Ni-renew ng Intellectual Property Office of The Philippines (IPOPHIL) ang Eat Bulaga! trademark na pagmamay-ari ng Television and Production Exponents Inc. (TAPE Inc.).
Kinumpirma ni Atty. Maggie Abraham-Garduque, legal counsel ng TAPE, na natanggap ng TAPE ang Certificate of Renewal of Registration para sa Eat Bulaga! trademark.
Ang TAPE ay pagmamay-ari nina Romeo Jalosjos Sr. at Antonio Tuviera. Ang aktibong namamalakad sa kumpanya ay ang mga anak ni Jalosjos na sina Jon, Bullet, at Soraya.
Ito ay sa kabila ng inihaing petisyon nina Tito Sotto, Vic Sotto, at Joey de Leon na kanselahin ang trademark registration ng TAPE para hindi magamit ang pamagat ng kontrobersyal na noontime show.
Nitong Sabado, Agosto 5, 2023, sinabi ni Garduque sa mensahe na ipinadala nito sa Philippine Entertainment Portal (PEP.ph) na ang TAPE ang mananatiling may-ari ng pamagat at logo ng Eat Bulaga! hanggang 2033.
Sampung taon ang itinatagal ng isang trademark registration.
"Marami kasi ang nagsasabi na since nag-expire ang registration ng TAPE Inc. sa Eat Bulaga! trademark, free for all na ito. This is not true," ang giit ni Garduque.
Ipinadala niya sa PEP.ph ang kopya ng Certificate of Renewal of Registration mula sa IPO bilang matibay na patunay ng kanyang pahayag.
Makikita rito na nakarehistro sa IPOPHIL ang Eat Bulaga! trademark classes 16, 18, 21, and 25 o para sa goods o merchandise items.
Si Director Jesus Antonio Ros ng Bureau of Trademarks ang nakalagda sa Certificate of Renewal of Registration na may Registration Number na 4/2011/00005951, na ni-renew noong June 14, 2023 at may bisa hanggang June 14, 2033.
Paliwanag pa ni Garduque: "TAPE Inc. renewed its registration and we are happy na na-issue na ang Certificate of Renewal which makes TAPE Inc. the continuous owner of the name Eat Bulaga! and EB and its logos until 2033.
"Importante ito kasi kumbaga sa lupa, ang Certificate of Registration and in this case, the Certificate of Renewal of TAPE Inc., ay ang titulo to prove its ownership over the trademark Eat Bulaga!"
Hindi kasali sa nasabing Certificate of Registration ang Eat Bulaga! trademark class 41 o entertainment services na in-apply-an ng TVJ pati na rin ng TAPE.
ONGOING LEGAL BATTLE BETWEEN TAPE AND TVJ
Nakasampa sa Branch 273 ng Regional Trial Court ng Marikina City ang Application for the Issuance of Writ of Injuction on the Copyright Infringement and Unfair Competition na inihain nina Tito, Vic, Joey at ni E.A.T. Creative Director Jeny Ferre laban sa TAPE Inc.
Inaasahang tatagal hanggang sa susunod na buwan, September 2023, ang pagdinig sa nasabing usapin.
