Nicko Falcis calls out Kris Aquino & lawyers over letter warning broadcast stations against airing his side

Nicko Falcis calls out Divina Law, lawyers for Kris Aquino, for writing "strongly worded" letters warning broadcast stations against airing the Falcis side: "Why would you curtail our freedom of speech, the freedom of the press? We have a right to air our side."


Inalmahan ni Nicko Falcis ang ginawang pagsulat ng kampo ni Kris Aquino sa mga broadcast stations tungkol sa pag-e-ere ng panig nila ng kapatid na si Atty. Jess Falcis.

Matatandaang sumulat sa TV5 ang Divina Law, isa sa law firms na nagha-handle sa legal concerns ng endorser at web star, noong January 8, 2019.

Pinaalalahanan ng law firm ang istasyon sa pag-ere ng panig ng magkapatid na Falcis dahil ang tanging layunin lamang daw nila ay siraan ang kanilang kliyente na si Kris.

Bahagi ng nakasaad sa sulat, “We understand that Mr. Nicardo M. Falcis II (Nicko) and his brother Atty. Jesus Nicardo M. Falcis III (Jess) are approaching various television and radio stations trying to arrange for interviews and/or guest appearances on shows with a clear intent of maligning, humiliating and destroying the reputation of our client through defamatory statements, malicious innuendos and unfounded accusations.

“While we recognize your constitutional right to free speech, free expression and press freedom, we reiterate that Libel is not protected speech.

“Thus, we caution you from airing or broadcasting these interviews without verifying the allegations or securing the side/explanation of our client.

"Every defamatory imputation is presumed malicious (Article 354, Revised Penal Code).

“Liability for defamatory statements published by radio or television may be had from the owner of the station, a licensee, the operator of the station, or a person who procures, or participates in, the making or caused the broadcast or publication of the defamatory statements.”

Nahaharap si Nicko sa reklamong theft na isinampa ni Kris sa pitong lungsod sa Metro Manila. Ang kanya namang kapatid na si Atty. Jess ay inireklamo ni Kris ng cyberlibel sa Department of Justice. 


Si Nicko ay ang dating finance manager ng Potato Corner + Nacho Bimby at dati ring endorser closer, talent agent, at project director ng digital company ni Kris na Kris Aquino Cojuangco Productions o KCAP.


Sa kanyang Instagram Stories kagabi, January 11, sinabi ni Nicko na hindi sila natatakot kay Kris at hindi sila maninikluhod dito.

Sabi niya (published as is): “Your army of lawyers tried to establish media blackout by sending 'strongly worded' memos to them and even tasked your paid entourage to fish for information from all EX-KCAP employees. 

“Stop bullying the media. Stop bullying our family! You are not the queen and we will NOT bend the knee!"

Sa kanya namang Facebook, ipinost din ni Nicko ang kahalintulad na status, ngunit may dinagdag siyang matapang na salita sa dulo. 

"No to bullies and power tripping! Do not curtail our freedom of speech!

"You started with your lies, and we’ll finish with the truth!"


Ikinabit din niya rito ang Facebook status ni Atty. Jess na may pamagat na "WHO CROWNED KRIS AQUINO AS QUEEN?".


Sa dalawa pa niyang IG Stories, pinuna ni Nicko ang ginawang hakbang ng Divina Law.

Sinamahan niya ito ng screenshots mula sa ulat ng TV5 tungkol sa sulat na ipinadala sa network ng law firm.

Saad ni Nicko: “Why would you curtail our freedom of speech, the freedom of the press?

“We have a right to air our side. @divinalawph”

Dagdag ni Nicko sa IG Stories: “How saddening for an esteemed law firm to be one-sided about the law…

“#DeanDivina dba UST ka?”



Humingi ang (Philippine Entertainment Portal) ng pahayag sa Divina Law sa pamamagitan ni Atty. Ricky dela Cruz.

Ito ang sagot nila:

"I think Nicko did not read our letter. It was addressed to the broadcast stations.

"We did not ask them NOT to air the interview of the Falcis brothers. In fact we said in the letter that we recognize their constitutional right to free speech and a free press.

"We reminded them that Libel is not protected speech. That is a fact.

"What we simply asked was for them to get the side of Ms. Kris Aquino for fair and balanced reporting.

"How can that request be construed as a curtailment of free speech?"
