Binaligtad ng chief prosecutor ng Quezon City Prosecutor’s Office ang naunang desisyong ibasura ang libel complaint na inihain ni Gretchen Fullido laban sa ilang kasamahan sa ABS-CBN News and Current Affairs.
Ito ay matapos maghain ng Motion for Reconsideration ang kampo ni Gretchen.
Sa resolusyong pirmado ni Quezon City Chief Prosecutor Vilma Barcellano, at may petsang April 29, 2019, may sapat daw basehan ang reklamo ni Gretchen laban sa broadcast journalist na si Cecilia "Ces" Oreña Drilon, showbiz news reporter na si Marie Lozano, at news executive na si Venancio Borromeo.
Ibig sabihin nito, maaari nang iakyat ang kaso upang magkaroon ng pormal na pagdinig sa hukuman.
Dahil nakitaan ng probable cause ang reklamo ni Gretchen, inirekomenda ng chief prosecutor ng Quezon City ang paglabas ng warrants of arrest laban sa tatlong akusado kasabay ng pagsasampa ng libel case sa korte.
THE FIRST DECISION
Noong October 5, 2018, sinampahan ni Gretchen ng libel complaint sina Ces, Marie, at Venancio.
May kinalaman ito sa hiwalay na sexual harassment complaint na isinampa ng TV Patrol entertainment reporter laban kina ABS-CBN News executive Cheryl Favila at ABS-CBN News segment producer Maricar Asprec.
Sa January 2019 resolution ng Quezon City Prosecutor’s Office, dinismiss ni Quezon City Assistant City Prosecutor Arceli C. Ragsac ang libel complaint ni Gretchen laban kina Ces, Marie, at Venancio.
Hindi ito ikinatuwa ng kampo ni Gretchen.
Naghain sila ng motion for reconsideration sa QC Prosecutor’s Office noong April 4, 2019 upang muling pag-aralan ang kanilang reklamo.
Ayon pa sa legal counsel ni Gretchen na si Atty. Eldrige Marvin Aceron, hindi pinal ang naunang pagbasura ng inihain nilang reklamo.
Bahagi ng kanilang pahayag: “We have filed this afternoon our Motions for Reconsideration on the resolutions of the Quezon City Prosecutor's Office regarding the cases filed by Gretchen Fullido for Libel.
“Please do not be misled into believing that the cases have been dismissed with finality.
"The filing of the Motions for Reconsideration, ten days from receipt of the resolutions, keeps the cases alive.
"And in the event of denial, we have resolved to file a Petition for Review with the Department of Justice.”
Sa bagong resolusyon ng Prosecutor’s Office na inilabas nito lamang April 29, 2019, sinabi rito ni Quezon Chief City Prosecutor Vimar Barcellano na sina Ces, Marie, at Venancio “all acted in bad faith when they issued libelous statements against Fullido.”
Patungkol kay Ces, ito ang nakasaad sa resolusyon:
"Respondent acted with malice when the imputation contained in her Affidavit appears to be absolutely discreditable tending to impeach the virtue and reputation of complainant.
“Respondent went beyond board and what is relevant on the case when she linked the act complained of to an alleged incident where complainant have many times received inappropriate comments from other members of TV Patrol, which in her opinion also constituted acts of sexual harassment.
"Respondent went farther when she said that complainant was willing to wear a bikini on television for TV Patrol’s ratings.
“It can be deduced from the words of respondent that she jumped into a conclusion or assumption that Complainant could easily ignore such unpleasant acts, as if she welcomed the same.”
