Vhong Navarro’s lawyer hits back at Deniece Cornejo’s lawyer for resorting to “name-calling, personal insults, defamatory insinuations”

Vhong Navarro’s lawyer Atty. Alma Mallonga on Deniece Cornejo camp’s allegations against her client: "Hindi naman siguro tamang ipamalita sa publiko ng isa sa mga akusado na winasak ni Vhong ang kanyang buhay, at sa ganoon ay ipalabas na si Vhong pa ang may sala. Hindi naman puwedeng tiisin na lamang ang paninirang ito."


Inalmahan ng legal counsel ni Vhong Navarro na si Atty. Alma Mallonga ang pahayag ng legal counsel ni Deniece Cornejo na si Atty. Ferdinand Topacio na “bully, unprofessional, at unethical” siya.

Unang pinabulaanan ni Atty. Mallonga ang alegasyong inaway at siniraan niya ang dating hurado na may hawak sa serious illegal detention case na isinampa ng kanyang kliyente laban kina Cedric Lee, Deniece Cornejo, at Zimmer Raz.

“I deeply regret that there has been resort to name-calling and personal insults in this case, as well as defamatory insinuations that the prosecution had any hand in circulating imputations of wrongdoing on the part of the former judge.

“The prosecution's earlier motion to inhibit was a legal remedy that it believed was appropriate under the circumstances, and it was filed invoking legal grounds,” pahayag ni Atty. Mallonga sa isang bahagi ng kanyang opisyal na pahayag na ipinadala sa PEP.ph (Philippine Entertainment Portal) ngayong Biyernes, July 3.

Ito ay matapos ihayag ni Atty. Topacio na “inaway” ni Atty. Mallonga si Judge Esperanza Paz-Cortes ng Taguig Regional Trial Court, matapos i-grant ang bail petition ng grupo ni Cedric Lee noong September 12, 2014.

Kaugnay pa rin ito ng kasong serious illegal detention na kinahaharap ng mga akusadong sina Cedric, Zimmer, at Deniece matapos makaranas diumano ng paggapos, pambubugbog, at pananakot ang complainant na si Vhong.

Sa ulat ng PEP.ph (Philippine Entertainment Portal) kagabi, July 2, inihayag ng legal counsel ni Deniece na si Atty. Topacio na “inaway” ng abugada si Judge Esperanza Paz-Cortes ng Taguig Regional Trial Court, matapos i-grant ang bail petition ng grupo ni Cedric noong September 12, 2014.

Sabi sa isang bahagi ng pahayag ni Atty. Topacio: “Ang hirap naman sa kanila, ‘pag hindi pabor sa kanila, hindi naintindihan ang court.

"Si Atty. Mallonga is ano... she’s one big bully, binu-bully niya yung court, e.

“Katulad nung kay Judge Esperanza Paz Cortez, natalo sila, na-grant yung bail, e, inaway niya yung Huwes.

"Kung anu-ano pang sinasabi nila na kesyo binayaran daw, hindi naintindihan, ipina-inhibit nila yung judge.

“Yung judge naman nag-inhibit, inilipat sa ibang judge.

"Yung judge naman na ito, kinatigan yung decision ni Judge Cortez, si Judge Mariam Bien."

RIGHT TO SEEK PLEA VS. CEDRIC, DENIECE, ZIMMER BAIL. Sa puntong ito, nilinaw ni Atty. Mallonga na tanggap ng prosekusyon na ang korte ang “final arbiters” pagdating sa pagresolba ng kaso.

Ngunit nanindigan din ang abugada na karapatan ng kanilang kampo na maghain ng karampatang apela, partikular na sa bail petition na inihain ng grupo ni Cedric.

Ito ay sa kadahilanang nakapaglatag daw ang prosekusyon ng sapat na ebidensiya upang mapatunayang dumanas ng matinding paggapos, pananakot, at panganguwarta ang complainant na si Vhong.

Paliwanag ni Atty. Mallonga: “The prosecution had the right to file a motion for reconsideration to correct what it considered to be errors in the appreciation of the law and evidence in the case.

“In this particular instance, it was filed to clarify, among others, that there was no possibility of rape as demonstrated by the CCTV [closed circuit television].”

Giit pa ng abugada, hindi nagbigay ng sinumpaang salaysay ang mga akusado upang kontrahin ang testimonya ni Vhong tungkol sa karahasang tinamo niya mula sa grupo ni Cedric, gayong hindi totoo ang alegasyong ginawan ng karahasan ng It’s Showtime host si Deniece.

“Only Vhong testified.

“None of the accused testified to dispute his testimony that he did not commit rape, that threats to kill him were made from the very beginning, or that demands for money were made upon him while his hands and feet were tied by duct tape.

“Having said that, the prosecution accepts that courts are the final arbiters of cases before it, but the prosecution can and will appeal orders and decisions that it believes in good faith to be erroneous.

“For that reason, the prosecution is prepared to take such other steps as may be necessary to correct the grant of bail to the accused.”

Inalmahan din ni Atty. Mallonga ang pahayag ni Atty. Topacio na unti-unting nagbabalik-trabaho ang kliyente nitong si Deniece matapos sirain ni Vhong ang buhay ng dalaga dahil sa kasong serious illegal detention.

Base ito sa opisyal na pahayag ni Atty. Topacio noong July 1, kung saan sinabi niya ang mga sumusunod: “In the meantime, Ms. Cornejo will try as best she can to pick up the pieces of the life that Mr. Vhong Navarro has shattered by resuming her career in modeling and styling as well as online selling, in order to attain gainful employment, as well as immersing herself in the arts such as painting and stage acting, for which she is currently undergoing training and mentoring.”

Buwelta ni Atty. Mallonga hinggil dito: "Hindi naman siguro tamang ipamalita sa publiko ng isa sa mga akusado na winasak ni Vhong ang kanyang buhay, at sa ganoon ay ipalabas na si Vhong pa ang may sala.

“Hindi naman puwedeng tiisin na lamang ang paninirang ito.”

Sa huli, muling inihayag ni Atty. Mallonga na desidido ang kampo nila na ituloy ang kasong serious illegal detention laban sa grupo nina Cedric, Zimmer, at Deniece.

Aniya, “Trial continues. None of the accused have been acquitted.

“Judge Bien herself has stressed that the ‘heart of the case’ has yet to be appreciated.

“The prosecution is determined to do its work within proper and ethical bounds and accepts it to be true that God knows the truth, but sometimes He waits.”
