Lawyer of respondents in Christine Dacera case questions PNP motion to reopen terminated preliminary investigation

Pinalagan ng kampo ng respondents sa Christine Dacera case ang inihaing motion to reopen preliminary investigation ng Southern Police District (SPD) investigator na si Corporal Louie Lopez.

Ito ay matapos tapusin ng Makati City Prosecutor’s Office ang preliminary investigation sa kaso noong February 17.

Naghihintay na lamang ngayon ng resolusyon sa inihaing reklamong rape with homicide laban sa respondents.

Pero noong March 1, naghain ng mosyon si Lopez upang muling buksan ang preliminary investigation dahil may mga bago raw silang ebidensiya.

Kaugnay nito, tinawagan ng PEP.ph (Philippine Entertainment Portal) sa telepono si Atty. Mike Santiago, ang abugado ng respondents, ngayong Biyernes ng hapon, March 5, upang kunin ang kanilang panig sa inihain ng SPD.

Saad ni Atty. Santiago, “Noong February 17, the case was already submitted for resolution.

“Basically, terminated na yung preliminary investigation and the prosecutor [assigned] will already be preparing for a draft of her resolution at para maaprubahan ng mga authority nila. That’s how it is.

“Now, the PNP wants to reopen the preliminary investigation again.

"Basically, what they wanted was for the prosecutor to admit additional evidence, consisting of the chemistry report, and meron pang semen na report nila.”

Ayon sa mga lumabas na ulat, may dalawang cotton swabs na nagresulta raw ng positive sa fluoromethamphetamine at shabu.

Mayroon din daw isang medico-legal report na nagpapakita ng traces of semen sa beddings, sa punda, at kumot ng hotel kung saan nakita si Dacera na wala nang buhay.

Ito raw ang mga ebidensiyang nais isumite ng pulisya kaya gusto nilang buksan muli ang preliminary investigation.

Pinalagan ito ng respondents.

Bakit daw kung kailan tapos na ang preliminary investigation ay saka pa lamang isusumite ang mga karagdagang ebsidensiya.

Saad ni Atty. Santiago, “Ang ano lang, ang surprising lang with this report, it was already available as early as February 11, nung hindi pa terminated ang preliminary investigation. Ongoing pa ang preliminary investigation, di ba?

“So, kung available na siya, bakit ngayon lang gustong i-submit, di ba?

"And totoo ba na... doubtful na tuloy yung ano... kami nagda-doubt kung saan galing ang report na ito na sinasabi ng PNP kasi available na siya February 11 pa, e.

“Bakit kailangan pa ng last minute saka nila gustong ipa-admit sa Prosecutor’s Office?”

HOPING FOR DISMISSAL

Hinihintay na nga lang daw ngayon ng kampo ng respondents ang resolusyon ng mga piskal sa inihaing reklamo ng Makati PNP.

Saad ni Atty. Santiago, “Naghihintay tayo ngayon ng resolusyon, yun nga, whether ibabasura ang kaso or isasampa sa korte.

“Kasi nasa piskalya na siya, e. So, kung hindi pabor sa mga respondents yung resolution, the case will be filed in court.

“Kung pabor sa mga respondents, that means idi-dismiss po.”

Umaasa silang mabasura ang reklamo dahil wala raw pulidong ebidensiya ang naihain laban sa respondents, ayon sa abugado.

Sabi pa Atty. Santiago, “Yes, of course, umaasa kami na madi-dismiss kasi wala namang sapat na batayan or ebidensiya ang inihain sa korte.”

Si Christine ay ang 23-year-old flight attendant na namatay dahil sa ruptured aneurysm noong January 1, 2021.

Naging suspects ang ilan niyang kaibigan at bisita sa ginawa nilang New Year’s Eve party sa City Garden Hotel, Makati City mula December 31, 2020 hanggang January 1, 2021.

Ilan sa kanila, na tinaguriang respondents ngayon, ay sina JP Dela Serna, Louie De Lima, Mark Anthony Rosales, John Paul Halili, Gigo de Guzman, Valentine Rosales, Rommel Daluro Galido, Clark Jezreel Rapinan, Rey Englis, Jammyr Cunanan, at Ed Madrid.
