Makati Prosecutor junks all complaints vs Christine Dacera companions, counter-complaints vs Sharon Dacera

Ibinasura ng Makati Prosecutor’s Office ang mga reklamong isinampa laban sa mga taong idinawit sa pagkamatay ng flight attendant na si Christine Dacera.

Ibinasura rin ng Prosecutor’s Office ang mga counter-complaints na isinumite ng respondents laban sa ina, kampo ng biktima, at pulisya.

Ibig sabihin, ibinasura ang lahat ng reklamong may kinalaman sa Christine Dacera case.

Ito ay matapos ang higit isang taon mula nang matagpuang walang malay ang biktimang si Christine, 23, sa isang hotel room sa Makati City, January 1, 2021.

Ginawa ang anunsiyo sa press briefer ng Department of Justice (DOJ) ngayong Lunes, February 7.

Ang reklamong “administering of illegal drugs” laban kina Mark Anthony Rosales at Rommel Galido ay ibinasura.

Ayon sa resolusyon, walang “proof of evidence that could establish the alleged administration of any illegal drug into the body” ng biktima.

Absuwelto rin sa reklamong “obstruction of justice” sina Rosales, Galido, John Pascual Dela Serna III, Gregorio Angelo Rafael De Guzman, Jezreel Rapinan, Alain Chen (a.k.a. Valentin Rosales), Reymar Englis, Darwin Joseph Macalla, at si Atty. Neptali Maroto legal counsel ng respondents.

Junked din ang perjury complaint laban kina Galido, Dela Serna, Macalla, at Rapinan.

Ayon sa DOJ briefer, “they were simply protecting their rights within the bounds of law.”

Ang isinampang reklamo ng respondents laban sa ina ng biktima na si Sharon Dacera, gaya ng libel, slander, at cyberlibel ay ibinasura “for lack of proof of malice.”

Absuwelto rin si Sharon sa reklamong “intriguing against honor” at “malicious prosecution.”

Ibinasura rin ang “illegal detention,” “arbitrary detention,” at “unlawful arrest” ng respondents laban kay Sharon, kaibigan nitong doktor na si Marichi Ramos, pinsang si Katherine Anne Faceo, at dalawa pang pulis.

Ayon sa resolusyon, hindi maaring kasuhan ang kampo ni Sharon Dacera "as there was no evidence that they effectively controlled and directed the respondent-police officers to arrest and detain the complainants."

Ibinasura rin ang “falsification” complaint laban Police Major Michael Nick Sarmiento, medico-legal officer, "as it was not established that the fact narrated by him were absolutely false."

Ngayong Lunes ng hapon, February 7, itinakda ang pagdinig sa hiwalay na administrative complaint na inihain ng grupo ng responds laban kay Makati City Police Chief Colonel Harold Depositar.

Sa kabilang matanda, noong April 2021 ay na-dismiss na ang reklamong “rape with homicide complaint" laban sa mga respondents dahil sa “lack of probable cause,” ayon sa Makati Prosecutor’s Office.

Sinabi nitong ang mga ebidensiyang ipinresenta ay hindi sapat “to engender a well-founded belief that rape, homicide, or rape with homicide has been committed.”

Ang respondents nito ay sina John Pascual dela Serna III, Rommel Galido, John Paul Halili, Gregorio Angelo de Guzman, Louie Delima, Clark Jezreel Rapinan, Rey Englis, Mark Anthony Rosales, Jammyr Cunanan, Valentine Rosales, at Ed Madrid.
