GMA-7 reacts to ABS-CBN’s statement that the former "should refrain from commenting" on the latter’s case against AGB Nielsen: "GMA Network is rightfully interested in making sure that only accurate information is disseminated to the public based on available court records."

Ito ang reaksiyon ng GMA-7 sa naging pahayag ng ABS-CBN na hindi na dapat nagkukomento ang Kapuso network tungkol sa kaso ng Kapamilya network laban sa AGB Nielsen.

Wala naman daw kinalaman ang GMA-7 sa naturang kaso.

Kaugnay ito ng isinampang kaso ng ABS-CBN noong 2007 laban sa AGB Nielsen, kung saan sinasabi ng Kapamilya network na dinaya ng GMA-7 ang ratings sa ilang bahagi ng Bacolod at Iloilo.

Nang mga panahong iyon, parehong kliyente ng AGB Nielsen ang Kapamilya at Kapuso networks.

Sa kasalukuyan, AGB Nielsen pa rin ang ratings service provider ng Kapuso network, habang Kantar/TNS na ang sa Kapamilya network.

Ayon sa naunang statement na ipinadala ng GMA network, sa pamamagitan ni Corporate Communications consultant Butch Raquel, sa PEP.ph (Philippine Entertainment Portal) noong Disyembre 28, 2011:

"The case filed by ABS-CBN against AGB was dismissed by Quezon City Regional Trial Court (RTC) Presiding Judge Charito Gonzales on January 7, 2008 for being prematurely filed.

"The Court likewise denied the Motion for Reconsideration filed by ABS-CBN in an Order dated June 8, 2009."

Sinagot naman ito ng ABS-CBN, sa pamamagitan ng kanilang Corporate Communications head na si Bong Osorio, sa ipinadala nilang statement sa PEP noong Disyembre 29, 2011.

Ayon sa Kapamilya network, "pending" pa ang naturang kaso.

Nakasaad sa statement ng ABS-CBN ang sumusunod:

"The ABS-CBN case against AGB is still pending resolution at the Court of Appeals, contrary to what GMA says has already been resolved.

"GMA is not party to the case and should refrain from commenting on it."

Dito’y nilinaw ni Raquel na ang nauna nilang sinabi na "dismissed" na ang kaso ng ABS-CBN laban sa AGB Nielsen ay base sa "court records."

Ito raw ay ayon sa "Certificate of Finality issued by Atty. Maila Doroteo Santos, Branch Clerk of the Quezon City RTC on January 5, 2010; And the Orders dated October 27, 2010 and March 21, 2011 from Quezon City RTC Presiding Judge Charito Gonzales."

Dito raw ay nakasaad na "the dismissal of ABS-CBN’s case against AGB Nielsen is final and executory and that the subsequent Petition for Relief from Judgment and Motion for Reconsideration filed by ABS-CBN have been dismissed."

GMA-7’S PRESS RELEASE. Narito ang kabuuang statement mula sa GMA-7:

"GMA Network is rightfully interested in making sure that only accurate information is disseminated to the public based on available court records.

"This is precisely the reason behind GMA-7’s letter - wherein the Network clarified that ABS-CBN’s case against AGB Nielsen has already been dismissed - which was sent to various media organizations last week.

"Said letter was based on the following court records: the Certificate of Finality issued by Atty. Maila Doroteo Santos, Branch Clerk of the Quezon City RTC on January 5, 2010; and the Orders dated October 27, 2010 and March 21, 2011 from Quezon City RTC Presiding Judge Charito Gonzales, which stated that the dismissal of ABS-CBN’s case against AGB Nielsen is final and executory and that the subsequent Petition for Relief from Judgment and Motion for Reconsideration filed by ABS-CBN have been dismissed."
