Hindi umubra ang kagustuhan ng dating pamunuan ni Liza Diño na maging regulatory body ang Film Development Council of the Philippines (FDCP).
Tinuligsa ni Vicente “Tito” Sotto, na noong panahong iyon ay Senate President, ang paggalaw ni Liza sa original Implementing Rules and Regulations (IRR) ng FDCP noong May 2020.
Si Tito ang principal author at sponsor ng R.A. 9167, ang batas na bumuo sa FDCP noong June 7, 2002.
Si Liza ay itinalagang FDCP chair noong August 12, 2016, sa administrasyon ng noo'y Pangulong Rodrigo Duterte.
Tatlong taon ang mandatong termino ni Liza, ngunit extended iyon mula 2019 hanggang July 2022.
Noong November 19, 2020 ay naiulat sa official site ng Senado ang pagtuligsa ni Sotto sa "specific provisions" sa Revised IRR ng FDCP.
"Inconsistent" at hindi na raw saklaw ng batas ang mga gustong ipatupad ng film council.
"The Council cannot be superior to Congress," diin ni Sotto noon.
Hindi raw maintindihan ni Sotto kung bakit ni-revise ng pamunuan ni Liza ang original IRR ng FDCP na 18 taon nang ipinatutupad.
Ayon pa rin sa ulat sa official website ng Senate, sinuspinde ng Senado ang "budget" ng FDCP dahil sa isyu.
May side story ang reaksiyon ni Sotto sa Revised IRR ni Liza.
Kuwento ng First and Second Sources sa Philippine Entertainment Portal (PEP.ph), kinompronta ni Sotto si Liza tungkol sa pag-amyenda nito sa original IRR ng FDCP.
"Nagwala si Tito," sabi ng First Source, "Tito went crazy over a Zoom meeting with her for doing that — and she closed her camera and cried."
Tanong ng PEP.ph: Ano ang takbo ng usapan?
Sagot ng First Source tungkol sa sinabi ng senador: “Ba’t mo in-amend yung IRR? Ang gumawa [ng revisions] ay hindi government office.”
Nangatuwiran umano si Liza na ang FDCP ay “agency” ng gobyerno kaya maaari itong mag-amyenda ng mga polisiya ng FDCP.
Dito nilinaw ng senador kay Liza na ang FDCP ay hindi “agency” kundi isang “council" kaya hindi maaaring maging valid ang revisions ni Liza sa IRR.
LIZA DIÑO’S CONFLICT WITH STAKEHOLDERS
Sa pagsusuri ng PEP.ph sa Revised IRR, kapansing-pansing walang pumirma ritong Council representatives ng theater owners, producers, at academe.
Hindi malinaw kung nasangguni ang stakeholders bago inaprubahan ng limang Council members ang Revised IRR.
Pero noong panahong inaprubahan ng limang members ng FDCP Council ang Revised IRR, makailang-beses nang nakabangga ng FDCP ang mga stakeholders na ito.
Tinutulan ng mga theater owners, producers, at filmmakers ang mahigpit na mga polisiyang gustong ipatupad ng FDCP sa pamumuno ni Liza.
Kabilang dito ang theaters owners na nasa Cinema Exhibitors Association of the Philippines (CEAP), ang producers na nasa Philippine Motion Pictures Producers Association (PMPPA), at filmworkers na nasa Inter-Guild Alliance (IGA).
Paliwanag ng Second Source ng PEP.ph: "It was during the pandemic that a lot of things happened sa movie industry.
"Particularly, nag-away-away ang Inter-Guild Alliance with her. Ang PMPPA nakipag-away na rin sa kanya.
"The sentiment was, instead of helping the film industry, she was making it more difficult by adding red tape — and then she was slowly expanding her powers as well."
Dati nang nailathala sa PEP.ph ang ilan sa mga isyu ng industry stakeholders na hindi gusto ang pamamalakad ni Liza.
THE CONTROVERSIAL FDCP RULES AT THE START OF THE PANDEMIC
Sumunod na nakalaban ng FDCP ang grupo ng producers at filmworkers sa unang bugso ng COVID-19 pandemic noong May 2020.
Nang mga panahong iyon, ipinatupad ng gobyerno ang enhanced-community-quarantine (ECQ) protocols, kunsaan ipinagbawal ang crowd gathering upang iwasan ang pagkalat ng virus.
Lubhang apektado ang entertainment industry dahil ipinagbawal ang shootings, tapings, live events, at iba pang trabaho na kinakailangan ng maraming tao.
Sabi ng First, Second, at Third Sources sa PEP.ph, dinagdagan lang ng FDCP ang pasakit sa filmworkers.
Noong May 16, 2020, naglabas ang FDCP ng post-ECQ protocols na dapat sundin ng filmworkers sa oras na payagan ng gobyerno ang entertainment industry na magbalik-trabaho.
May titulo itong "Interim Guidelines on Safety Protocols For The Conduct of Film and Audio-Visual Production Shoots to Mitigate COVID-19."
Pagsapit ng June 7, 2020, naglabas uli ang FDCP ng joint administrative order (JAO) na kabahagi ang Department of Health (DOH) at Department of Labor and Employment (DOLE).
May titulo itong "Health and Safety Protocol for the Conduct of Film and Audio-Visual Production Shoots and AudioVisual Activities During COVID-19 Pandemic."
Iregular daw ang pakikialam ng FDCP sa stakeholders at film workers noon.
EXPANDING THE TERRITORY OF FDCP
Sabi ng sources, sinaklawan ng FDCP hindi lang ang film industry kundi buong audio-visual industry. Ibig sabihin, kasama ang TV, digital, at iba pang media platform.
Sinabi sa JAO ng FDCP na kinakailangang dumaan sa FDCP ang production shoots ng film, TV, corporate AVP, animation, live events, at audio-visual content sa online platform.
May registration form kung saan ilalagay ang contact details ng production company, complete cast and crew, date of shooting, location, call time, at wrap-up time ng proyekto.
Nakalagay pa sa rules ng FDCP na may ipapataw na "administrative fines" at may karampatang "legal action" sa mga hindi magko-comply sa post-ECQ guidelines.
Ayon pa rin sa sources ng PEP.ph, may kanya-kanyang safety protocols na ipinatutupad ang private sectors na lubhang apektado sa quarantine protocols noong pandemya.
Lalo lamang daw pinapahirap ng "bureaucratic" requirements ng FDCP ang sitwasyon ng audio-visual workers noon.
THE STAKEHOLDERS THAT OPPOSED FDCP
Inalmahan ito ng industry stakeholders, kabilang ang PMPPA at Inter Guild Alliance (IGA).

Sa imbestigasyon ng PEP.ph, kuwento ng Second Source: “Nagwala ang mga producer. Lalo na nang umabot sa punto, bago ka makapag-shooting, dumaan muna sa FDCP.
"E, ang hirap nun. Instead of going directly to the entities that will help you with your shoot, you have to go through another step."
Ang PMPPA ay kinabibilangan ng 22 film producers. Binubuo ito ng Star Cinema Production, Regal Entertainment Inc., Viva Communication Inc., Quantum Films Inc., Reality Films, at The IdeaFirst Company.
Kabilang din ang MZET, OctoArts Films, GMA Films, APT Entertainment Inc., ALV Films Inc., Cineko Productions Inc., at Globe Studios Inc.
Kasama pa ang Spring Films Inc., TBA Studios, TREX Entertainment Prods Inc., Slick Pictures, Megavision Integrated Res. Inc., at Ten17P.
Kabilang din sa PMPPA ang Seiko Films, Imus Productions, at Crown Seven.
Ang Inter Guild Alliance naman ay binubuo ng iba-ibang grupo mula sa sektor ng film, television, at advertisting industries. Bahagi ng IGA ang Directors Guild of the Philippines.

ON LIZA WANTING TO "ASSERT HER POWER"
Sabi naman ng First Source na kausap ng PEP.ph, siya man na isa raw stakeholder ay "very cooperative" sa mga programang sinimulan ni Liza sa FDCP.
Pero kalaunan, na-turn off daw siya sa "overreach" ni Liza.
Kuwento ng First Source sa PEP.ph: "I thought she was doing a good job. But, there was a kind of shift.
"All of a sudden, there is this need to assert her power, not only with the film industry but with the entire audio-visual industry, which is not within the mandate of the FDCP.
"Why is this so? If you read the mandate, the FDCP is created for the cinema evaluation which was later aborted by the Supreme Court as unconstitutional."
Simula noong December 10, 2019 ay natigil ang pag-remit ng local government units (LGUs) ng amusement tax sa FDCP.
Ito ay matapos magdesisyon ang Supreme Court na "unconstitutional" ang Cinema Evaluation Board (CEB) ng FDCP.
Ang Cinema Evaluation Board ay dating sangay ng FDCP na layuning magbigay ng Grade A o Grade B para sa mga dekalidad na pelikulang pinoprodyus ng mga producer/filmmaker.
Ang Graded A ay binibigyan ng 100% amusement tax na nakolekta mula sa pelikula, habang ang Graded B ay binibigyan ng 65% amusement tax. Ang natirang 35% ay idinadagdag sa pondo ng FDCP.
Ano ang ipinalit sa CEB nang matanggal ito sa FDCP?
Saad ng First Source sa PEP.ph, "With the absence of the Cinema Evaluation Board, the FDCP began to assume other duties and responsibilities which are felt at the start were good with the industry."
THE BOLD MOVES OF FDCP UNDER LIZA'S LEADERSHIP
By January 2020, ang isa sa solusyon ng FDCP ay palakasin ang film incentive programs tulad ng Film Location Incentive Program (FLIP), International Co-Production Fund (ICOF), at ASEAN Co-Production Fund (ACOF).
Pagsapit ng mga sumunod na buwan, doon na raw nagsimula ang kagustuhan ng FDCP na saklawan ang audio-visual industry.
Patuloy na kuwento ng second source: "But when the pandemic occurred, suddenly the FDCP wanted to cover television, commercials, and live events which are the concerts.
"FDCP wanted to be an agency, which it is not. It is a council which is different from being an agency...
"Nakaka-disappoint. I used to work a lot with her."
Hindi sinunod ng audio-visual workers ang post-ECQ guidelines ng FDCP na inisyu noong 2020.
Dagdag ng First Source: “Ang hindi niya kinaya, yung advertising kasi may sariling daigdig ang advertising. Binalewala siya."
Base sa ulat ng PEP.ph noong July 31, 2020, ipinasususpinde ni Senator Tito Sotto kay Liza ang pagpapatupad ng Joint Administrative Order (JAO) ng FDCP, DOLE, at DOH noon.
Ani Sotto, walang "legal authority" ang FDCP para pilitin ang movie at audio-visual industry na sundin ang post-ECQ guidelines nito dahil hindi ito regulatory body.
Ang primary purpose raw kaya itinayo ang FDCP ay para i-promote ang "development and growth" ng local film industry.

THE VERY FIRST FDCP MEMO
Ang pinakaunang pagkilos ng FDCP para sakupin ang audio-visual industry ay nangyari bago pa opisyal na inanunsiyo ang COVID-19 pandemic sa Pilipinas.
Inisyu ng FDCP ang "Joint Memorandum Circular 1," kabahagi ang DOLE at DOH, noong February 28, 2020.
May titulo itong "Guidelines Governing The Working Conditions And Occupational Safety and Health of Workers In The Audio-Visual Production."
Layunin nitong i-regulate ang "working conditions" at "occupational hazards" sa audio-visual film industry.
"Kasi, ginagamit niya paulit-ulit yung Eddie Garcia incident. We all agree that should never happen," saad ng Second Source sa PEP.ph.
Dugtong niya, "And I'm all for that in terms of safety measures and everything. Pero ginamit niya ang incident na yun para i-expand ang power ng FDCP."
Ang tinukoy ng source na "Eddie Garcia incident" ay ang nangyaring aksidente sa set ng isang GMA-7 teleserye, ang Rosang Agimat, noong June 8, 2019.
Napatid si Eddie Garcia sa cable wire ng production sa isang eksena kung saan tumatakbo ang beteranong aktor.
Tumumba si Eddie at may nabali sa bandang leeg nito, na nagresulta sa pagpanaw ng legendary actor noong June 20, 2019.

Naging malaking isyu iyon sa entertainment industry, at lumikha ng panawagang magsagawa ng panuntunan para maproteksyunan ang filmworkers.
Sa kasalukuyan, may mga nakabinbin pang panukala sa Kongreso at Senado, na tinawag na Eddie Garcia Act, na layuning isulong ang mga karapatan ng filmworkers.
ON LIZA INVOLVING DOLE IN IMPLEMENTING FDCP RULES
Mula sa Memo Circular 1, pag-amyenda ng IRR, hanggang sa post-ECQ protocols at JAO na inisyu ng FDCP, makikita raw ang anila'y problema sa sistema ng pamamalakad ni Liza.
"She knew her every move," sabi pa ng Second Source sa PEP.ph. "Kasi, even the fact na alam niyang walang [regulatory] power ang FDCP, nakipag-tandem siya sa DOLE, at DOLE ang pina-issue niya ng memorandum circular para may ipin."
Konklusyon nito, "So, she was really manipulating everything."
Hindi raw DOLE ang tamang ahensiya na may mandatong bumuo ng guidelines para sa working conditions ng audio-visual workers.
Dagdag ng source, mas tamang pagmulan ng guidelines ang Department of Trade and Industry (DTI) o National Film Commission.
Ang DTI ang government agency na itinalagang tagapangasiwa sa FDCP, alinsunod sa Executive Order No. 161 mula sa Malacañang noong January 27, 2022.
Ang Department of Education (DepEd) ang dating oversight agency ng FDCP mula 2009 hanggang January 2022.
ON "ALIENATING" THE STAKEHOLDERS IN FILM INDUSTRY
Hindi raw puwedeng basta na lang magpatupad ang FDCP ng gusto nitong rules sa film industry.
Nangangailangan daw iyon ng masusing dialogue sa pagitan ng stakeholders.
Komento ng Source 3: "Tsaka ang mahirap naman, may naka-set nang rules, di ba? Dahil sa ginawa niyang IRR, pinasikip niya yung rules.
"Pinadagdag pa niya sa mga producers. E, bigat na bigat na nga, e. Overtaxed, overbudget ang mga producers. And then, sasakalin mo pa iyong leeway nila sa work. Ba't pa ako magpo-produce?"
Sabi naman ng isang source, "I would like to think of her positively in this. In her enthusiasm to implement so many things, she has somewhat alienated, even isolated herself, from the major stakeholders."
Umabot sa puntong ayaw na raw makipagtrabaho ng producers, theater owners, at ibang filmworkers sa FDCP dahil kay Liza.
Sa dami ng proyektong nais pasimulan ng pamunuan ni Liza, sa huli ay lumampas na siya sa saklaw ng mandato nito.
Nagpadala ang PEP.ph ng mensahe kay Liza upang kunin ang kanyang panig ukol sa mga isyu ng FDCP.
