Dr. Mark Herbert "Bistek" Rosario and Dr. Vicki Belo attended the preliminary investigation by the Philippine Medical Association (PMA) on the Hayden Kho sex-video scandal yesterday, June 16, to explain their alleged involvement in the distribution of the videos.

Bistek, who never attended any probe on the scandal before, said in an interview with GMA News that: "I've never, parang nagtago with this. I was very open to any investigation."

Bistek's name was dragged into the scandal when scandal victim Katrina Halili charged him and three others—Dr. Vicki Belo, Erik Johnston Chua, and Bistek's long-time girlfriend Princess Velasco—as the masterminds behind the scandal, in a formal complaint she filed at the Department of Justice (DOJ).

The controversy made headlines when videos of the sexual exploits of cosmetic surgeon Hayden Kho Jr. with at least three women, including Katrina, surfaced on the Internet.

In an earlier interview with ABS-CBN's Showbiz News Ngayon (SNN), Bistek denied any hand in the distribution of Hayden Kho's sex videos to the public, asserting that he did not even have time to view the videos because he was busy with his medical profession.

But he admitted that it was him and businessman Erik, another friend of Hayden, who warned Vicki of the existence of the sex videos. He said Vicki then instructed them to retrieve these in Hayden's laptop.

Bistek also confirmed Hayden's foiled suicide attempt. He said that after he and Erik gave Vicki the files they retrieved from Hayden's condo unit, he was told that Hayden attempted suicide. It was Bistek who first checked on his friend.

"I found Hayden there lying down and siyempre as a doctor, I checked if he was still breathing. We immediately brought him to Makati Med," he said.

THE AFFIDAVITS. Vicki also submitted to the PMA the sworn affidavit she previously presented to the National Bureau of Investigation last May 26.

The affidavit confirmed that she instructed Bistek and Erik to retrieve three computers and one hard drive from Hayden's place, which she owns.

The doctor to the stars also confirmed that only Erik, not Bistek, had copies of the sex videos. She added that Erik gave her a DVD copy, which she promptly destroyed after viewing.

But in a court affidavit he submitted on June 4, Erik also denied "having a hand in the proliferation of Dr. Kho's sex videos."

"Dr. Belo handed a recordable digital video disk (DVD-R) and asked me to make a copy of the video recordings. In her presence, I made a copy of the video recordings, and turned over the DVD-R to Dr. Belo upon its completion. On Dr. Belo's instructions and likewise in her presence, I deleted all the video recordings in the laptop, and thereafter left her residence. Dr. Belo likewise left her residence for another meeting," Erik explained.

THE LOGBOOK. Atty. Adel Tamano, Vicki's legal counsel, however, argued that Erik's sworn affidavit contained inconsistencies.

In an interview in GMA-7's Startalk last June 13, Atty. Tamano claimed that it was Vicki who left her residence first, not Erik.

"Ang sabi ni Erik sa affidavit niya, after he downloaded the videos, nauna siyang umalis sa bahay ni Dra. Belo. Hindi po totoo 'yan. Because, ang hindi naalala ni Erik Chua, every time na pumasok ka sa bahay ni Dra. Belo, may security guard doon.

"And the security guard will record who you are, and also what time you arrived, what time you left. We took a look at the logbook at kinausap namin yung mga security guard.

"Si Erik Chua arrived at Dra Belo's house at 5:45 ng hapon. Si Dra. Belo umalis ng 7:25, at si Erik Chua left the house at 8:55. Meron pang isang oras at kalahati that it was just Erik Chua with the computer and the videos. Doon pa lang sa affidavit ni Erik Chua, hindi na totoo ang sinasabi niya," explained Atty. Tamano.
