Aga Muhlach cleared by Comelec on residency issue

Wala nang hadlang sa kandidatura ni Aga Muhlach bilang congressman sa Camarines Sur ngayong eleksiyon matapos desisyunan ng Second Division ng Commission on Election (Comelec) sa kanyang pabor ang disqualification case na isinampa laban sa kanya dahil sa kakulangan ng merito ng kaso.


Lusot na ang aktor na si Aga Muhlach sa isyu ng residency kaugnay ng kanyang pagtakbo sa Camarines Sur, ayon sa desisyon ng Second Division ng Commission on Election (Comelec).

Last March 5 pa daw na-dismiss ng Comelec ang disqualification case na isinampa kay Aga dahil daw sa kakulangan ng merito ng kaso.

Sa ulat ng interaksyon.com kahapon, March 14, napatunayan daw ni Aga na nakumpleto niya ang kanyang one-year residency requirements prior to the 2013 elections.

Ayon pa sa labintatlong pahinang desisyon ng second division ng Comelec na pinamumunuan ni presiding commissioner Elias Yusoph, katuwang si commissioner Maria Gracia Padaca, “The instant petition is hereby dismissed for lack of merit.”

Ayon pa sa Comelec resolution, “[Aga was] able to adduce substantial evidence to demonstrate compliance with the one-year residency under the law.

“His ancestry is traced in the province of Camarines Sur. Respondent established his actual physical presence in the district. As early as April 2011, he purchased a property in San Jose Camarines Sur.”

Ayon pa sa desisyon ng Comelec, hindi nagpresinta ng matibay na ebidensiya ang mga petitioners na sina Crispin Imperial at Francisco Perico Dizon ng barangay San Juan, San Jose, Camarines Sur, kaya na-dismiss ang kaso.

Dagdag pa sa resolution, “[The petitioners] never presented any evidence that the respondent deliberately intended to commit the alleged false representation to deceive the electorate.”

Pinaninidigan daw ng mga nagreklamo sa aktor ang kanilang claim na hindi taga-San Jose, Camarines Sur si Aga, pero “no proof was ever presented to show that the respondent, when he filed his certificate of candidacy, at least knew of his ineligibility to office, and despite such knowledge, intends to deceive the electorate by passing himself off as eligible for public office.”
