Atty. Macalintal na malinaw na sumunod sina Aga at Charlene sa sinasabing six-month residency requirement dahil nagsimula silang manirahan sa San Jose noong February 17, 2012.

Ayon sa website ng Commision ng Elections (Comelec), isa sa mga requirement para maging lehitimong botante ay maging residente ng lugar ng hindi bababa sa anim na buwan bago ang eleksiyon.

Nagsumite ng voter’s registration sina Aga at Charlene noong March 19, 2012. Ito ay naaprubahan ng ERB noong September 28, 2012.

Ang eleksyon ay gaganapin sa Mayo 13, 2013.
