Court denies permanent protection order filed by Kris Aquino’s camp for son Bimby against James Yap

The Makati Regional Trial Court denied the permanent protection order requested by Kris Aquino’s camp for her son Bimby against James Yap. Yet the same court has granted Kris’s request for PPO for herself, which still restricts James from visiting his son.


Hindi iginawad ng Makati Regional Trial Court ang permanent protection order (PPO) na hiniling ni Kris Aquino— tumatayong tagapagsalita ng anak na si James Yap Jr. o Bimby— laban sa dati nitong asawa na si James Yap.

Ayon sa text message na ipinadala ni Atty. Sonya Castillo, isa sa mga legal counsel ni James, sa PEP.ph (Philippine Entertainment Portal) ngayong gabi, Mayo 29, “Court denied their prayer for PPO vs. Bimby.”

Sinabi naman ni Atty. Lorna Kapunan, isa pa sa mga abugado ni James, sa ABS-CBN News ngayong araw, Mayo 29, dumating sa kanila ang court order noong Mayo 21.

Nangangahulugan lang daw ito na mababalewala na ang temporary restraining order (TRO) na nai-file noon ng kampo ni Kris laban kay James.

Ibig sabihin din daw ay maaari nang makitang muli ni James ang kanyang anim na taong gulang na anak.

Sabi ni Atty. Kapunan, “Since he [James Yap] is attending an event in Escalante [Negros Occidental], we will be asking for a visit on Sunday.

“We will try to get soon a schedule to visit, if Kris or the yaya [will not allow it], it will clearly be contemptuous of court.”

THE FIGHT IS NOT OVER. Pero tila iba ang sinasabi ng abugado ni Kris na si Atty. Frank Chavez tungkol dito.

Ayon kay Atty. Chavez, hindi man na-grant ang PPO na hiniling nila para kay Bimby, naibigay naman ang PPO na hiniling ni Kris para sa kanyang sarili.

Matatandaan na Marso nitong taon ay nag-file ang TV host-actress ng PPO laban kay James dahil sa ground na ito: “overstepping his boundaries and of attempting to seduce her while visiting her home, and of inflicting psychological harm on their son Bimby.”

Kaakibat ng PPO na ito, hindi maaaring lumapit si James kay Kris, sa kanilang anak, at sa kanilang mga kasambahay “at least 100 meters... from her residence, school, place of employment or any place frequented by her and her son.”

Sabi ni Atty. Chavez sa ABS-CBN News, “The court found evidence that James Yap inflicted psychological, emotional hurt and harm on Kris with sexual undertones.”

Ito ay isang bagay na ikinasaya umano ni Kris dahil “she said she can no longer be pestered by James.”

Dagdag pa ni Atty. Chavez, magpa-file sila ng apela sa naging desisyon ng korte na hindi ibigay ang PPO na hinihingi nila para kay Bimby.

Kaya naman sabi ng legal counsel ni Kris, “The issue regarding whether or not he can visit his son is not yet resolved with finality.

“James Yap can’t come near 100 meters of Kris.

“He, therefore, can’t see Bimby. I can’t see on the horizon any [reunion] this Sunday or several Sundays from now. There are issues that have to be resolved.”

Pero kung sakaling hindi pa rin ibigay ng korte ang hinihingi nilang PPO para kay Bimby, sabi ni Atty. Chavez, “We can live with that, provided conditions are met…

“He will have to prove to be a father who will not inflict psychological, physical, emotional stress or strain on his son.

“[The] father and son can interact in the right way.”
