Isang source ng PEP.ph (Philippine Entertainment Portal) ang nagpadala ng kopya ng sulat ng Divina Law sa TV5 tungkol sa kontrobersiyang kinasasangkutan ngayon ni Kris Aquino at ng magkapatid na sina Nicko at Atty. Jess Falcis.
Ang Divina Law ang isa sa law firms na humahawak sa legal matters ng web star/endorser na si Kris.
Isa na rito ang reklamong theft na isinampa ni Kris laban kay Nicko—dating finance manager ng Potato Corner + Nacho Bimby at dati ring endorser closer, talent agent, at project director ng digital company ni Kris na Kris Aquino Cojuangco Productions o KCAP—dahil sa diumano unauthorized na paggamit nito ng credit card ng kumpanya sa kanyang mga personal na gastusin.
Bahagi ng nakasaad sa sulat ng Divina Law na may petsang 8 January 2019:
“We understand that Mr. Nicardo M. Falcis II (Nicko) and his brother Atty. Jesus Nicardo M. Falcis III (Jess) are approaching various television and radio stations trying to arrange for interviews and/or guest appearances on shows with a clear intent of maligning, humiliating and destroying the reputation of our client through defamatory statements, malicious innuendos and unfounded accusations.
“While we recognize your constitutional right to free speech, free expression and press freedom, we reiterate that Libel is not protected speech.
“Thus, we caution you from airing or broadcasting these interviews without verifying the allegations or securing the side/explanation of our client.
"Every defamatory imputation is presumed malicious (Article 354, Revised Penal Code).
“Liability for defamatory statements published by radio or television may be had from the owner of the station, a licensee, the operator of the station, or a person who procures, or participates in, the making or caused the broadcast or publication of the defamatory statements.”
Kagabi, January 10, iniulat ng primetime news program ng TV5 na Aksyon Prime ang tungkol sa hakbang na ito ng Divina Law para sa kliyente nilang si Kris.
Pahayag ng News5 tungkol sa sulat na ito ng mga abugado ng dating tinaguriang Queen of All Media:
“Kami po sa News5 ay tinitiyak na patas ang aming pagbabalita at sinisikap na makuha ang bawat panig ng kampong sangkot sa isyu.
“Bagama’t meron pong programa sa Radyo Singko ang kapatid ni Nicko na si Atty. Jesus Falcis ay wala po kaming pinapaboran.”
BOTH SIDES OF A STORY
Hiningan ng PEP.ph ng pahayag ang Divina Law, sa pamamagitan ni Atty. Ricky dela Cruz, tungkol sa ipinadala nilang sulat sa TV5.
Sagot ng abugado, hindi lang TV5 ang pinadalhan nila kundi “all broadcast stations.”
Iginiit din nilang hindi nila inaakusahan ang anumang network ng pagiging "bias or being unfair."
Saad ni Atty. Dela Cruz, “We gave similar letters to all broadcast stations because our client felt that only Nicko's side is being aired.
“Our client was not asked to comment before the interview was aired.
“We did not accuse any network or broadcast station of bias or being unfair.
“We simply reiterated a legal precept that Libel is not protected speech and that in the spirit of fair reporting—both sides of a story should be aired.”
ATTY. JESS FALCIS REACTS
Kaugnay nito, hiningi rin ng PEP.ph ang reaksiyon ng magkapatid na Falcis sa pamamagitan ni Atty. Jess.
Idinaan ng nakababatang Falcis ang kanyang statement sa pamamagitan ng isang Facebook post ngayong hapon, January 11, na may pamagat na “WHO CROWNED KRIS AQUINO AS QUEEN?”
Iginiit ni Atty. Jess na nasa demokrasyang bansa tayo at walang karapatan ang isang tao na apakan ang freedom of expression ng kapwa.
Tinawag din niyang “delusional queen” Kris.
Narito ang buong pahayag ni Atty. Falcis (published as is):
"I didn’t know that Kris Aquino, the has-been and self-proclaimed for branding purposes Queen of Media, was a real Queen whose subjects could not criticise.
"Let me remind her that we live in a democracy and not a monarchy. We do not have lese majeste laws like those in other countries with a monarchy.
"Kris Aquino's attempt, through her lawyers, to intimidate and prevent the media from airing our side is like the last gasp of a delusional queen who is afraid of losing credibility and power because her fake image will be unmasked.
"Kris Aquino is like a child, in this case an oligarchich spoiled brat, throwing a tantrum because she can’t get her way.
"To begin with, she brought it upon herself. She can’t expect us not to talk in public and on social media when she herself did so last year.
"Kris Aquino was the one who first defamed my brother. Our responses are only in self defense.
"She started with lies, we’ll finish with the truth.
"And it’s hypocritical for her and her lawyers to intimidate the media from covering us when she herself invited the media to cover her filling of cases and most recently her delirious press conference with her so-called Justice League.
"Divina Law should refresh themselves of legal ethics.
"They should not brazenly lie in their letter and say that every defamatory imputation is presumed malicious.
"They know, unless they are grossly ignorant of the law, that malice is not presumed in cases involving public figures!
"Maybe Divina Law should focus first in protecting Smartmatic in election cases and UST in hazing cases instead of focusing a lot of their time and effort in representing an oligarch.
"Stop bullying the media. Stop bullying our family! You are not a Queen and we will not bend the knee.
Kahit saan mang panig ng mundo ay pinapairal ng 4th estate ng lipunan o ng media ang fair journalism.
Ito ay sumasalamin sa katotohanang ang isang isyu o kontrobersiya ay nararapat na may dalawang panig o lahat ng panig na nakakaladkad sa isyu ay may reaksiyon o pahayag.
Ito rin ay nangangahulugang ang isang gumagawa ng balita ay dapat walang pinapanigan sa bawat kampo ng mga sangkot sa isyu.
At iyan ang sinusunod na panuntunan ng PEP.ph sa paghahatid ng balita, katulad na lamang sa sigalot sa pagitan ni Kris Aquino at ng magkapatid na Nicko at Jesus Falcis.
Ayon naman sa broadcasting principles ng Kapisanan ng mga Broadkaster ng Pilipinas (KBP), ang bawat balita ay dapat balanse.
Nakatala sa Broadcast Code of the Philippines 2007 (as amended in 2011), “Balance, in the presentation of the news, views, and discussions is the goal of the broadcaster, who airs both or all sides of an issue.
“The broadcaster does not use the air to malign, destroy, insult, or disrespect anyone regardless of gender, view, religious belief, political position, culture, race or ethnicity.”
