Nakatakdang magsampa ang kampo ni Vhong Navarro ng reklamong perjury at libel laban kay Deniece Cornejo, dahil diumano sa patuloy na pagpapakalat ng mga ito ng kasinungalingan laban sa actor-TV host.

Diin ni Atty. Alma Mallonga, legal counsel ni Vhong, “She has perjured herself effectively, three times.

“The first time was when she filed a rape complaint and said that Vhong raped her and the evidence shows it is not true.

“Secondly, she perjured herself again when she asserted that rape happened to support her petition for a protection order with the RTC [Regional Trial Court] in Taguig.

“The third time was when she asserted the falsehood that on January 17, a rape occurred, when in all her previous allegations she has categorically said nothing of that sort happened because she sent Vhong away.

“Given the consistency of her lying about this, how can she be believed at all?”

Nakapanayam ng PEP.ph (Philippine Entertainment Portal) ang abugada kagabi, February 25.

CONFLICTING SWORN STATEMENTS. Ang pahayag ni Atty. Mallonga ay kaugnay ng sinumpaang salaysay ni Deniece na isinumite niya sa Department of Justice noong February 21.

Dito ay inilahad ni Deniece na dalawang beses diumano siyang hinalay ni Vhong sa loob ng kanyang condo unit sa Forbeswood Heights, Taguig City.

Naganap umano ang seksuwal na pang-aabuso sa dalaga sa magkahiwalay na okasyong nagkita sila ni Vhong—noong gabi ng January 17 at January 22.

Taliwas ito sa complaint affidavit na isinumite ni Deniece sa Taguig Prosecutor’s Office noong January 29, kunsaan walang anumang nabanggit ang dalaga na hinalay siya ni Vhong nang puntahan siya nito sa tinutuluyan niyang condo unit noong gabi ng January 17.

Kuwento pa ni Deniece, halos hindi sila nakapagkuwentuhan ni Vhong dahil abala siya sa pagtatrabaho at nakatutok sa kanyang laptop, habang ang actor-host naman ay umiinom ng alak sa maliit na sala ng condo.

“During this time, I was still preoccupied with some work and did not join Kuya Vhong in the living area, which is why he commented to me, ‘Ano ba ’yan… magkikita tayo ’tapos trabaho nang trabaho. Hindi ka nag-e-entertain ah.’

“I replied that we were still waiting for my girl friend to arrive that’s why I was still finishing some work before we could all hang out.

“Kuya Vhong remarked, ‘Ah talaga, akala ko tayong dalawa lang.’ I told him no, my friend said she’s still coming over.

“So I continued with my work while Kuya Vhong tried to make light conversation with me,” lahad ni Deniece sa kanyang pinakaunang complaint affidavit.

Sa huli, tumawag daw ang kaibigan niya upang sabihin na hindi ito makakarating, kaya nagpasya si Deniece na pauwiin na lang si Vhong.

Patuloy na salaysay ni Deniece, “He tried to insist that I let him stay longer and even made jokes about sleeping over, which I just dismissed as playful banter.

“I told him, ‘No, di talaga puwede so finally Kuya Vhong conceded and said, ‘Sige next time na lang. Bumawi ka sa akin.’

“Thereafter, Kuya Vhong left my unit by himself.”

“LIABLE FOR PERJURY AND LIBEL.” Umani ng pambabatikos mula sa publiko ang kampo ni Deniece, dahil sa pabagu-bagong pahayag ng dalaga kaugnay ng reklamong panggagahasa sa kanya ni Vhong.

Sa panayam ng DZMM kay Atty. Howard Calleja, legal counsel ni Deniece, umapela ito sa publiko na intindihin ang sitwasyon ng kanyang kliyente.

Ito ay sa kadahilanang hindi madali para sa isang biktima ng panggagahasa ang paulit-ulit na alalahanin ang nangyaring karahasan sa kanya.

Sa kabilang banda, kinukuwestiyon ng kampo ni Vhong kung bakit ngayon lang isiniwalat ni Deniece ang tungkol sa seksuwal na pang-aabuso sa kanya ng actor-host noong January 17.

Paliwanag ni Atty. Mallonga: “She had two opportunities to assert those details in her complaint. But she repeatedly said no such thing happened.

“In the police blotter, which she submitted to Southern Police District’s District Investigation and Detection Management Division (DIDMD) dated January 22, she never mentioned anything of that sort.

“In fact, on the night of January 22, all she said was an attempted rape occurred.

“It was also indicated in the police blotter that she didn’t want to pursue her claim.”

Bunsod nito, sinabi ng abugada na mayroong sapat na ebidensiya ang kampo ni Vhong, kaugnay ng reklamong perjury at libel na nais nilang isampa laban kay Deniece.

Maging si Cedric Lee ay kasama rin sa gustong ireklamo ng kampo ni Vhong, dahil sa patuloy na paninira umano ng una sa actor-host.

Tila kaugnay ito ng pahayag ni Cedric, kunsaan tahasan nitong sinabi na si Vhong ay isang “rapist.”

Sabi ni Atty. Mallonga, “Naaawa ako kay Vhong. Isn’t it enough na binugbog siya nang pisikal?

“Now he continues to be brutalized and victimized by all of these lies against him. This is too much.”

Saad pa ng abugada tungkol sa reklamong perjury at libel na balak ihain ni Vhong laban kina Deniece at Cedric:

“Aside from the serious illegal detention complaint, they are also liable for perjury and libel.

"And very soon, these additional charges will be filed against them."

Ayon sa chanrobles.com, nakasaad sa Articles 183 at 184 ng Revised Penal Code na ang perjury ay paglabag sa batas, kunsaan ang isang testigo ay naghayag ng pawang kasinungalingan sa kanyang sinumpaang salaysay kaugnay ng isang judicial or official proceeding.

Ang libel, ayon sa Article 353 ng RPC o Crimes Against Honor, ay ang pagpapalaganap ng malisyosong impormasyon o paninira sa reputasyon ng isang tao nang walang sapat na “justifiable motive.”

SERIOUS ILLEGAL DETENTION COMPLAINT. Nauna nang sinampahan ni Vhong ang grupo nina Deniece at Cedric ng reklamong serious illegal detention, serious physical injuries, grave threat, grave coercion, at blackmail sa Department of Justice.

Kasama rin sa naturang reklamo sina Bernice Lee, Simeon “Zimmer” Raz Jr., Ferdinand Guerrero, JP Calma, Jed “Mike” Fernandez, at isang hindi pa nakikilalang lalaki.

Sa preliminary investigation ng DOJ noong February 21, hiniling ng kampo ni Vhong na ipa-subpoena ng National Bureau of Investigation (NBI) sina JP at Jed, upang makapaghain na sila ng kanilang counter-affidavit.

Si Ferdinand naman ay hindi pa napapadalahan ng kopya ng serious illegal detention complaint ni Vhong, dahil hindi pa napag-aalaman ng NBI kung ano ang address nito.

Samantala, umapela si Atty. Mallonga noong mismong pagdinig sa DOJ kung maaaring ibigay ng kampo nina Cedric ang address ni Ferdinand.

Ngunit nanatiling tikom ang bibig ni Cedric at tumanggi ang abugado nitong si Atty. Calleja na ibigay ang impormasyong hinihingi ng abugada.

Tumanggi rin si Atty. Calleja na pangalanan ang isang hindi pa nakikilalang lalaki na kasama sa nambugbog kay Vhong noong gabi ng January 22 sa Forbeswood Heights, Taguig City.

Nakatakdang magkita muli sa tanggapan ng DOJ ang magkabilang kampo para sa isa pang pagdinig sa Biyernes, February 28.

Nanatiling bukas ang PEP sa anumang pahayag na nais ipahayag ng mga taong sangkot sa isyung ito.
