Willie Revillame's legal counsel submits counter affidavit


Earlier this month, the MTRCB filed a case against Willie Revillame for "unethical conduct," stemming from remarks he made while a video inset of Cory Aquino's cortege on his noontime show Wowowee was on air.Last August 20, 2009, Willie's camp attended a clarificatory hearing and submitted their counter affidavit in response to the charge.

Last Thursday, August 20, 2009, members of the Movie and Television Review and Classification Board (MTRCB) attended the last hearing on the case theyfiled against Willie Revillame regarding the TV host's alleged unethical conduct of August 3, 2009. The incident was in reference to Willie's outburst on that date, questioning the presence of a video inset of the late Corazon Aquino's cortege on his noontime program, Wowowee.

The hearing was also attended by Willie, his legal counsel, the ABS-CBN's legal team, and network executive Johnny Manahan.

Startalk was able to interview each side's legal counsel. Willie's lawyer, Atty. Armando Marcelo, commented: "We have submitted our counter affidavits to the complaint, and the body conducted clarificatory questions."

Atty. Zosimo Alegre, legal counsel of the MTRCB, however noted that although a clarificatory hearing had been conducted, this did not mean that evidence had been provided. He said: "Of course, nagpaliwanag siya [Willie]. Pero alam niyo, pag ganyang paliwanagan, actually hindi pa nga ebidensiya 'yan, e. It is a matter of personal views and positions."

The formal complaint filed by the MTRCB stated that Willie breached Section 3-C of Presidential Decree 1996, which refers to action or speech deemed objectionable and contrary to customs and traditions with respect to the dead.

After this, does the MTRCB expect a speedy response to the complaint?

"Submitting of documents na lang at sagutan sa pamamagitan ng memorandum," Atty. Alegre revealed. "'Yon na lang ang gagawin at wala na gaanong formal na hearing na ganito. Decision na ang susunod doon. If may batas na nilabag, e may kaparusahan iyan."

Meanwhile, a different hearing on the issue will be conducted by the Kapisanan ng mga Brokaster ng Pilipinas (KBP). MTRCB Chair Maria Consoliza Laguardia earlier alleged that Willie violated the broadcast code of the Philippines.
