Ibinasura ng Quezon City Prosecutor’s Office ang mga reklamo ni Sunshine Cruz na child abuse (R.A. 7610) at Anti-Violence Against Women and their Children (R.A. 9262) laban sa kanyang estranged husband na si Cesar Montano.
Si Assistant City Prosecutor Ferdinand Baylon ang nakalagda sa resolution na nagpapawalang-sala kay Cesar laban sa mga paratang ni Sunshine na dinala nito sa korte noong February 2015.
Nag-ugat ang mga kaso mula sa reklamo ni Sunshine na “nagparaos” diumano si Cesar sa harap ng kanilang mga anak na babae noong November 16, 2014.
Nagresulta diumano ito ng "distress, psychological, and emotional violence" kay Sunshine at sa mga anak nila ni Cesar.
Ginamit na ebidensiya ni Sunshine ang mga sulat ng kanyang anak tungkol sa kalaswaan na diumano’y ginawa ng aktor.
Ang kakulangan ng probable cause ang dahilan ni Baylon sa pagbasura nito ng mga kaso dahil nabigo si Sunshine na magbigay ng matitibay na ebidensiya.
Narito ang bahagi ng resolution kaugnay ng pagkakabasura ng mga reklamo ni Sunshine:
“The complainant failed to produce any evidence which would engender a well-founded belief that respondent herein indeed masturbated in front of his daughters and thus caused them emotional and psychological distress.
“Since the victims here were the children, it was imperative upon the complainant to at least present them and have them authenticate their letter’s complaints.
“None of the daughters who allegedly was the respondent masturbate was presented.
“Thus, the undersigned was deprived of the opportunity to examine whether these children were capable of perceiving the truth and narrating them as ‘child witnesses.’
“Moreover, none of the letters which was allegedly written by the victims were notarized or subscribed to by them.
“Thus, for all intents and purposes, the assertions made by the complainant are mere hearsay since she did not have any personal knowledge as to the alleged masturbation which was committed by the respondent in front of their daughters.”
