Cesar Montano’s lawyer: My client did not abuse Sunshine Cruz

Isang official statement ang inilabas ng abugado ni Cesar Montano na si Joel Ferrer upang pabulaanan ang mga alegasyon ng aktres na si Sunshine Cruz laban sa asawa nitong aktor.


Naglabas ng opisyal na pahayag ang abugado ni Cesar Montano na si Atty. Joel Ferrer ngayong araw, August 14, bilang sagot sa inihaing reklamo ni Sunshine Cruz laban sa aktor.

Ayon kay Atty. Ferrer, ang isinampa ni Sunshine na paglabag diumano ni Cesar sa Republic Act 9262 o Anti-Violence Against Women and Their Children Act ay "verbatim rehash" lamang ng petition for protection order na unang inihain ng aktres.

Pinabulaanan din ng abugado ni Cesar ang mga paratang ni Sunshine laban sa aktor.

Hindi raw inabuso ni Cesar si Sunshine "whether physical or verbal."

"Simply preposterous" naman daw ang akusasyong marital rape.

Inulit ni Atty. Ferrer ang naging pahayag niya kaninang umaga sa Unang Hirit ng GMA-7 tungkol sa nangyari noong May 12, 2013.

"From what we know, my client was invited by Cruz to join her and their children for dinner on May 12, 2013, Mothers’ Day. They had dinner at the Edsa Shangrila Hotel. Thereafter Montano slept and stayed overnight at the present residence of Cruz. He left the place the following day. The two even had exchanges of text messages of good nature belying any animosity between them several days after the Mothers’ Day celebration."

Tungkol naman sa kustodiya ng kanilang tatlong anak, ayon kay Atty. Ferrer, ang mga bata raw ang may gusto na manatili sa kanilang tahanan sa Tivoli Royale kasama si Cesar.

Malaya rin daw makita ni Sunshine ang kanilang mga anak sa anumang oras na gustuhin nito—sa bahay nila sa Tivoli o sa eskuwelahang pinapasukan ng mga bata.

Pero si Sunshine daw mismo ang may desisyon na hindi pumunta "probably due to her hectic work schedule."

Naniniwala rin ang abugado ni Cesar na ang paghahain si Sunshine ng mga reklamo laban sa asawang aktor ay upang makakuha ng "leverage" sa kanyang pagnanais na ma-annul ang kanilang kasal.

Hanggang ngayon daw kasi ay ginagawa ni Cesar ang lahat upang maisalba ang kanilang kasal alang-alang sa mga anak nila.

FULL STATEMENT. Narito ang kabuuang pahayag ni Atty. Ferrer:

"The criminal complaint for violation of R.A. 9262 filed by Sunshine Cruz against my client, Cesar Montano, is a mere verbatim rehash of the petition for protection order earlier filed.

"It must be recalled that the application for a Temporary Protection Order (TPO) was denied by the court last week though a hearing for the protection order is set on Aug. 15.

"Be that as it may, my client vehemently denies the charges and prevarications leveled against him as contained in the complaint of Cruz. We maintain that there is no truth whatsoever that my client abused Cruz whether physical or verbal. The marital rape Cruz is alluding to is simply preposterous.

"From what we know, my client was invited by Cruz to join her and their children for dinner on May 12, 2013, Mothers’ Day. They had dinner at the Edsa Shangrila Hotel. Thereafter Montano slept and stayed overnight at the present residence of Cruz. He left the place the following day. The two even had exchanges of text messages of good nature belying any animosity between them several days after the Mothers’ Day celebration.

"Relative to the custody of the children, it is actually the children’s preference that they stay at their family residence at Tivoli Royale. It is also worth mentioning that Cruz is at liberty to see them anytime whether at the Tivoli residence or in the school where the children go to every single day. It is Cruz’s expressed decision not to go probably due to her hectic work schedule.

"We believe Cruz filed the cases against Montano to gain leverage in her fervent desire to seek an annulment of their marriage.

"To this date Montano is exerting earnest effort to preserve their matrimonial bond especially for the sake of their children."
