Supreme Court ousts Lucy Torres-Gomez as Leyte representative; Lucy’s camp "surprised but not worried"

Supreme Court has ousted Lucy Torres-Gomez as representative of the fourth district of Leyte because she “did not validly substitute” her husband, Richard Gomez.


Dalawang buwan bago ganapin ang mid-term 2013 elections, ibinaba ng Supreme Court ang desisyon kaugnay ng protesta laban sa TV personality na si Lucy Torres-Gomez.

Ayon sa report ng ABS-CBN News ngayong araw, March 19, ipinatanggal na si Lucy bilang representative ng fourth district ng Leyte.

Sa text message na ipinadala ng Supreme Court spokesperson Theodore Te sa media, si Lucy “did not validly substitute” ang kanyang asawa na si Richard Gomez noong May 2010 elections.

Ipinaliwanag ni Te na hindi maaaring palitan ni Lucy ang kanyang asawa dahil hindi naman talaga ikinunsidera bilang kandidato si Richard.

Pahayag ng SC spokesperson, “He was held ineligible for failure to comply with residency requirements. Thus, absent a valid substitution Ms. Torres-Gomez could not have been considered a candidate.”

Ayon pa kay Te, pitong magistrates ang bumoto para sa ouster ni Lucy, apat ang nag-dissent, at apat din ang nag-abstain.

Dapat sana ay tatakbo si Richard bilang fourth district representative ng Leyte sa ilalim ng Liberal Party, ngunit diniskwalipika siya ng Commission on Elections (Comelec) noong February 17, 2010.

Ito ay dahil hindi raw napatunayan nang lubusan ng aktor ang kanyang residency sa Ormoc City, na siyang hometown ng kanyang misis na si Lucy.

Ang protesta ay inihain ng residente ng Ormoc na si Silverio Tagolino.

Pagkatapos madiskwalipa ni Richard ay pinalitan siya ni Lucy.

Nakakuha si Lucy ng botong 101,250 laban sa 76,549 votes ng Lakas-Kampi-CMD candidate na si Eufrocino Codilla Jr.

Dahil sa pagkakatanggal ni Lucy, ayon sa isang analyst, posibleng ipasauli sa kanya ang nakuha niyang suweldo sa panahong nanilbihan siya bilang Leyte representative.

Ayon din sa analyst, maaari ring si Codilla ang humalili sa kanya hanggang sa maihalal ang bagong representative.

Tumatakbo muli ngayon si Lucy bilang representative ng fourth district, laban kay Eric Codilla.

Ipinadala naman agad ni Richard sa pamamagitan ng text message sa managing editor ng PEP na si Karen Pagsolingan ngayong hapon, ang pahayag ng legal counsel ni Lucy na si Atty. Alex Avisado ng Gana Atienza Avisado & Associates.

Narito ang pahayag nila:

"We are surprised but not worried about this recent decision in the case filed by Silverio Tagolino against Cong. Lucy Torres Gomez.

"In a similar case, the Supreme Court had already previously upheld the decision of the HRET [House of Representatives Electoral Tribunal] in our favor and dismissed the petition of her rival Eufrocino Codilla Jr.

"The issue of residency of Cong. Lucy Torres Gomez had long been settled with finality for which an Entry of Judgment had already been issued by the Supreme Court.

"We humbly believe this is a serious and reversible error.

"We will file a Motion for Reconsideration as soon as we receive a copy of this decision.

"In the meantime, Cong. Lucy shall continue to discharge her duties as the duly elected representative of the 4th district of Leyte.

"We are confident that in the end, justice shall be served only to those who are deserving."
