Supreme Court orders immediate return of PHP60B to PhilHealth

Supreme Court stresses its decision is “immediately executory."

Ipinag-utos ng Korte Suprema ang pagsasauli ng bilyun-bilyong pisong pondo ng PhilHealth na inilipat sa National Treasury.

Ayon sa Supreme Court magistrates, “void” o unconstitutional ang naging basehan ng gobyerno sa ginawang paglipat ng PHP60-B funds ng PhilHealth sa National Treasury.

Pag-aaralan daw ng gobyerno ang utos ng Supreme Court, pero nagpahayag ito ng kahandaang sundin ang desisyon.

Ang desisyon ng Mataas na Hukuman ay ipinost din nila sa Facebook page nito.

Noong 2024, pinare-remit sa National Treasury ang tinatayang PHP90 billion extra fund ng PhilHealth na hindi umano ginagamit ng ahensiya, ulat ng GMA Integrated News.

Una nang nailipat sa National Treasury ang PHP60 billion. Naiwan ang PHP30 billion balance dahil nag-isyu ang SC ng temporary restraining order nang kuwestiyunin nila ang remittance ng PHP60B sa government treasury.

Sa SC decision en banc, idineklara nilang walang bisa ang Special Provision 1(d), Chapter XLIII ng 2024 General Appropriations Act (2024 GAA), at ang Circular No. 003-2024 ng Department of Finance (DOF) na siyang naging basehan ng gobyenro para mailipat ng PhilHealth funds sa National Treasury.

Sabi ng Korte Suprema, nakitaan nila ng “grave abuse of discretion amounting to lack or excess of jurisdiction” ang pagpapatupad dito.

“The SC also ruled that Special Provision 1(d) is void because it impliedly repeals Section 11 of the Universal Health Care Act (UHCA) and the Sin Tax Laws,” saad pa ng Korte Suprema sa pahayag nito.

Bukod sa pagbabalik sa PHP60B sa PhilHealth, ipinagbawal din ng SC ang paglipat sa natitirang PHP30B ng PhilHealth.

Giit ng SC, “immediately executory” ang kanilang desisyon.

Tumanggi naman ang Korte sa hiling ng petitioners na matukoy ang pananagutan ni dating DOF secretary at ngayon ay Executive Secretary Ralph Recto para sa reklamong technical malversation o plunder.

“The Supreme Court said that this was not the proper proceeding to determine the criminal liability of the secretary of Finance,” sabi sa pahayag ni Atty. Camille Ting, SC spokesperson.

Sa pahayag naman ni Presidential Communications Office Secretary Dave Gomez, sinabi nitong iginagalang nila ang desisyon ng Mataas na Hukuman.

Ire-review raw ng Office of the Solicitor General ang ruling at magdedesisyon para sa susunod nilang hakbang, kabilang ang pagsusumite nila ng motion for reconsideration.

Ang mga taong nasa likod ng petisyong maibalik ang bilyun-bilyong pisong pondo sa PhilHealth ay pinangunahan nina former Justice Antonio Carpio, former Ombudsman Conchita Carpio-Morales, Economics Professor Cielo Magno, former State Auditor Heidi Mendoza, at ang civic coalition na 1Sambayan.
