Part 2. Nadia Montenegro and her lawyers want QC Prosecutor's Office to "reassess" decision on child abuse case against Annabelle Rama

Dahil sa hindi makumbinsi ang mga nilapitan nilang tao para maging witnesses sa kaso nilang child abuse laban kay Annabelle Rama, inamin ng abugado ni Nadia Montenegro na si Atty. Dexter B. Lacuanan na inaasahan na niyang madi-dismiss nga ng Quezon City Prosecutor’s Office ang kaso nilang ito laban sa talent manager.

Pero bawi rin agad ni Atty. Lacuanan sa mga kaharap na miyembro ng media na dumating sa ipinatawag na presscon ni Nadia kahapon, Abril 19, sa TJ Resto, Quezon City, “I was just a little bit disappointed, kasi I thought that the statement of the kids themselves would’ve been sufficient to mete probable cause.

“That is why we are now appealing and filing our Motion for Reconsideration…”

Matatandaang nitong Lunes, Abril 16, lumabas ang balitang na-dismiss ng Quezon City Prosecutor’s Office ang kaso ni Nadia ng child abuse laban kay Annabelle, habang pinagtibay naman sa resolusyon ang 14 na kaso ng libel at dalawang kaso ng unjust vexation and grave oral defamation laban sa talent manager

RE-ASSESS. Kasamang humarap sa media ang kliyenteng si Nadia at mga anak nitong sina Ynna at Anykka Asistio, at kapwa abugado na si Atty. Maggie Abraham, sinabi pa ni Atty. Lacuanan na hindi lahat ng alegasyon nila sa kasong child exploitation laban kay Annabelle ay natingnang maigi ng Prosecutor’s Office.

Sabi ni Atty. Lacuanan, “The Resolution did not tackle all the allegations of child exploitation. Only some were discussed in the Resolution, and we wanted to invite the attention of the investigating prosecutor na dalawing uli at ire-assess nilang uli.”

Ayon naman kay Atty. Abraham, “There are some facts that have been misappreciated or not have been considered.

“Like for example, the most important facts there [are] the rumors that were spread against the children of Nadia. That one of the children was raped and another child suffered from STD.

“So I believe that the Office of the City Prosecutor must consider this matter as well for the resolution to be reconsidered and reversed.

“So, dun sa Motion for Reconsideration namin, may mga facts kami na mas lalo pa naming ipu-push para ipakita sa Office of the City Prosecutor that, indeed, the crime was committed."

Saad naman ni Nadia, “’Tsaka kailangan na maintindihan n'yo, yung parang pinagdiinan nila dun yung 40 hours of working time na nirereklamo ko sa mga anak ko. Kailangang malinaw yun, hindi ko nirereklamo yung 40 oras na…

“Ang dami pa dun na kailangang basahin kung bakit ko nireklamo yun.

“I mean, ang tagal-tagal ko na sa business na ‘to. Alam ko ang working hours. Hindi naman ako ganun kababaw na yun lang, irereklamo ko.

“Tingnan nila kung bakit. Dahil nag-suffer ang school ng mga anak ko, hindi natupad ang lahat ng pinag-usapan namin, marami siyang ipinagawa na hindi na dapat. Hindi lang yung 40 hours, e.

“Kaya sana, basahin ulit nang maayos kasi napakadami naming nilagay dun na reasons, hindi lang yun.”

NOT APPRECIATED. Sa pagsasalitang muli ni Atty. Lacuanan, sinabi niyang kaya rin daw na-dismiss sa kaso ng child abuse si Annabelle ayon sa resolution ng Quezon City Prosecutor’s Office ay dahil wala naman daw “decision-making authority” si Annabelle bilang manager nina Ynna at Anykka. Para sa parents daw ang authority na ito.

“To a certain extent, as I pointed out, tama yung appreciation ng investigating prosecutor dun.

"Except that, as I earlier pointed out din, that is a statement from someone who does not belong in the [showbiz] industry.

“So, hindi siguro na-appreciate yung nuances that the person involved [Annabelle] actually makes the decision for the children, and sometimes, does not even inform the mother.

“Yun yung sinabi namin sa initial complaint. Kaya nga nung malaman ni Nadia yung mga nangyayari, that’s why she decided she wanted to file this case. It’s very important lang to point that out.

“Again, I do not take it against the prosecutor. But in our Motion for Reconsideration, we will probably try to enlighten her [prosecutor] and we will probably try to argue this point further.”

Sinubukang kunin ng PEP.ph (Philippine Entertainment Portal) ang panig ng Quezon City Prosecutor's Office hinggil sa mga sinabing ito nina Atty. Lacuanan at Atty. Abraham.

Nakausap naman ng PEP si Assistant City Prosecutor Jovie M. Calderon na siyang gumawa ng Resolution, ngunit tumanggi itong magbigay ng pahayag hinggil sa mga sinabi ng dalawang abugado ni Nadia.

Ini-refer na lamang ni Asst. City Prosecutor Calderon ang PEP sa QC Chief Prosecutor na si Donald Lee, ngunit ayon sa staff nitong nakausap ng PEP ay naka-leave ito ngayong araw, April 20, at sa Lunes (April 23) pa ang balik.

Inayunan naman ni Nadia ang mga sinabi ni Atty. Lacuanan.

“Siguro naman, yun nga, hindi nga alam ng mga prosecutor kung paano maging manager ang isang Annabelle Rama.

"I mean the people in the industry do understand siguro kung ano yung hirap din na pinagdadaanan ko. Because you know how she is.

“May mga maliliit na bagay na hindi puwedeng makialam daw ang mga magulang, to the point na ako na yung nakikialam kasi nakikita ko na yung hirap ng mga bata, yung mga maling nangyayari.

“And ano ang ending, di ba? Mumurahin ka, makikipag-away. No matter how hard I tried na makipag-usap sa kanya nang maayos, na madaan lahat ito sa madaling pakiusap, hindi.

“I mean she has done it in the past to her other talents. So, I mean, what makes my children different from her other talents?

“It just has to stop. It really has to stop.

"Siya lang yata yung katangi-tanging ganito. Na walang karapatan yung mga talents niyang magreklamo, walang karapatang magpahinga, walang karapatang lahat.”

NOT DISAPPOINTED. Dismissed man ang kaso ng child abuse, hindi naman daw disappointed si Nadia sa Resolution ng Prosecutor’s Office.

“Parang kahit papa’no yung 14 counts ng libel na yun at yung dalawang unjust vexation, it just proves that what I am saying is true. I just have to prove more on the other case.”

Malaki raw ang tiwala ni Nadia sa Philippine justice system at sa kanyang mga abugado kaya nga raw siya nag-file ng Motion for Reconsideration.

“I will try again by filing a Motion for Reconsideration, baka basahin nila ulit nang maayos at maintindihan nila lalo yung punto namin,” ani Nadia.

Tungkol naman sa kanyang mga anak na sangkot sa kontrobersiyang dulot ng kaso, patibay raw nang patibay ang mga ito at pati na rin ang buo nilang pamilya.

Ayon kay Nadia, “We just go stronger every day. It is not easy, definitely hindi madali.

“It’s been what? Six months nga, e, since I filed.

"Pero yung paghihirap namin, magdadalawang taon na. Yung hirap namin as the manager of my children. “

Sabi pa ni Nadia, hindi lang ang mga anak niya ang inaaway ng partido nina Annabelle. Buong pamilya na raw nila at pati na ang kapatid niya’t mga kaibigan.

“Yung kapatid ko na nagtatrabaho nang tahimik, mga kaibigan ko, may malaman lang sila na may kumakampi sa akin, lahat na.

“Ang dami na nilang inaway, ang dami na nilang kinakawawa. It just has to stop,” pahayag ni Nadia.

Sinubukan ng PEP ng kunan ng reaksiyon si Annabelle sa mga naging pahayag ni Nadia, ngunit tumanggi itong magsalita.
