GRAND ENTRANCE. Caviteños in the vicinity were thrilled by the arrival of the Gutierrez family at around 9:30 a.m. A crowd of spectators wielding cameras filled the street as the celebrities alighted from a Mitsubishi Rosa micro-bus that they parked in front of the Imus City Hall of Justice.
Accompanying the family were Annabelle's star talents Ehra Madrigal, Michelle Madrigal, Bubbles Paraiso, and Carla Humphries, plus Royale Era Entertainment publicist Jun Lalin.
Richard's group was immediately ushered to Preliminary Investigation Room No. 1, where Richard was expected to affirm the counter-affidavit his lawyer filed on Aug. 28. Richard had not been present on that day.
Eddie, Richard, Ramon Christopher, Pilita, and Annabelle occupied the whole second row of Room No. 1. Lorayne sat directly in front of Annabelle, but the two did not acknowledge each other's presence.
Fans started milling around the stars and asked to have their pictures taken with them. The stars obliged. At about 10 a.m., Prosecutor Velasco called the two parties to his office. He talked to them about working out an amicable settlement. He said he believed that a settlement was still possible.
Atty. Asuncion, Richard's counsel, then proposed that Prosecutor Velasco talk to the the complainant and the defendant individually. Atty. Jainal, Lorayne's counsel, agreed to the proposal.
Velasco first had a closed-door meeting with Lorayne, her father-in-law Ramon, and Atty. Jainal. After about twenty minutes, the three stepped out of Velasco's office and were ushered to another room, which was also the room where the Gutierrezes had been waiting. When the two camps passed by each other in the corridor, neither one acknowledged the other's presence.
While Velasco was in his closed-door meeting with Richard, Annabelle, Eddie, Ruffa, Monching, Pilita, and their two lawyers, Atty. Mallari and Atty. Asuncion, and Lorayne was waiting in another room, PEP managed to have a brief conversation with her. (At this point, there was as yet no gag order issued.)
We asked if she was inclined to settle. Lorayne said that despite the prosecutor's offer, she was not. In her words, "Kung ikaw ba iyong namatayan, makikipag-settle ka ba?"
After about ten minutes, Prosecutor Velasco asked Lorayne and Richard to talk to each other in a room adjoining Velasco's office, but not within sight of the others. Their conversation lasted more than 30 minutes, according to Velasco.
The meeting between the actor and the widow was relatively quiet, and no sound escaped the room where they stayed. Both parties were also unwilling to divulge the details of their conversation to the press, more possibly because of the gag order than from a natural reluctance to vent.
After the private conversation between them, an expressionless Richard and an unsmiling Lorayne returned to the prosecutor's office, where they agreed to the prosecutor's proposed 15-day period within which to decide on the possibility of a settlement.
A source who works in the Hall of Justice also told PEP that before the mediation ended, Richard finally affirmed his counter-affidavit. Lorayne also passed and subscribed to her own Letter of Reply.
The gag order prevented PEP from procuring copies of the said documents.
When the press asked Ruffa for her reaction, she said, "Sana kanina bago mag-gag order. Abangan n'yo na lang sa The Buzz."

Kahit iniipon lang ang karma nila - lahat may hanganan din. Tao lang din sila - kagaya nating lahat...kaya mayroon din silang hanganan...
Ganoon ba? Di bale basta ang importante ay malaman ni Richard Gutierrez ang kanyang pagkakaMALI at hindi iyung aksidente ang pinagbabalingan ng sisi. He is indeed responsible for the accident. As a DRIVER, he just failed to do things that he should do to avoid it.
Mali pala tayo. Nonetheless, the rest of our arguments still hold up...it is man's responsibility to avoid accidents.
From the ABSCBN site - I stumbled upon the news that Lorayne has approached the DOJ for assistance today the 11th of September. The entire article has been posted on the thread for Lorayne here at PEP or you can also view it from the ABSCBN website.
I am glad that Lorayne and family have decided to move out of the Cavite region to seek justice. Anyway, hopefully - it will for the best.
Let us not give up on this!
Please read my comment367 for my detailed explanation.
RIP, JB, Nomar at Kulot.
cont'n...
Whether it says that he cannot think for himself, I cannot say. Who knows?
That he lacks humility, possibly.
He is an idol - 'yan lang ang point ko.
Whether he deserves to be idolized is another matter that I think I already clarified in detail.
I just want to be fair also.
I agree with you that Richard 'handled his mess' immaturely.
1. He deceived the public when he said 'I am not responsible' sa PR nya. Kasinungalingan 'yan kung pagbabasehan ang batas.
2. He tolerated - or maybe he encouraged - his mom's crass behavior against the deceased and his family eg. saying derogatory remarks, saying Nomar doesn't deserve a tribute, stopping check donations.
3. He refused to talk to Lorayne even just to tell the story of what happened. This is just plain rude.
Notwithstanding all these examples of poor judgement, Richard IS still a role model obviously because people like phinx and tigasin09 still idolize him. We cannot deny that fact. What that says about these people, is another matter I would not care to elaborate on...hehe.
Whether it says he cannot think for himself, I cannot say.
To illustrate further:
To conclude, Richard should say 'sorry' for his 'wrong' actions and decisions that resulted in Nomar's death. His sympathies and condolences are not enough. He should still say 'I'm sorry' and accept that 'he was responsible' for the accident. And preferably, he should mean what he should say.
The traffic law RA4136 was created so that only those that have control are blamed for accidents. We cannot blame the weather or the road condition or even God for this accident because no one can control these factors when travelling. Kaya driver ang sinisisi. And for public vehicles, pati yung nag-hire ng driver - the vehicle owners ang sinisisi.
What is so 'rude and utak barbarik' about this line of reasoning? I am not a legislator nor a lawyer but I understand the logic behind the law. I think that our laws are reasonable and fair and if only they are strictly implemented, our drivers will show more discipline on the road... and in general, our country will be more progressive.
I disagree with you on the point that the tragedy involving Dennis and JB is due to 'nature'.
While JB's death is indeed a tragedy and I would not wish for this to happen to anyone, his death is a result of his own negligence. It is dangerous for anyone to swim near rocky surfaces. It is his decision to swim despite the apparent danger that caused the accident.
And tigasin09, since it is his own negligent behavior that resulted in his death, no one should blame his swimming buddy Dennis for this accident.
Same as humanright and thehunks100 position... there is no law that says that you are responsible for the accidental death of a person you are swimming with.
Look up and read RA4136 so you could understand why we think Richard is responsible for Nomar's death.
Kung tamad ka, I'll spell it out for you... The land transporation and traffic code says that the driver and vehicle owners are responsible for any damage or death resulting from an accident.
In short, it is the law that says Richard is responsible for his passenger's death. It is not just some 'principle' that we imagined and used as the basis for our judgement.
If they want to appear as socially responsible citizens - they should start with the people they have wronged.
Haay naku - though you are celebrities - not everything you do should be a presscon of sorts. Can you not do anything good for others without the need for reporters to be around?
I hope that nothing more disturbing is happening with this case. If the lawyers of the Pardo's are disturbed with the turn of events - how do you think we feel then? Their camp is so quiet - it is really disturbing...
