Jennylyn Mercado's camp not happy with the court's decision to acquit Mel Pulmano

"We presented all available evidence including bank personnel who testified having given Mel the checks of Jen. But the judge chose to close his eyes on the evidence presented and limited himself to one point: no one saw Mel forge Jen's signatures on the checks," says Atty. Dismayado ang kampo ni Jennylyn Mercado sa lumabas na desisyon ng korte tungkol sa kasong qualified theft na isinampa ng aktres laban sa dati niyang personal assistant na si Rowena "Mel" Pulmano. (CLICK HERE to read related story.)

Sa desisyon ni Judge Vivencio Baclig ng Quezon City Regional Trial Court Branch 77, sinabi nitong nabigo ang kampo ni Jennylyn na patunayang guilty si Pulmano.

Kaugnay ng pagkaka-acquit ng korte kay Pulmano, isang statement ang ipinadala ng abugado ni Jennylyn na si Atty. Joji Alonso sa PEP (Philippine Entertainment Portal):

"Today [January 25], Judge Vivencio S. Baclig acquitted Rowena "Mel" Pulmano of qualified theft. He chose not to give import to the testimony of the expert witness who proved that the signatures in Jennylyn's checks were all forgeries.

"He also simply dismissed the fact that Mel Pulmano deposited at least 2 forged checks to her own account.

"In justifying his decision, he said: 'Although the court is not certain as to her innocence, it is also not certain as to her guilt, hence, it is its duty to acquit her.'

"At the moment, Mel Pulmano faces 2 other criminal cases, one of which is non-bailable.

"Jennylyn and Becky will continue to relentlessly pursue the same as Mel should not be given a chance to make anyone suffer the same fate thay they had."

Ang Becky na tinutukoy ni Atty. Joji ay ang manager ni Jennylyn na si Becky Aguila.

Sa panayam ng PEP kay Atty. Joji ay tinanong namin siya kung ano ang reaction at opinyon ni Atty. Joji sa naging desisyon ng korte?

"I feel sad for Jen because justice was not served her. Just because Mel was acquitted does not mean she did not commit the crime.

"May he [the judge] enjoy his retirement," makahulugang sabi ni Atty. Joji.

Ayon pa sa abugado ng aktres, hindi na sila puwedeng mag-appeal pa dahil sa principle of double jeopardy. Ibig sabihin nito ay hindi na puwedeng dinggin ng korte ang isang kaso na nadesisyunan na nila.

Pero kahit na-acquit si Mel sa nasabing kaso, sabi ni Atty. Joji, ay hindi pa rin ito puwedeng lumabas sa kulungan dahil may dalawa pa siyang kasong hinaharap—isang estafa case at qualified theft na non-bailable.

"These are totally separate and distinct from Jen's case. So she will stay in jail," pahayag ng legal counsel ng aktres.

Nalulungkot din ang manager ni Jen na si Becky Aguila sa naging desisyon ng korte.

Aniya, "Mas binigyan pa niya ng timbang ang kawalan ng saksi sa pagpirma ng forged signatures ni Jen. Kelan ba naman nangyari na nagpahuli ang criminal? Alangan namang ipakita pa niya sa iba ang pag-forge ng signatures ni Jen?

"Dismayado kami sa naging desisyon ng presiding judge, pero hindi kami titigil hanggang hindi namin nakakamit ang hustisya para hindi na makapaminsala pa kahit kelan si Rowena Pulmano."

Pinili namang manahimik muna ni Jennylyn tungkol sa pagkaka-acquit ng korte kay Pulmano.
