Annabelle Rama’s camp to request court to review dismissed theft complaint against Nadia Montenegro

Annabelle Rama and her lawyers are ready to face whatever charges Nadia Montenegro will file against the talent manager. According to one of Annabelle’s legal counsel, Atty. Connie Jimenez-Aquino, "We cannot say na posible pa ‘yong settlement.”


Naniniwala ang kampo ni Annabelle Rama na may sapat silang ebidensiyang susuporta sa theft charges na isinampa nila laban kay Nadia Montenegro.

Kaya naman maghahain sila ng Motion for Reconsideration para sa kasong ito na nauna nang na-dismiss kamakailan ng prosecutor ng San Juan City.

Ayon sa legal counsel ni Annabelle para sa kasong ito, si Atty. Connie Jimenez-Aquino, may “probable cause” ang talent manager na magsampa ng kasong theft laban sa anak ng kanyang tatlong talents na sina Ynna, Anykka, at Alyanna Asistio.

“We will ask the prosecutor to consider the evidence again kasi, in the first place, based on the affidavit exchanged by the parties, na-establish na may taking on the part of Ms. Montenegro.

"Klaro na ginawa niya ‘yong mga gamit ni Ms. Annabelle Rama,” sabi ni Atty. Jimenez nang makapanayam siya ng PEP.ph (Philippine Entertainment Portal) sa telepono kahapon, Abril 29.

Matatandaan na sa affidavit na isinumite ni Annabelle sa San Juan Prosecutor’s Office, sinabi niya na bukod sa hiniram na sofa set, kinuha rin umano ni Nadia ang 10 antique accent chairs, 65-inch Sony TV, designer frame set, accent table, three beds with headboard and mattresses, antique cabinet, at isang set ng BelKraft stainless steel pots and pans.

Subalit sa ekslusibong panayam ng PEP kay Nadia noong nakaraang linggo, inihayag niya na walang pagnanakaw na naganap.

Base sa kuwento ng dating aktres, si Annabelle diumano ang nag-alok sa kanya na kumuha ng mga gamit mula sa kanyang storage.

Sabi raw ni Annabelle kay Nadia, “Ang dami kong gamit sa storage, kailangan end of the month wala na akong gamit do’n dahil ang laki-laki ng binabayaran kong renta do’n. Magdala ka ng sarili mong truck.’”

Isa sa mga dahilan ng pagkaka-dismiss ng kasong theft laban kay Nadia ay ang panahon ng paghahain nito.

Pahayag ni Atty. Aquino, “Sinasabi rin ng fiscal na dinismis nila kasi how come it took so long for Ms. Annabelle to file the case, bakit one year.

“But then, ‘yong nakaligtaan o baka hindi pa na-appreciate ng prosecutor is the fact that the crime of theft describes ‘yong 15 years.

“So, it doesn’t matter na one year after nilang na-file or two years after kasi it’s within the prescription period of 15 years.”

Dahil dito, hihilingin daw nila sa korte na muling tingnan ang kasong kanilang inihain laban kay Nadia.

“We’re getting her attention on the evidences that we presented. There was really a probable cause to file theft case,” ani Atty. Aquino.

ON LIBEL CASE AGAINST ANNABELLE RAMA. Samantala, natanong din ng PEP kay Atty. Aquino ang tungkol naman sa pagkaka-dismiss ng kasong child abuse na inihain ni Nadia laban sa kanilang kliyenteng si Annabelle.

Dahil daw dito, may posibilidad na ma-dismiss na rin ang kasong libelong may kinaslaman sa kasong child abuse na parehong naisampa laban kay Annabelle.

Sa isang statement na inilabas noong Abril 20 ng Calleja Law Office—ang law firm na nagre-represent kay Annabelle—nabanggit dito na balak din nilang magsampa ng motion for reconsideration para sa naiwan pang kaso.

Sa bahagi ng statement na ito nasasaad, “With regard to the libel cases still pending, it is likewise our client’s right to file the proper motion for reconsideration with regard to the said cases. However, we would like to reiterate that the said libel charges are merely an offshoot of the principal case for child abuse. And now that the principal case has been dismissed, we are confident that these charges will likewise be eventually dismissed.”

Mariing sinabi ng abogado ni Nadia na si Atty. Marie Glenn Abraham na bagamat dismissed na ang kasong child abuse, patuloy pa rin ang kasong libelo laban kay Annabelle.

Ayon kay Atty. Abraham, “Itong mga bagay na ‘to, ang layo niya sa case na child abuse, at ang layo niya as defense do’n sa child abuse.

“Paano natin masasabi na konektado ‘yon sa child abuse, that the dismissal of child abuse will be tantamount to the dismissal of the libel case?”

Subalit paliwanag naman ni Atty. Aquino sa PEP, “Ang sinasabi lang namin doon is because nawala na ‘yong child abuse—‘yon naman ang pinagmulan, e, ‘yan ang principal action. ‘Yan ang unang-unang pinag-awayan nila.

“Confident lang kami na madi-dismiss ‘yong libel because, in the first place, ‘yon naman ang pinagmumulan, e, lahat ng mga nasabi, pinagsasabi.

“We’re just saying that their evidence is weak.

“For us, alam namin na matatanggal ‘yon. We’re confident naman na madi-dismiss ‘yon.”

FIGHTING IT OUT. Sa panayam ng The Buzz kay Annabelle na ipinalabas kahapon, Abril 29, sinabi ng talent manager kay Nadia, “Hindi kita uurungan.”

Tila ito nga ang magiging aksyon ng kampo ni Annabelle sa kabila ng balitang pagsasampa ni Nadia ng motion for reconsideration para sa na-dismiss na kasong child abuse.

Ayon kay Atty. Aquino, “I’m sure they’re going to appeal sa mga charges that were dismissed.

“We will confront all other actions that Nadia continues to, you know, file against [Annabelle].

“Sa pagkakaalam namin, maghahain na naman daw siya ng panibagong petition.

“Whatever it is, we will continue to confront all the charges they have against our client.”

Sa pagtatapos ng panayam, tinanong ng PEP si Atty. Aquino kung may pag-asa bang magkaroon ng maayos na settlement sa pagitan nina Nadia at Annabelle.

Ang sagot ng isa sa mga legal counsel ni Annabelle, “As we said before, puwede namang pag-usapan, puwede.

“But then, with the actuations of both parties, at this point, we cannot say na posible pa ‘yong settlement.”
