Isa-isang sinagot ng GMA Network ang findings ng Department of Labor and Employment (DOLE) ang tatlong safety precautions na nilabag umano ng TV network kaugnay ng aksidenteng kinasangkutan ng veteran actor-director na si Eddie Garcia.
Nitong Lunes ng gabi, September 16, natanggap ng PEP.ph (Philippine Entertainment Portal) Ang “Comment” ng Kapuso Network, bilang tugon sa tatlong violations nito, ayon sa imbestigasyon ng DOLE.
Noong June 8, 2019, napatid sa cable wire ang 90-anyos na aktor habang nagti-taping para sa Kapuso teleseryeng Rosang Agimat, na ngayon ay na-shelve na.
Bunsod ng pagkakapatid ay natumba at nagkaroon ng fracture sa leeg si Eddie.
Dahil din sa insidente ay na-comatose ang beteranong aktor, hanggang sa tuluyan siyang bawian ng buhay noong June 20, 2019.
Noong September 4, Miyekules, iniulat ng CNN Philippines ang update ni DOLE National Capital Region (DOLE-NCR) Director Sarah Buena Mirasol tungkol sa aksidenteng ikinasawi ni Eddie.
Ibinahagi ni Mirasol ang detalyeng ito sa budget hearing ng House Appropriations Committee nang humingi ng update si Gabriela Party-list Representative Arlene Brosas ng update sa imbestigasyon ng DOLE sa kaso ng namayapang aktor.
Ayon sa DOLE officer, may tatlong nilabag na safety precautions ang GMA Network, sa ilalim ng Implementing Rules and Regulations (IRR) ng Occupational Safety and Health (OSH) Law.
Narito ang tatlong paglabag, ayon sa DOLE: hindi pagsumite ng network at ng mga contractor ng report ng insidente sa loob ng 24 oras; hindi pagtatalaga ng safety officer; at hindi pagpu-provide ng first aide professional sa set ng teleserye.
GMA NETWORK ANSWERS DOLE FINDINGS

Kaugnay ng hindi umano pagsumite ng TV network at ng contractors ng incident report sa loob ng 24 oras, ito ang Comment ng GMA Network matapos ang kanilang “thorough internal investigation":
"[T]he Network initially gave a copy of the results to the family of Mr. Garcia as a matter of respect and thereafter voluntarily submitted a copy to the DOLE on July 5, 2019 in compliance with the law and its IRR.”
Binanggit din ng TV network na nakatalaga umano sa IRR na "exemption" ang pagsusumite ng incident report sa loob ng 24 oras kung ang nangyaring aksidente ay nauwi sa matinding aksidente o pagkamatay.
Pahayag ng Kapuso network: “Regarding the first finding, GMA noted that the IRR, as worded, states that such a case of ‘work accidents resulting in disabling injury or death’ is an exception to the requirement that a report be made within 24 hours from the occurrence.
“Nonetheless, GMA submitted the report within one (1) month from the accident which occurred last June 8, 2019.”
Nilinaw rin ng GMA-7 na mayroon silang sapat na bilang ng safety officers para sa mga empleyado ng network.
Pero sinabi rin ng TV station na ang “workplace” na covered sa OSH Law ay tumutukoy lamang sa mga lugar “where services of the employees are regularly rendered.”
Hindi raw saklaw sa IRR ang mga pansamantalang lugar o lokasyon para sa trabaho.
Ang taping ng Rosang Agimat ay naganap sa isang residential area sa Tondo, Manila.
Ayon sa pahayag ng GMA Network:
“Secondly, on having a designated safety officer in the workplace, GMA confirms that it actually has sufficient number of DOLE-certified safety officers catering to its employees.
“The ‘workplace’ covered by the OSH Law is deemed to refer only to those places where services of the employees are regularly rendered.
“The IRR cannot expand the coverage of the law to include temporary, moving, or shifting locations.
“Extending said requirement of the law through the IRR to all temporary taping locations would unreasonably burden the industry with a requirement which is beyond the contemplation of the law.”
Pagpapatuloy ng statement ng network: “GMA maintains safety and security in tapings through extensive discussions among its safety officers, the program’s officers, and staff and its contractors in coordination with Barangay officials having jurisdiction over the locations for security, traffic and crowd control matters.”
Kaugnay naman ng hindi umano pagpu-provide ng first aide personnel sa teleserye, sinabi ng TV network na may mga production staff sa lokasyon na may sapat na kaalaman sa first aid at basic life support.
“Lastly, on designating first aid responders, GMA validated that three production staff who have completed the Philippine Red Cross' lecture demonstration on First Aid and Basic Life Support – CPR were present on the location site on the day of the accident.
“Despite the safety measures undertaken by GMA, it was determined that what happened was an unforeseeable accident.”
Sinagot din ng GMA Network ang pahayag ni Mirasol na tumanggi umano ang TV network na magbigay ng listahan ng mga lokasyon para sa mga teleserye nito para isailalim sa inspection.
Nailathala ang pahayag na ito ni Mirasol sa online report ng The Philippine Daily Inquirer noong September 7, 2019 na may titulong “Dole on Eddie Garcia case: GMA 7 committed 3 violations of Occupational Safety and Health Law”
Sagot dito ng GMA-7: “Moreover, in an article published in The Philippine Daily Inquirer on September 7, 2019, it was mentioned that GMA Network refused to comply with DOLE’s directive to provide a list of the locations of all its teleseryes, which shall be subject to inspection by its representatives.
“GMA, for its part, said that there was no refusal to provide the information.
“The locations and schedules were not submitted immediately because of their tentativeness and the fact that they are too numerous to remember from memory.
“These tapings are under the supervision of different officers and thus needed ample time to compile.
“However, a list of regular taping locations and schedules was submitted within the prescribed period."
Dagda pa nila, “The Kapuso Network assures that it will continue to cooperate with the DOLE on this matter.”
