Catriona Gray files libel suit vs Bulgar over fake nude photo

Desidido si Miss Universe 2018 Catriona Gray na ipagtanggol ang sarili sa diumano'y paninirang-puri sa kanya ng tabloid na Bulgar.

Nagsampa ng reklamo ng tig-isang bilang ng libel ang international celebrity laban sa Bulgar editor na si Janice Navida at writer na si Melba Llanera.

Lubha raw nasaktan at inabot ng matinding kahihiyan ang celebrity dahil sa nailathalang tabloid article na nagsasabing mayroon siyang "nude photos."

Inireklamo rin ni Catriona ng isang bilang ng cyber libel si Navida. Si Navida umano ang nag-post sa Facebook page ng Bulgar ng makatawag-pansing teaser para sa tabloid article.

Biyernes ng umaga, September 18, personal na nagtungo si Catriona sa Department of Justice sa Quezon City para isumite at panumpaan ang kanyang salaysay.

Kasama niya ang kanyang talent manager na si Erickson Raymundo at legal counsel na si Josabeth "Joji" Alonso.

Nakakuha ang PEP.ph (Philippine Entertainment Portal) ng kopya ng 16-page complaint affidavit ng beauty queen laban kina Navida at Llanera.

Bungad ni Catriona (published as is, with emphasis supplied):

"For the record, I categorically state that I am not this woman explicitly shown in the photo to be topless.

"I was completely shocked and outraged upon learning of the foregoing Bulgar's online Facebook post, which was subsequently published in their tabloid with nationwide circulation.

"Apart from being absolutely false, it contained a statement which was sufficient to leave in the minds of the readers that I am a woman of ill-repute engaged in a scandalous act."

THE "malicious, DEFAMATORY, libelous" PHOTOS

Idinetalye ni Catriona na noong gabi ng July 18, 2020, ipinost sa official Facebook page ng Bulgar ang isang makatawag-pansing teaser para sa ipinapangako ng tabloid na news article.

Sabi sa caption ng post (emphasis supplied): "After ng bantang pasabog ni Clint... NUDE PHOTOS NI CATRIONA, KALAT NA! OMG!!! Basahin ang detalye sa INSIDER ni Melba Llanera bukas, Linggo. Bili na ng Bulgar para lagi kang updated!!"

Ang Clint na binabanggit ay si Clint Bondad, ang kasintahan ni Catriona bago ito hiranging Miss Universe.

Kinabukasan, July 19, lumabas sa tabloid ang sinasabing "pasabog."

Ang lumabas na tabloid article ay naglalaman ng ganitong headline (emphasis supplied): "After ng bantang pasabog ni Clint... Nude photos ni CATRIONA, kalat na!"

May kalakip na tatlong larawan ang tabloid article at ang Facebook post ng tabloid.

Dalawa rito ay kuha ni Catriona na nakalublob sa isang puting batthub. May isa namang litrato ng isang babaeng nakaliyad ang dibdib habang nakahiga sa kama.

Umalma si Catriona dahil ni hindi man lang daw kumilos ang tabloid para i-verify ang balita bago ito ilathala.

Paliwanag ni Catriona, siya ang babae sa dalawang batthub photos, na kuha raw para sa online advertisement ng isang clothing brand noong February 2014.

Mariin niyang itinanggi na siya ang babaeng naka-topless sa kama sa ikatlong litrato.

Kung hindi daw iyon "digitally-altered," posibleng kuha raw iyon ng isang babaeng may hawig sa kanya.

Lahad ni Catriona, "After conducting a thorough investigation, I was shown a video of a woman who has strikingly very similar features as me.

"I was informed that this woman is a Russian model who performs sensual acts on videos and poses nude on photographs."

Isinumite ni Catriona sa Department of Justice ang litrato ng sinasabi niyang Russian model, pati na ang mga litratong inilathala ng Bulgar para maikumpara ang mga ito.

"DEFAMATORY" FACEBOOK POST AND TABLOID ARTICLE

Reklamo pa ni Catriona, malinaw sa mga salitang ginamit sa tabloid article na kinukumpirma nitong siya ang babaeng naka-topless sa photo.

"Despite the need to produce proof as to its authenticity, the article was defamatory in its language compounded by the publication of a nude photo,' as if such photo was real.

"As a matter of fact, respondent Llanera specifically stated in her tabloid column, without any hesitation or raising doubts, that I have nude photos circulating online and all these photos show me:

"'Heto nga, may nude photos pang kumakalat ngayon online si Catriona kung saan bukod sa naliligo siya sa bath tub ay may kuha itong nakahiga habang kita ang dibdib.'"

Ganoon din daw ang dating ng caption na ibinahagi ni Navida sa Facebook page ng Bulgar.

Bilang patunay, nagsumite si Catriona ng mga sampol ng komento ng netizens na naniwalang siya nga ang babaeng kita ang dibdib sa Facebook post.

Aniya, "As of 27 August 2020, this malicious post that has extensively offended and blatantly shamed me to the benefit of the publication’s social media mileage, had already gained traction of 747 likes with 376 comments and 198 shares."

Ayon pa sa Miss Universe titlist, hindi tamang naglabas ang Bulgar ng walang basehang ulat tungkol sa kanya para lang sabayan ang "trending issue" sangkot ang ex-boyfriend na si Clint Bondad.

Pahapyaw na nabanggit ni Catriona na itinuturing niyang harassment ang pandadawit sa kanya ni Clint, isang model na pumalaot na sa acting, sa trending Instagram posts nito noong Hulyo.

"It appears that Bulgar, being aware of the trending issue of Clint Bondad’s Instagram posts harassing me, was able to obtain a copy of the explicit photo from an unidentified source.

"The subject photo was then purposely uploaded on its online platform and subsequently published it in its tabloid, without verifying its sources.

"Both in the Libelous Post and Libelous Article, respondents Navida and Llanera falsely and maliciously imputed that the topless woman in the photo is me and that it had already widely spread – despite evident uncertainty as to its legitimacy."

Nauna nang nagpadala ng demand letter ang kampo ni Catriona kina Navida at Llanera noong July 30, 2020.

Sa demand letter, humihingi si Catriona ng public apology at PHP10M na danyos para sa "public ridicule" at "immeasurable damage" sanhi ng tinawag niyang mapanirang artikulo at Facebook post ng Bulgar.

Walang inilabas na public apology ang Bulgar.

Imbes ay nagpadala ng reply letter si Navida kina Catriona at counsel nitong si Atty. Alonso noong August 3.

Gabi ng August 4, pinadalhan ni Navida ang PEP.ph ng kopya ng kanyang reply letter.

Sabi rito, ang tanging intensiyon ng Bulgar ay magdala ng balita sa publiko tungkol sa isyung kinasasangkutan ni Catriona.

Nais din umano ng Bulgar na malaman ni Catriona na may mga tao o grupong nagpapakalat ng "obscene photo" para siraan ang beauty queen.

Depensa pa ni Navida, may bahagi sa artikulo ni Llanera na nagpapahiwatig na posibleng "fake" at "edited" ang kumalat na topless photo ni Catriona. Nagsisilbi raw itong disclaimer.

Hindi katanggap-tanggap kay Catriona ang paliwanag ni Navida.

Pakiramdam pa niya ay sarkastiko si Navida sa pagsabing gusto nitong linisin ang pangalan ng beauty queen.

Hindi rin daw tugma ang sinasabi ni Navida sa inilabas ng tabloid na headline at content ng article at Facebook post nito, dahil pinapalabas daw ditong si Catriona nga ang babaeng topless sa litrato.

Lahad ni Catriona: "To add greater insult to the injury, respondent Navida even tried to defend her actions by frivolously implying that they did their part to protect me, that in releasing the subject photo, they had my best interest and blurred the private part.

"It was even being requested that I be the one to understand them since their only intention in publishing the subject photo was 'to help me clear my name.'"

Bilang mga dyornalista, responsibilidad daw nina Navida at Llanera na i-verify muna ang source ng mga litrato at imbestigahan kung lehitimong maiuugnay ang mga ito kay Catriona.

Lalo na raw kung ang natanggap na impormasyon ng Bulgar ay may tao o grupong gustong manira sa reputasyon ng Miss Universe titleholder.

Si Catriona ay isa sa apat lamang na Filipina Miss Universe. Kasama niya sa select circle sina Gloria Diaz, Margie Moran, at Pia Wurtzbach.

Ani Catriona: "However, they miserably failed to do so resulting in the unwarranted dissemination of misleading information that had caused irreparable damage to my career and severely tarnished my hard-earned reputation.

"Regardless of the fact that I hold a celebrity or 'public figure' status, this alone does not give respondents Navida and Llanera any right to release a libelous material which they know would sufficiently impeach my reputation and put me in public ridicule.

"As a news agency, Bulgar should be held to a higher degree of care and responsibility as they are considered to be a source of 'credible' information."

"NO GOOD INTENTION"

Sa huli, nanindigan si Catriona na "malicious, defamatory, at libelous" ang Facebook post at tabloid article na inilabas ng Bulgar.

Wala raw siyang makitang "good intention and justifiable motive" para sa ginawang ulat ng Bulgar.

Kitang-kita raw na ang pakontrobersyal na mga salitang ginamit ng Bulgar ay sinadya para makahatak ang tabloid ng "social media mileage" sa Facebook at "readership" sa street sales.
