Atty. Lorna Kapunan says Mayor Duterte should apologize; not surprised by Sen. Grace Poe's disqualification

Atty. Lorna Kapunan, known as the lawyer of the stars, is in the senatorial slate of presidential candidate Senator Grace Poe and her running mate, Senator Francis "Chiz" Escudero.


Ang mga kontrobersiya na kinasasangkutan ng presidential candidates na sina Davao City Mayor Rodrigo Duterte at Senator Grace Poe ang ilan sa mga maiinit na isyu ngayon na sinagot ni Atty. Lorna Kapunan.

Si Atty. Kapunan, na kilala bilang lawyer to the stars, ay kumakandidatong senador sa Partido Galing at Puso nina Senator Poe at Senator Francis Escudero.

Ang hiling ni Atty. Kapunan kay Duterte ay humingi ng paumanhin dahil sa pagmumura nito kay Pope Francis nang magdeklara ng kanyang presidential bid noong Lunes, November 30, ang alkalde ng Davao City.

Pahayag ni Atty. Kapunan, "Ang P…I… is a part of an expression.

"Alam mo, kapag sa high society sinabi nilang 'shit or fuck you,' do we get offended?

"No, kasi hindi natin gets yung 'Fuck you, shit, go to hell,' mga ganyan, walang dating yun.

"Pero kapag sinabing 'Pu**ng ina niyo naman, makinig kayo dito!' may dating ‘yon?

"I am giving him [Duterte] the benefit of the doubt.

"With Pope Francis, that’s unforgivable. In fact, he should apologize.

"That is one instance where he cannot get away with saying, 'I did not mean Pope Francis, what I was referring to was the traffic,' ‘cause hindi ganyan ang transcripts.

"To me, the test of bravery is when you are brave enough to accept that you are wrong.

"And this is one instance where I think he is wrong; do not malign the Pope.


POE DISQUALIFICATION. Ano naman ang opinyon ni Atty. Kapunan sa naging desisyon ng Commission on Elections (Comelec) second division na i-disqualify si Senator Grace sa 2016 presidential race dahil diumano sa hindi nito pagiging natural-born Filipino?

Saad niya, Hindi ako nagulat at ang headquarters po ng Partido Galing at Puso ay hindi rin nagulat.

"Apat ang disqualification cases na ‘yan.

"Even after the jubilation, nung lumabas yung decision ng Senate Electoral Tribunal, kung saan five senators voted in her favor, parang ina-anticipate niya na yayariin ng Comelec.

"I am not casting aspersion sa Comelec.

"Kung babasahin natin yung decision, e, sabi nga nila, interpretation ang decision nila because there is no law nga, e.

"Dalawang isyu ang pinagbasehan ng decision, yung issue kung natural born or naturalized.

"Pangalawa, did you comply with the 10-year citizenship residence requirement?"

FOUNDLING ISSUE. Patuloy niya, "On the first issue, settled na ‘yan ng Supreme Court.

"Ang maganda sa column ni Chief Justice Panganiban a[bout foundlings], sabi niya nung pinag-uusapan yung distinction between natural-born citizen and naturalized during the Constitutional Convention, in-amend ang Constitution.

"Ang nag-cite pa na ang foundling is a natural born was no less than the father of Mar Roxas [the late Senator Gerry Roxas], who said hindi na kailangang ilagay diyan na ang foundling, e, natural born.

"Number one, obviously, if you are a foundling and you are found in the Philippines, you are natural born.

"Number two, kokonti lang naman ang foundling dito sa Pilipinas, understood na ‘yon.

"I’m paraphrasing it, but sabi ni Chief Justice Panganiban, how can that be a legal issue?

"And if it is coming from the Liberal Party, that means they did not do their homework.

"Because no less than the honorable Senator [Gerry] Roxas during the deliberations on that provision, sabi niya, ang foundling, hindi na kailangan, wala naman magkukuwestiyon.

"Well, fast forward to now, sino ang nagkukuwestiyon?

"Sadly, they have forgotten the heritage at pinagmana ng wisdom ng kanilang ancestors.


RESIDENCY ISSUE. Secondly, on the issue of residency, ang dami-dami ng precedence diyan, there are so many rulings of the Supreme Court.

"They cite one or two [cases] na ginamit daw yung U.S. passport ulit kaya tinanggalan ng pagka-mayor; hindi naman yun ang applicable.

"On the side of the citizenship, talagang binibilang yung animus; animus is yung intention, intention to return.

"If you are saying somebody like a Grace Poe who leaves the country, the husband is a doctor, typical brain drain, looking for a livelihood abroad.

"The children, they migrated to the US; he is a doctor para mag-practice.

"Are we saying na lahat ng balikbayan abroad na sumama sa pamilya at gusto nang bumalik sa Pilipinas cannot re-acquire Filipino citizenship?

"And the period of time they were away should be counted against them? Hindi!

"There is a new Republic Act recognizing the rights of balikbayan to come back, regain their citizenship.

"Dahil kung hindi ka citizen ng Pilipinas, maski na balikbayan ka, how can you even acquire lands in the country?

"E, yung pinaghirapan mo as OFW, two to three jobs a day para mag-ipon para makauwi ka at, at least, gumawa ng hollow blocks na bahay.

"Di ba, ganoon sa probinsiya, puro hollow blocks na lahat?

"Yun ang ginagawa ng mga OFW, but can they own the property?

"The Republic Act precisely recognizing a situation where all Filipinos who want to come home, they‘re considered not only natural born, they’re also considered as not having left the country.

“And the period they were away are not counted against them."
