Former Sen. Lito Lapid's graft case over fertilizer fund scam junked

Ex-Senator Lito Lapid's alleged involvement in fertilizer scam gets dismissed by anti-graft court due to "unjustifiable delay" in the Ombudsman's preliminary investigation. 

Binasura ng Sandiganbayan ang kasong graft laban kay dating Senator Lito Lapid na nasangkot sa diumano’y fertilizer fund scam.

Ito ay sa kadahilanang wala raw sapat na basehan kung bakit tumagal ng apat na taon at anim na buwan ang imbestigasyon ng Office of the Ombudsman bago nito isinumite ang impormasyon sa anti-graft court.

Sabi sa isang bahagi ng resolusyon ng Sandiganbayan First Division, na naiulat sa GMA News Online, ngayong Martes, Oktubre 4:

“All in all, the unjustified delay during the Ombudsman’s preliminary investigation qualifies as vexatious, capricious, and oppressive.

“Without a reasonable explanation, the delay in the latter’s proceedings is unwarranted considering the adverse effects and/or prejudice that such a long delay may cause upon the defense of the accused.”

Maging ang mga kapwa-akusado na sina Ma. Victoria Aquino-Abubakar, Leolita Aquino, at Dexter Alexander Vasquez ay absuwelto rin mula sa parehong kaso.

Naharap sa kasong graft si Senator Lapid dahil sa diumano’y maanomalyang pagbili ng lokal na pamahalaan ng Pampanga ng 3,880 liters na fertilizer mula sa Malayan Pacific Trading Corporation (MPTC) noong 2004.

Sa impormasyong isinumite ng Office of The Ombudsman sa Sandiganbayan, nakasaad na hindi umano dumaan sa public bidding ang pakikipagtransaksiyon ng lokal na pamahalaan ng Pampanga sa MPTC.

Ang naturang transaksiyon—na nagkakahalaga ng P4.76 million—ay naganap diumano noong panahong nagsilbing gobernador ng Pampanga si Lapid.
