Sen. Grace Poe disqualified by Comelec from 2016 presidential race

Diniskwalipika ng Commission on Elections (Comelec) si Senator Grace Poe mula sa presidential race para sa 2016 elections dahil sa hindi raw nito pagiging natural-born Filipino.

Ayon sa ulat ng GMA News ngayong Martes ng gabi, December 1, bumoto ang Comelec second division ng 3-0 pabor sa petisyong inihain ng abugadong si Estrella Elamparo upang kanselahin ang certificate of candidacy ni Sen. Poe para sa pagka-Pangulo.

Kinumpirma ng running mate ni Sen. Poe na si Senator Chiz Escudero ang balitang ito, ilang minuto pa lamang ang nakalilipas, ngunit hindi na siya nagbigay ng detalye.

Sa petisyong inihain ni Atty. Elamparo, sinabi nitong nabigo diumano si Sen. Poe na maabot ang 10-year residency requirement na nakasaad sa Konstitusyon para sa isang tumatakbong presidente.

Ayon sa Comelec second division, naging residente lamang ng Pilipinas si Sen. Poe noong July 2006 pagkatapos nitong mag-apply ng dual citizenship.

Ibig sabihin, kulang pa diumano ng dalawang buwan bago nito maabot ang 10-year residency rule.

Ngunit iginiit ng mga abugado ni Sen. Poe na naging residente ang senadora noon pang May 2005.

Iaapela raw ng mga abugado ni Sen. Poe ang naging desisyon ng Comelec en banc.

Isa lamang ang petisyon ni Elamparo sa apat na petisyong naglalayong idiskwalipika si Sen. Poe mula sa presidential race.

Comelec second division voted 3-0 in favor of the petition filed by lawyer Estrella Elamparo, who is seeking the cancellation of Poe's certificate of presidency for president.

Poe's running mate, Sen. Francis Escudero, confirmed this, saying he received the information 10 minutes ago.

According to Elamparo, Poe failed to meet the 10-year residency requirement mandated by the Constitution for a presidential candidate.

The report quoted the Comelec second division as saying that Poe became a resident only on July 2006 when she applied for dual citizenship.

It said this would make her two months short of meeting the 10-year residency rule.

Meanwhile, Poe's lawyers insisted that she became a resident in May 2005.

The report quoted Poe's camp as saying that they will appeal the decision with the Comelec en banc.
