Vhong Navarro’s lawyer dismayed at Taguig judge: "We have lost our confidence in the court to appreciate this case properly.”

Ito ang dismayadong pahayag ng legal counsel ni Vhong Navarro na si Atty. Alma Mallonga.

Kaugnay ito ng desisyon ni Judge Paz Esperanza-Cortes ng Taguig Regional Trial Court Branch 271 na hayaang makapagpiyansa sina Cedric Lee, Zimmer Raz, at Deniece Cornejo, na nahaharap sa kasong serious illegal detention at grave coercion.

Patuloy na saad ng abugada sa panayam ng dzMM na nailathala sa ABS-CBNNews.com, ngayong araw, September 17, “It appears to me that the court said that there was admittedly a detention, but ang sabi ng korte na whether or not the detention is illegal is of doubt.”

"VERY CLEAR" EVIDENCE. Kinuwestiyon ni Atty. Mallonga ang resolusyon ni Judge Cortes, kung saan nakasaad na hindi sapat ang ebidensiyang inihain ng kampo ni Vhong upang mapatunayan na “serious” at “kidnapping” ang motibo ng mga akusado para sa nabanggit na kaso.

Kaugnay pa rin ito ng insidenteng pambubugbog kay Vhong noong gabi ng January 22, 2014, sa Forbeswood Heights condominium sa Taguig City.

Sabi pa ni Judge Cortes sa isang bahagi ng resolusyon na may petsang September 12, “There was the immediate turnover of the private complainant by the accused herein to the police station for some alleged commission of the crime of rape.

“There was a possible demand for money in exchange for the release of an alleged video or the trashing of the police blotter.

“It is clear, therefore, that the motive for that alleged illegal detention by the accused of the private complainant herein is unclear.”

Buwelta ni Atty. Mallonga hinggil dito, “Amazingly enough, the matter of whether or not a rape occurred, the court also said it is not yet to be determined.

Ayon pa sa legal counsel ni Vhong, napilitan siyang ihayag ang kanyang saloobin dahil ipinagdiinan ng kampo nina Cedric at Deniece na ang pagpayag ng korte na pansamantala silang makalaya ay patunay na walang kasalanan ang mga akusado.

Ngunit muling iginiit ni Atty. Mallonga na hindi posible ang sinasabi ng mga akusado na “lawful arrest” ang ginawa nila kay Vhong, dahil walang naganap na panghahalay kay Deniece noong gabing binugbog ang aktor.

Patunay umano nito ang pagbasura ng dalawang reklamong panghahalay na isinampa ni Deniece laban kay Vhong.

Kasama na rin dito ang CCTV footages na ilan lang sa mga inihaing ebidensiya ng kampo ng aktor.

Kaya naman kinukuwestiyon ng abugado kung bakit itinuturing ng korte na hindi matibay ang ebidensiya laban sa grupo nina Cedric at Deniece, at pagkatapos ay pinayagan ang petisyon ng mga akusado para makapagpiyansa.

Pahayag pa ni Atty. Mallonga, "Huwag natin sabihin na si Vhong pa dito ang may sala.

“Wala pong kaso na rape that is pending against Vhong.

“The CCTV footage made it very clear that rape is impossible.

"So, I tell you, how can there be doubt about the matter?"



"LEGAL" ARREST. Sa hiwalay na panayam, nanindigan ang legal counsel ni Cedric na si Atty. Howard Calleja na “legal” ang isinagawang “citizen arrest” ng grupo ni Cedric kay Vhong.

“Ang mga elemento po ng illegal detention ay was there detention.

“Ang tanong po, kumpleto ba ang detention?

“Hindi naman po ibig sabihin ’pag ikaw natalian, nagkaroon na ng detention.”

Patuloy na paliwanag ni Atty. Calleja, "Isa pa pong tanong, e, kung legal or illegal.

“Ang sagot naman po namin ay iyon po ay legal dahil iyon ay citizen’s arrest.

“Dahil nakita ho namin siya [Vhong] na may ginagawa.

"Hindi rin po napatunayan ng kabila na invalid po ang arrest kaya nabigyan din po kami ng piyansa."

Kahapon, September 16, pansamantalang nakalaya sina Cedric Lee at Zimmer Raz matapos maghain ng tigpa-P500,000.

Ngayong araw, September 17, naudlot ang nakatakda sanang paglaya ng isa pang akusado na si Deniece Cornejo na nakapagbayad na rin ng piyansa.

Ito ay sa kadahilanang hindi napirmahan ni Chief City Prosecutor Archibald Manabat ang prosecutor’s clearance ni Deniece.

Nagkataon kasing dumalo ang prosecutor sa pagdinig ng kaso kaugnay ng Ampatuan massacre.

Ganunpaman, sinabi ng spokesperson ni Deniece na si Atty. Ferdinand Topacio na inaasahang makakalabas na ang kanyang kliyente mula sa detention cell ng Crime Investigation and Detection Group (CIDG) sa Camp Crame bukas ng umaga, September 18.
