Comelec reverses decision; Imelda Papin can now run for Congress in San Jose del Monte City

After having been disqualified last January, Imelda Papin has been granted permission to run for a congressional seat in San Juan del Monte City, Bulacan after Comelec reversed its previous decision.

May go-signal na ang dating jukebox queen na si Imelda Papin na tumakbo sa pagkakongresista sa lone district ng San Jose del Monte City sa Bulacan, matapos bawiin ng Commission on Elections (Comelec) ang naunang disqualification nito kay Papin.

Matatandaang noong Enero ay na-disqualify ang former singer sa pagtakbo sa nasabing lugar dahil umano sa kakulangan ng residential requirements sa naturang bayan.

Pero sa inilabas na 22-page decision na inaprubahan ni Comelec Chairman Sixto Brillantes Jr. kamakailan, sinasabi nito na inaaprubahan na ng commission en banc ang motion for reconsideration na isinumite ni Papin at ng abogado nitong si Atty. Romulo Macalintal na makatakbo ang dating singer sa congressional race sa San Jose del Monte City.

Sinabi ni Brillantes sa desisyon na ang resolusyon ng Commission (second division) noong January 31, 2013 na nagdi-disqualify kay Papin ay binabawi na.

Ayon pa sa desisyon, wala umanong “deliberate attempt” si Papin na i-misrepresent ang kanyang residence na nakasaad sa kanyang certificate of candidacy, “simply because she believed that she has transferred to San Jose del Monte City and will be eligible to seek the position of congressional representative of the city come the May 13, 2013 elections."

Sinasabi rin sa desisyon na kung sa obserbasyon ng ibang tao na naninirahan na sa San Jose del Monte city si Papin, “respondent [Papin] cannot be faulted also for believing and stating in good faith that she had effectively transferred to the said City."

Naunang pinaboran ng Comelec ang petisyon ni Zosimo B. Lorenzo, secretary general ng Arangkada San Joseno Political party, na huwag payagan si Papin na tumakbo bilang kongresista sa kanilang lugar.

Sinabi ni Lorenzo na di maaaring tumakbo sa distrito sa Bulacan si Papin dahil wala siyang sapat na katibayan na siya ay residente ng San Jose del Monte City, at sa Quezon City talaga nakatira ang dating singer.

Dagdag pa sa bagong desisyong inilabas ng Comelec, “The Supreme Court has ruled that there is nothing wrong in an individual changing residences so he could run for an elective post, for as long as he is able to prove with reasonable certainty that he has effected a change of residence for election law purposes for the period required by law. The required period of residency at the place where one seeks to be elected is at least one-year immediately preceding the day of the elections."
