Erik Santos files libel complaints vs. Jobert Sucaldito

Erik Santos on libel complaints against radio show host Jobert Sucaldito: "The words and phrases that he used are calculated to induce the readers of his Facebook page to suppose and understand that I am gay and that I engage in sexual relationships with people of the same gender. The same are indisputably defamatory for they impute upon me a condition which is sufficient to impeach or reputation as bankable artist and to hold me up to public ridicule."


Singer Erik Santos and Cornerstone Entertainment Inc. founder and president Erickson Raymundo formally filed libel and several other legal complaints against radio host and reporter Jobert Sucaldito.

The complaints were filed at the Quezon City Prosecutor's Office today, March 30.

This was in relation to Sucaldito's series of Facebook posts and a blind item in his radio show that were allegedly damaging to the reputation of Santos and Raymundo.

Santos and Raymundo's complaints against Sucaldito totaled to 43 counts of cyber libel, 12 counts of grave threats, 1 count of slander, and 2 counts of libel.

Santos, in particular, filed two counts of libel, 21 counts of cyber libel, and six counts of grave threats against Sucaldito.

After filing his sworn affidavit before the Quezon City Prosecutor's Office, Santos immediately left and did not give any media interviews.


ERIK SANTOS'S COMPLAINT. Based on a copy of his sworn affidavit, Santos said that Sucaldito's attacks against him started when the latter gave a blind item during the live broadcast of his radio show Mismo on dzMM last March 9, 2017. 

The blind item was about a "certain talent management group" who is allegedly handling "gay singers."

Referring to Sucaldito's blind item, Santos's sworn affidavit partly read: "When his co-host, Ahwel Paz, mentioned that he does not know any gay singers from said talent management, Respondent replied, as follows, 'Meron no! 'Di ba nga magcoconcert nga?'

"Respondent was clearly referring to me since I am about to have a my concert on 07 April 2017, which was being promoted by Ahwel Paz during the same show, immediately before said blind item was narrated."

Santos's sworn affidavit also contained screenshots of Sucaldito's "derogatory" Facebook posts dated March 16, March 17, March 18, March 19, and March 21.

SUCALDITO'S "BLIND ITEMS" ON FACEBOOK. In his March 10 Facebook post, Sucaldito wrote about an unidentified "gay" male singer who pretends  to be courting a female singer to hide his real gender identity.

This was followed by Sucaldito's March 16 Facebook post wherein he alluded to a still-unnamed gay singer pretending to be a "saint" while engaging in "pasimpleng kawalanghiyaan" acts."

Sucaldito further accused the unnamed gay singer of being a freeloader and of having sexual relationships with male singers and massage therapists.


NAME-DROPPING ERIK SANTOS. Santos further narrated in his sworn affidavit that Sucaldito "explicitly" dragged his name in the latter's supposed "blind items."

Citing Sucaldito's March 17 Facebook post, the Kapamilya singer elaborated, "This time, he explicitly mentioned my name and alluded that I was the person in the blind items he has been posting...

"Not only was my name mentioned explicitly by Respondent, he was clearly out to destroy the reputation that I have carefully built in the industry.

"The fact that he mentioned 'Mga nauto ni Erika' showcases the malicious attack made against me."

Santos added that Sucaldito "undoubtedly" identified him in a separate Facebook post on that same day. 

Santos narrated, "This time, he undoubtedly affirmed that I was the person he mentioned in his previous blind items. 

"The post mentioned that he asked permission to repost a certain statement from an artist, who conveyed an experience told to him by his sister, during an event in San Francisco."

Based on the screenshot of Sucaldito's March 17 Facebook post, his own caption alluded to a showbiz personality named "Erik" at least twice.

This was followed by Sucaldito's March 18 Facebook post wherein he made loaded remarks about the Kapamilya singer.

The dzMM radio host described Santos as "maganda nga ang boses pero boring lang pakinggandan dahil sobrang linis at lamya (opinyon ko it ha) at chaka ang character."


SUCALDITO IDENTIFIES ERIK, ERICKSON. Santos was also able to produce screenshots of Sucaldito's March 21 Facebook posts.

Naming names this time, Jobert Sucaldito accused Erik Santos and his manager Erickson Raymundo as "walang utang na loob."

Santos also said in his sworn affidavit that Sucaldito "threatened" to expose "libelous information" against him and Raymundo.

This seemed to in be relation to Sucaldito's separate Facebook rants about an unnamed celebrity and a talent manager who were allegedly power-tripping him.

A furious Sucaldito revealed that he was reprimanded by his bosses after the unnamed celebrity and talent manager raised complaint against him.

SANTOS SEEKS P12-M WORTH OF DAMAGES. Santos said that he wants to seek justice for the "mental anguish, serious anxiety, sleepless nights, besmirched reputation, wounded feelings and social humiliation" that Sucaldito caused him.

Citing Sucaldito's "defamatory" Facebook posts, Santos stood by his libel complaint against Sucaldito.

Santos said in his sworn affidavit: "The words and phrases that he used are calculated to induce the readers of his Facebook page to suppose and understand that I am gay and that I engage in sexual relationships with people of the same gender.

"The same are indisputably defamatory for they impute upon me a condition which is sufficient to impeach or reputation as bankable artist and to hold me up to public ridicule.

"Attacking my sexuality is a clear insult and harmful to my person and career. He also repeatedly attacked my character, labelling me a traitor and one who mooches on other people."

According to Santos's affidavit, he is also seeking P10 million for moral damages and P2 million for exemplary damages from Sucaldito.

At press time, Sucaldito's social media posts in question can no longer be seen on his Facebook page.


However, Santos's legal counsel Atty. Josabeth "Joji" Alonso maintained that deleting defamatory Facebook posts "after damage has been inflicted, as if nothing has happened" is no excuse.

She added, "The vicious cycle of mercilessly maligning the reputation, sexuality, character, and integrity of another using social media posts, has got to stop...

"We trust that justice will be served."
