Why PNoy did not mention plunder raps against Senators Enrile, Estrada, Revilla

“We have a separation of powers. So, if it’s already with the judiciary, the wheels of power are moving already. Let’s not meddle anymore because that’s the final step," says Senator Teofisto Guingona III when asked why the much-talked about plunder raps against Senators Juan Ponce Enrile, Jinggoy Estrada, and Bong Revilla weren’t mentioned in PNoy’s SONA.


Kapansin-pansing hindi binanggit ni President Benigno "Noynoy" Aquino III ang kontrobersiyal na pork barrel scam na kinasasangkutan nina Senators Juan Ponce Enrile, Jinggoy Estrada, at Bong Revilla sa kanyang State of the Nation Address (SONA) ni PNoy kahapon, July 28.

Ang tanging ini-report ng Pangulo kaugnay ng anti-corruption drive ng administrasyon ay irregularities sa infrastructure projects, P3.5 billion rehabilitation budget para sa mga nasalanta ng Ondoy at Pepeng, at paglustay ng government funds sa mga proyektong “walang saysay.”

Ito ay sa kabila ng inaasahang panibagong pasaring na matatanggap ng tatlong mambabatas na nahaharap sa kasong plunder at kasalukuyang nakaditena sa Camp Crame.

Nauna nang inihayag ng maybahay ni Senator Revilla na si Cavite Representative Lani Mercado na hindi siya dadalo ng SONA dahil posibleng maging “biktima” muli ang kanyang asawa sa “shame campaign” ni PNoy.

Ayon naman kay Senator Teofisto Guingona III, tama lang na hindi na banggitin pa ni PNoy ang tungkol sa kaso nina Senators Enrile, Estrada, at Revilla dahil nasa korte na ito.

“The PDAF [Priority Development Assistance Fund] kasi is already with the judiciary.

“We have a separation of powers.

“So, if it’s already with the judiciary, the wheels of power are moving already.

“Let’s not meddle anymore because that’s the final step. Hayaan na natin,” saad ni Senator Guingona.

Maging si Department of Justice (DOJ) Secretary Leila de Lima ay sang-ayon na hindi na binanggit ni PNoy sa SONA ang tungkol sa kinasasangkutang kontrobersiya ng tatlong mambabatas.

“I see no problem with that. I think ang naisip ng Pangulo kung bakit hindi na niya minention ‘yan is because alam na ng mga tao kung anong stage ng kasong ‘yan.

“Nasa Sandiganbayan na. Hayaan na lang muna natin na ang proseso ng justice system ay gumalaw.

“Kaysa naman we highlight, baka magreklamo pa yung mga nasasakdal.

“They also have the presumption of innocence and they have the right to due process.

“And that’s precisely what they’re facing now—due process.”

Hiwalay na nakapanayam ng PEP sina Senator Guingona at Secretary De Lima pagkatapos ng SONA ni PNoy sa Batasang Pambansa, Quezon City, kahapon, July 28.

PETITION FOR BAIL. Sa ngayon, nagsimula na ang proseso ng pagdinig para sa petition for bail na inihain nina Senator Revilla at Senator Estrada.

Humarap si Senator Revilla sa Sandiganbayan para rito noong July 17 at si Senator Estrada naman noong July 22.

Si Senator Enrile naman ay hindi pa pormal na naghahain ng petition sa Sandiganbayan.

Paliwanag ni Secretary De Lima, “Two of the three cases, nagsimula na yung bail hearings because all of them asked for bail.

“Plunder is non-bailable. But then again, puwede rin humingi ng bail if the evidence of guilt is not strong.

“Almost every accused in a non-bailable case will always try to ask for bail.”

SUSPENSION ORDER. Noong July 18, nag-isyu ng suspension order ang Sandiganbayan Third Division at Fifth Division para kina Senator Estrada at Senator Enrile, respectively.

Ayon kay Secretary De Lima, “Meron na ring order of suspension yung respective divisions, the ones trying Senator Jinggoy and Senator JPE.

“We’re awaiting the one in the case involving Senator Bong Revilla.”

Ngunit hindi pa ipinapatupad ng Senado ang naturang utos ng Sandiganbayan sa ngayon.

Ayon sa hiwalay na panayam ng GMA News kay Senator Alan Peter Cayetano—na nailathala sa GMA News Online—“under detention” ang itinalang dahilan kung bakit absent sina Senator Enrile, Senator Estrada, at maging si Senator Revilla sa opening ng second regular session ng Congress kahapon.
