Trigger warning: rape, abuse
Tinawag nina Jojo Nones at Dode Cruz na "baseless, malicious, at frivolous" ang reklamong rape na isinampa ni Sandro Muhlach laban sa kanila.
Ang alegasyong panghahalay kay Sandro ay naganap umano noong madaling-araw ng July 21, 2024 sa isang hotel sa Pasay City.
Nakatanggap ang PEP.ph (Philippine Entertainment Portal) ng kopya ng joint sworn affidavit nina Jojo at Dode na isinumite sa DOJ noong September 12, 2024.
"There is NO evidence to indict us for rape through sexual assault," diin nina Jojo at Dode.
Wala rin daw ebidensiya para makasuhan sila ng acts of lasciviousness.
Detalyado nilang ipinaliwanag ito sa kanilang sinumpaang salaysay.

JOJO NONES AND DODE CRUZ: "NO RAPE"
Ipinunto nina Jojo at Dode na dalawa sa tatlong elemento para sa rape through sexual assault ay "absent" sa reklamo ni Sandro.
Ayon sa Article 266-A paragraph 2 ng Revised Penal Code, ang first element ay ang mismong akto ng sexual assault.
Ang second element ay pagpasok ng ari o anumang instrumento o bagay sa genital area.
Ang third element ay ang paggamit ng puwersa o pagbabanta sa biktima.
Idiniin nina Jojo at Dode na walang ebidensiyang magsasabing may nangyaring penetration, gamit ang ari o anumang bagay o instrumento, sa ari o sa bibig ng complainant.
Reklamo raw ni Sandro, rape ang aktong "licking of butthole." Dinanas umano niya ito mula sa respondents.
Katuwiran ng respondents, hindi iyon maituturing na rape dahil walang naganap na penetration.
Saad sa salaysay nina Jojo at Dode (published as is and itals provided): "Under the law, the object/instrument must be INSERTED into the butt or anal orifice. It should not just be on the butt or anal orifice."
Patunay raw nito ay ang mismong medico legal na isinumite ni Sandro bilang bahagi ng kanyang sworn affidavit sa DOJ.
Ipinunto ng respondents na walang nakitang "evident injury/lesion" sa "ano-genital examination" na isinagawa kay Sandro sa medico legal.
July 27—o anim na araw matapos ang alleged rape incident—ang petsa nang sumailalim si Sandro sa medico legal base sa kumalat na dokumento sa social media.
Pahayag naman nina Jojo at Dode sa kanilang sinumpaang salaysay (published as is, itals provided): "That based on the foregoing documentary evidence of the Complainant, no injury was seen at the anus which is the part of the body material in rape through sexual assault.
"Hence, the own testimonial and documentary evidence of the Complainant FATALLY failed to prove the second element of rape through sexual assault."
Hindi rin daw masasabing ginamitan ng respondents ng puwersa, pagbabanta o pananakot si Sandro.
Kahit sa sinumpaang salaysay ni Sandro ay wala raw itong sinabing gumamit ng sandata o di kaya ay tinakot ng respondents si Sandro para maabuso ito.
"That there is nothing in the testimonial evidence of the Complainant which states of the employment of force by any of us that would be 'sufficient' to consummate the crime of rape.
"It has to be underscored that Complainant is a man of legal age, tall (more or less 6-footer) and with large built.
"Therefore, the force to be employed by us; Richard who was described by the Complainant himself as very drunk when he entered the room and Jojo who is short, small built gay; would never be sufficient to restrain the Complainant to do something against his will;
"Most importantly, the documentary evidence of the complainant which is the medico-legal report does not also support the allegation of any use of force."

JOJO NONES AND DODE CRUZ: "NO EVIDENCE FOR ACTS OF LASCIVIOUSNESS"
Nanindigan din sina Jojo at Dode na walang nangyaring acts of lasciviousness sa pagitan nila ni Sandro.
Ayon sa Article 336 ng Revised Penal Code, ang akto ng kalaswaan ay may tatlong elemento.
Unang elemento ay iyong mismong akto ng karahasan.
Ikawalang elemento ay kung ginamitan ng dahas, pagbabanta o pananakot; grave abuse of authority; o kung 12 taong gulang pababa ang biktima.
Ikatlong elemento ay ginawan ng karahasan ang isang tao, mapalalaki man o babae.
"Albeit, in his testimonial evidence, Complainant in his Sinumpaang Salaysay alleged of lewd acts like sucking of nipples, touching of penis, licking of balls, sucking of penis and licking of butt hole, Complainant failed to show through evidence at hand that these acts were attended by any of the circumstances mentioned in the second element of the offense;
"Since crimes are defined by its elements, thus the absence of just one (1) element will not make the crime committed and there is NO reasonable certainty to convict us for the crime of acts of lascivious."

on SANDRO'S ALLEGATION THAT HE WAS "DRUGGED"
Isa pang inalmahan nina Jojo at Dode ay ang alegasyong wala sa tamang huwisyo si Sandro dahil siya ay drinoga at nilasing diumano ng respondents.
Hindi raw nila drinoga si Sandro.
Iginiit ng respondents na negatibo sa dangerous drugs ang resulta ng isinumiteng toxicology report kakabit ng sworn affidavit ni Sandro sa DOJ.
"For better reference, we opted to reproduce said toxicology reports of the Complainant taken from his complaint-affidavit and re-attach it herein as our ANNEXES “2” and “2-A”, being an integral part of our Joint Counter-Affidavit."
Kinuwestiyon nina Jojo at Dode ang salaysay ni Sandro na pinasinghot daw ang aktor ng "white substance" na sinasabing ilegal na droga.
Sinasabi raw ni Sandro na sa unang singhot pa lang ay nahilo at halos mawalan ito ng malay.
Kung iyon daw ang nangyari, paano raw ito nakapunta mula sa dulo ng kama malapit sa pinto ng kuwarto papunta sa bintana para suminghot ng tatlo hanggang apat na beses at saka pinainom ng wine.
"Complainant needed to walk from the bed near the door going to the table near the window to have access to said substance," saad sa salaysay nina Jojo at Dode.
Wala rin daw sa salaysay ni Sandro na pinilit ito nina Jojo at Dode na suminghot ng white substance.
Inconsistent umano ang testimoniya ni Sandro dahil sa Senate hearing ay sinabi nitong pinainom muna siya ng alak bago pinasinghot ng ilegal na droga.
Hindi rin daw masasabing wala sa ulirat si Sandro.
Ipinunto nina Jojo at Dode na nakausap pa si Sandro ng nobyang si Shanelle Agustin habang si Sandro ay nasa hotel room ng respondents.
Nakasaad daw iyon sa mismong sworn affidavit ni Sandro.
Pero base na rin daw sa salaysay ni Sandro, sinagot ni Sandro ang audio call ni Shanelle via Instagram.
Nagkausap pa raw sina Sandro at Shanelle sa loob ng 25 seconds via Instagram audio call.
"This proves that Complainant has indeed control of his phone;
"Thus, if the Complainant was really as drunk and drugged that he was almost passed out as he was claiming, then how could he have answered the call of his girlfriend which even lasted for 25 seconds?"
Binanggit din nina Jojo at Dode ang sinabi ni Sandro sa sworn affidavit nito na nakapagpadala pa ito ng text message kay Shanelle na nagsasabing "Yes love pabalik na ko."
Nakapagpadala rin daw ng text messages si Sandro sa kaibigang si Elijah Alejo.
"Curiously, if something bad was about to happen or was happening to the Complainant at that time, why did he not tell this to Elijah and his girlfriend so he could ask help considering that he could send messages to both of them?
"In fact, he was able to talk to Shanelle at 5:41am via Instagram audio. That would be the best opportunity under natural course of things to ask for help."

WHAT WAS SEEN ON CCTV FOOTAGE
Nagbigay rin ng pahayag sina Jojo at Dode patungkol sa naiulat na CCTV footage kay Sandro nang pumasok at lumabas ito ng hotel room nina Jojo at Dode noong madaling-araw ng July 21.
Sinasabi raw ni Sandro na naganap ang insidente ng pang-aabuso mula 4:48 a.m. hanggang 5:22 a.m.
Ayon daw kay Sandro, tumigil lamang ang respondents sa panghahalay sa kanya nang mag-deliver ng bottle of wine ang service attendant bandang 5:22 a.m.
Ipinunto nina Jojo at Dode na base sa CCTV footage ay lumabas ng kuwarto si Sandro bandang 6:46 a.m. o "one (1) hour and twenty-four (24) minutes" matapos mag-deliver ng wine ang service attendant sa kanilang hotel room.
"That no one can believe as well that the service attendant went inside the room at 5:22AM and stayed there at 30 seconds and the Complainant did not even ask help from him.
"In fact, based on the CCTV footages Capturing the Activities of Sandro, the attendant went back at 5:31AM, carrying a bill booklet, and still Complainant did not ask help from him if indeed he was sexually assaulted."
Dagdag ng respondents, "Complainant alleged that he was heavily drugged and intoxicated. In fact, he said he could not move and fight back because of the dizziness he felt, however, when the service attendant arrived, he was able to get up and dressed up by himself.
"In fact, CCTV footages when he went out of the room shows that he did not look erratic and messy. His hair was nicely combed, he was neatly and properly clothed and he walked straight eradicating any sign of dizziness/weakness."
Kung susumahin daw ang salaysay ni Sandro, sinabi nina Jojo at Dode na kamangha-mangha at hindi raw kapani-paniwala ang mga paratang sa kanila.
Hiling nila ay ibasura agad ng DOJ ang reklamo ni Sandro.
Kaugnay nito, inihayag nina Jojo at Dode ang payo ng kanilang abogado na hindi lang basta "probable cause" kundi "reasonable certainty of conviction" ang pamantayan ng piskalya bago magrekomenda ng kaso laban sa isang respondent.
Saad pa nina Jojo at Dode: "In the end, we will not risk our almost thirty (30) years of good reputation in the show business industry for the acts complained of.
"We have worked with several artists already and over the years there is no one who filed any complaint against us, sexually related or otherwise;
"We plead to this Honorable Office to resolve this case based on merits, otherwise this will serve as a precedent to all fame-thirsty artists who can just concoct a story for publicity at the expense of any production staff who tediously work just to earn his standing in the industry."
