Ombudsman junks motion for reconsideration of Enrile, Estrada, Revilla in plunder raps

In three separate orders dated June 4, Ombudsman Conchita Carpio Morales denied the motion of reconsideration filed by Senators Bong Revilla, Jinggoy Estrada, and Juan Ponce Enrile. "Evidently, the motions for reconsideration are rehashes of the arguments previously raised by them and already resolved by this Office,” says Ombudsman Morales in a press statement released today, June 5.


Ibinasura ni Ombudsman Conchita Carpio Morales ang inihaing apela nina Senators Juan Ponce Enrile, Bong Revilla, at Jinggoy Estrada kaugnay ng kasong plunder na kinahaharap nila.

Kaugnay pa rin ito ng maanomalyang paggamit ng Priority Development Assistance Fund (PDAF) o mas kilala bilang pork barrel.

Sa ulat ng GMA News Online ngayong araw, June 5, inilathala ang ilang bahagi ng opisyal na pahayag ni Morales tungkol sa pagbasura niya ng motion for reconsideration ng tatlong mambabatas.

Bunsod nito ay tuloy ang paghain ng Office of The Ombudsman ng kasong plunder at kasong paglabag sa Section 3(e) ng Anti-Graft and Corrupt Practices Act laban kina Enrile, Estrada, at Revilla sa Sandiganbayan.

Sabi sa isang bahagi ng joint orders ng Ombudsman na lumabas kahapon, June 4: “Evidently, the motions for reconsideration are rehashes of the arguments previously raised by them and already resolved by this Office.”

Iginiit din ni Morales na mayroong “probable cause” upang sampahan ng kasong plunder sina Enrile, Estrada, at Revilla.

Ito ay base sa mga nakalap na ebidensiya, kabilang na ang comprehensive report ng Commission on Audit (COA) hinggil sa mga ini-release na PDAF ng mga sangkot na mambabatas.

Itinuturing ding matibay na ebidensiya ang mga sinumpaang salaysay ng whistleblowers, witnesses, at pati na rin ang resulta ng hiwalay na imbestigasyon ng Field Investigation Office ng Office of The Ombudsman.

“Probable cause, for purposes of filing a criminal information, refers to such facts as are sufficient to engender a well-founded belief that a crime has been committed and the respondent is probably guilty thereof and should be held for trial [, and] needs only to rest on evidence showing that, more likely than not, a crime has been committed and that it was committed by the accused.”

Matatandaang inirekomenda ng Office of The Ombudsman na makasuhan ng plunder sina Enrile, Revilla, at Estrada noong April 2.
