DOJ prosecutor general clarifies Christine Dacera case not yet dismissed

Nilinaw ni Department of Justice (DOJ) Prosecutor General Benedicto Malcontento na hindi nila ibinasura ang reklamo ukol sa pagkamatay ng flight attendant na si Christine Dacera, 23, noong January 1, 2021.

Si Malcontento ang pinuno ng prosecutors sa buong bansa.

Sa desisyong inilabas ng Makati City Prosecutor’s Office kahapon, January 6, inatasan nila ang Makati Police na magsagawa pa ng malawakang imbestigasyon sa kaso ni Christine.

Kulang pa raw kasi ang mga ebidensiyang inihain nila sa korte.

Ang desisyon ay pirmado nina Makati Assistant City Prosecutor Joan Bolina-Santillan, Deputy City Prosecutor Henry Salazar, at City Prosecutor Dindo Venturanza.

Sa panayam kay Malcontento sa programang The Source ni Pinky Webb sa CNN Philippines ngayong Huwebes, January 7, ipinaliwanag nito ang naging desisyon ng Makati City Prosecutor’s Office tungkol sa kaso ni Dacera.

Pahayag ni Malcontento, “I will just explain what are the procedures in so far as our prosecutors are concerned.

“Our office will just receive the complaint coming from the PNP. Now, probably they have their own mindset.

“As our deciding authority, we have our own procedures to follow.

“And our decision is, at this point in time, the pieces of evidence are not enough for us to arrive at a decision whether the case will be filed or not."

Paglilinaw ng prosecutor general, “We are not dismissing the case, just to be clear about it.

“We are just converting this into a regular preliminary investigation.”

Nakatakda ang preliminary investigation sa kaso ni Dacera sa January 13, 10 A.M.

PROVISIONAL RAPE WITH HOMICIDE?

Naitanong din sa prosecutor general kung may kaso ba talagang "provisional rape with homicide."

Ito kasi ang kasong isinampa ng Makati Police sa korte laban sa respondents na sina John Pascual dela Serna III, Rommel Galido y Daluro, John Paul Halili y Reyes, Gregorio Angelo Rafael De Guzman, Clark Rapinan, Valentine Rosales, at Mark Anthony Rosales.

Ayon kay Malcontento, hindi ordinaryong termino ang salitang “provisional.”

“The word provisional is a bit not ordinary in so far as we are concerned.

“However, probably by way of strategy, so I’m leaving it to the PNP.

“In so far as we are concerned, we studied the affidavits and the evidence, these are not enough at this point in time.

“That’s why the procedure is to proceed to a regular proper preliminary investigation so that the police are given sufficient time to submit additional evidence if they have.

“And at the same manner, they, respondents, will be given a chance to submit their evidence as well.”

PREMATURE, MEDICO-LEGAL FINDINGS

Masasabi ba niyang premature o hilaw ang reklamong isinampa ng pulisya laban sa respondents?

Tugon ni Malcontento, “I can say that it’s premature in so far as the prosecutors are concerned.

“Premature because that is our finding. If it is sufficient, we could have dismissed it outright or decided to file the case."

Tungkol naman sa mga pasa at semen na nakita raw sa katawan ni Christine, ayon sa initial reports ng Makati Police, may basehan ba ito?

Paliwanag ng prosecutor general, “Ganito 'yan, yung sinasabing may semen, walang evidence to that effect.

“Yung sa medico-legal, walang sinasabing ganyan.

“That’s why other prosecutors decided to refer this for further investigation to determine baka meron in the future or wala at all.

“But sa ngayon, yung case na 'yon, based doon sa medico-legal na sinubmit ng PNP, there's no such thing na nagsabi na may semen sa private part ng deceased."

Pagpapatuloy niya, “Number 2, yung sinasabi na mga pasa, bruises, inaral namin yung pieces of evidence, ang nag-testify lang niyan yung cousin ni Christine Dacera.

“So we must have an independent medical examination for that.

“Ano ba yung cause ng abrasions, injuries na yun?

“So in other words, there must be a scientific basis, medical basis, na dapat i-submit ang PNP para mapaniwalaan namin ang kanilang allegation.

“As of now, it does not exist. Wala pa.

“Wala pang medical finding which explains why our decision is for full-blown criminal investigation.”

OTHER FORENSIC EVIDENCE

Sa resolution pa rin ng prosecutors, pinasusumite nila ang pulisya ng DNA analysis report, toxicology/chemical analysis, at histopath examination report.

Paano ba ito makakatulong sa kaso?

Saad ng prosecutor general, “Itong mga forensic evidence na ito, makakatulong sa amin, because doon sa sinubmit ng PNP na documents are not enough.

“That’s why we are giving them, the parties involved, to submit additional evidence because itong DNA, granting na may semen, makikita kung saan galing.

“Itong toxicology naman, makikita natin doon ano ba yung ininom, ano ang pinainom, ano yung mga results ng mga ininom.

“'Yan ang makukuha sa results diyan sa forensic evidence na makukuha ng mga prosecutors, to determine either na may foul play o wala. At kung may foul play, sino ang responsible?"

Ang histopath naman ay may kinalaman daw sa cells ng isang tao.

HEALED LACERATION

Sa initial report ng pulisya, may mga sugat at nakitaan din daw ng semen ang katawan ng namayapa.

Ayon naman sa kumalat na autopsy report sa social media, hindi nakasaad dito ang tungkol sa semen.

Ruptured aortic aneurysm pa rin ang nakasaad na sanhi ng pagpanaw ni Christine.

Pag-sang ayon ni Marcoleta, “That is correct. Now, ganito 'yan, allow me to explain in general terms, kasi I cannot dwell on the specifics, because the case is still pending.

“Kasi yung sinasabi natin na healed laceration, hindi 'yan ngayon mapu-prove na assault because in layman’s term, ang healed laceration ay matagal na 'yan nangyari.

“So, kung itong alleged rape or sexual assault, may nangyari dito, it will not help yung ganung laman ng medico-legal.

“In relation to this, Secretary Meynard Guevarra issued a department order to the NBI to conduct investigation, cooperative effort, so that we can arrive at the truth."

Kailan ito maipapasa sa kanila?

Sagot ni Marcoleta, “The focus now in this case with the PNP, NBI cooperationg, mabilis dapat yan, dapat within the week dapat lumabas yan.”

DEFINITION OF TERMS

Ano ngayon ang tawag sa mga taong inuugnay sa kaso: suspect o persons of interest?

Sagot ng DOJ prosecutor, “Ang legal term namin diyan, taking into account na meron nang preliminary investigation, ang tawag natin diyan respondents. They are respondents.”

May karapatan pa ba ang PNP na ipatawag ang 11 respondents? Paano kung ayaw ng mga itong makipag-cooperate sa PNP sakaling ipatawag sila?

Saad ni Malcontento, “Taking into account na nag-issue na kami ng order for a regular preliminary investigation, yung venue ng kaso, nasa prosecutors na' yan, wala na sa police.

“In other words, ang order na masusunod, yung orders ng prosecutor natin for the 11 respondents to appear on January 13, 'yan yung amin.

“'Yan ang masusunod. Wala nang iba pa at this point in time.”
