Last August 14, the first preliminary conference for the criminal complaint filed by Lorayne Pardo against Richard Gutierrez took place. The latter was a no-show because of a movie-shoot commitment.

Isang preliminary conference ang naganap sa Imus Hall of Justice sa Cavite, noong Agosto 14, kaugnay sa "Reckless Imprudence Resulting In Homicide" na isinampa ni Lorayne Pardo laban sa aktor na si Richard Gutierrez.
Si Lorayne ang asawa ni Nomar Pardo, ang personal assistant ni Richard na namatay sa car accident na naganap noong May 22 sa Silang, Cavite, nang ang sports car na minamaneho ni Richard ay lumihis sa highway at bumangga sa poste ng PLDT, bago sumalpok sa tatlong puno ng niyog, at tuluyang mahulog sa mababang damuhan. Si Pardo, na nakaupo sa likod, ay lumusot sa likod na salamin at tumilapon mga sampung metro mula sa binagsakan ng sports car.
Nakatakdang magsumite noong araw na iyon ng counter-affidavit si Richard. Subalit ayon sa abogado ni Richard na si Atty. Sheryll Mallari—isang junior partner sa Belo Gozon Elma Parel Asuncion & Lucila Law Offices—kailangan pa raw nila ng mas mahabang panahon upang buuin ang kanilang counter-affidavit.
Sa panayam ni Atty. Mallari sa Startalk, sinabi nito: "We just want some ample time to file our response because we haven't received the copy of the subpoena yet, and today, we received a copy of the amended complaint affidavit. So, next hearing is set on August 28 at 10:00 a.m."
Sa ngayon, saad ng abugado ni Richard: "We are in the process of preparing the affidavit for filing it at the Prosecutor's Office."
Hindi nakasipot sa hearing si Richard dahil first shooting day raw nito sa kanyang upcoming horror film, ang Patient X.
Nakapanayam din ng Startalk ang legal counsel ni Lorayne na si Atty. Ombra Jainal tungkol sa hindi pagsusumite ng kampo ni Richard ng kanilang counter-affidavit at sa hindi pagsipot ng aktor.
Ayon kay Atty. Jainal: "Maybe, she herself did not receive anything. But per information from the prosecutor herself, somebody who represented himself as a legal representative of Richard Gutierrez got a copy of affidavit."
Dagdag nito: "[The] justice system is very reasonable. I think it will be good for everybody if we will allow our justice system to work. Walang personalan.
"The truth is, you don't even need a complainant for the case to be prosecuted. We have our own criminal laws. If the laws are violated, it is incumbent upon our public officer to make sure that these laws are implemented. So, this is not a subject of any compromise..."
Ano naman ang masasabi ni Atty. Jainal tungkol sa kanyang kliyente at sa isyu?
"Asawa niya namatay. Gusto niya makausap si Richard nang masinsinan to really find out the truth about what really happened and she's entitled... Isipin mo na lang, halimbawa ang nagmaneho si Nomar, 'tapos si Richard ang nadisgrasya, 'tapos kakausapin si Nomar ng nanay ni Richard. Hindi na ako magsasalita. You know the answer."
"LALABAN AKO HANGGANG HULI." Pagkatapos ng preliminary conference ay nakausap naman ng PEP (Philippine Entertainment Portal) si Lorayne tungkol sa development ng kasong isinampa niya laban sa aktor.
Wala na ba talagang pag-asa na makipag-settle siya sa kampo ni Richard?
"Lalaban po tayo hanggang sa huli," ang payak na sagot ni Lorayne.
Nang tanungin uli siya ng PEP, ipinaliwanag niya ang sarili: "Ang isinampa ko pong kaso sa kanya, isa—criminal. Sa criminal [case] po, wala pong settlement doon. Wala, it's too late. Mahaba na 'yong two months, e, pero wala siyang ginawa... My lawyers are pro bono."
Ang "two months" na tinutukoy ni Lorayne ay ang panahon mula sa pagkamatay ni Nomar hanggang sa pagsampa niya ng kaso laban kay Richard. Sa panahong daw na iyon, walang ginawa si Richard upang ituwid ang pagkakamali. Sa tinukoy naman niyang "pro bono," ang ibig sabihin nito ay wala siyang ibinabayad sa abugado.
Sinegundahan ito ni Atty. Jainal: "As lawyers, it is incumbent upon us to render some free legal assistance, and this will be credited to my obligation because it is mandatory."
Ang free legal assistance ay ibinibigay sa mga taong walang kakayanang bayaran ang kanilang mga abugado, lalo na sa isang kasong malamang ay abutin sa korte ng maraming taon.
