Ito ang desisyon ng Quezon City Office of the City Prosecutor sa reklamong cyber libel ni Mary Liza Diño laban sa tatlong PEP.ph (Philippine Entertainment Portal) editors.

Ito ay sina PEP Editor-In-Chief Jo-Ann Q. Maglipon, PEP Associate Editor Erwin Santiago, at PEP Deputy Managing Editor Rachelle Siazon.

Dismissed din ang reklamo ni Diño laban sa aktor na si Tirso Cruz III, direktor na si Jose "Joey" Javier Reyes, at Atty. Josabeth "Joji" Alonso ng Alonso and Associates Law Offices.

Apat na consolidated complaints para sa 78 counts of cyber libel ang isinampa ni Diño laban sa anim na respondents.

Kaugnay ito ng Nine-Part Investigative Report ng PEP sa mga iregularidad diumano sa panahon ng panunungkulan ni Diño bilang chairperson ng Film Development Council of the Philippines (FDCP).

Si Diño ay naging FDCP chairperson mula Agosto 2016-Hulyo 2022, sa panahon ni Presidente Rodrigo Duterte.

Si Tirso Cruz III ang pumalit sa kanyang FDCP chairperson mula Hulyo 2022 hanggang sa magbitiw ito sa puwesto noong Marso 2024, sa panahon ni Presidente Ferdinand Marcos Jr.

Si Joey Reyes ay technical consultant to the FDCP chair sa termino ni Cruz. Ang director-writer ang pumalit kay Cruz noong Abril 2024, at siya pa rin ang FDCP chairperson sa kasalukuyan.

Si Atty. Joji Alonso ay founder at CEO ng Quantum Film Productions, isang kumpanyang nagproprodyus ng mga pelikula at TV shows. Siya rin ang founder at managing partner ng Alonso and Associates Law Offices, at kilalang lawyer to the stars.

Nakakuha ang PEP ng kopya ng resolusyon ng Quezon City Office of the City Prosecutor noong March 16, 2026.

FISCAL resolves: NO MALICE IN PEP'S FDCP REPORT

Ayon sa Resolusyon: "As the subject of the published online articles is a matter of public interest, the media has the right to report the subject matter as legitimate news.

"The legitimate media has a right to publish such matter under the constitutional guarantee of freedom of the press.

"Respondents Jo-Ann, Erwin, and Rachelle, as entertainment writers and publishers, merely acted on information they received from their source/s about the alleged irregularities governing the tenure of complainant Liza, a public figure, as FDCP Chairperson."

Sabi pa ng Quezon City Office of the City Prosecutor (QC OCP), hindi nakitaan ng "presumption of malice" ang investigative report ng PEP kay Liza Diño.

Ayon pa rin sa Resolusyon: Ang PEP report sa FDCP ay may kinalaman sa "conduct" ni Diño bilang "public official" nang panahong ito ay FDCP chair.

Dapat daw patunayan ni Diño na may "actual malice" ang inilathala ng PEP.

Dapat maipakita nitong inilathala ang impormasyon kahit alam ng PEP editors na ang impormasyon ay mali o kaya nama'y may reckless disregard sa correctness ng information.

Masasabi raw na merong "reckless disregard" kapag ang author o publisher ay may "serious doubt" sa katotohanan ng ulat o kaya'y may "high degree of awareness" ito na mali ang impormasyon.

Niresolba ng Office of the City Prosecutor na bigo si Diño na mapakitang may "reckless disregard" ang editors.

Ayon uli sa Resolusyon: "Complainant Liza submitted no evidence that the respondents wrote and published the online articles to deliberately destroy her reputation."

Iniulat lamang daw ng PEP ang impormasyong naberipika ng mga ito sa "reliable sources" at pinaniwalaan nilang totoo.

"Likewise, there was no evidence that respondents entertained awareness of the probable falsity of their information."

Hindi rin daw napatunayan ni Diño na naglagay ang PEP editors ng sariling "comments, opinions, and conclusions" sa kanilang FDCP report.

Ayon sa Resolusyon: Bagama't hindi daw tinukoy ng PEP sa FDCP report ang sources nito, binanggit ng piskal ang nauna nang court ruling sa ibang kaso, na acceptable sa batas ang "lone source" kahit na "one side of the story" lamang ito, basta mapatunayan ng reporter na ang iniuulat nito ay hindi maling impormasyon.

Ayon pa sa Resolusyon: "Immaterial" ang claim ni Diño na, dahil hindi na siya public official nang ilathala ang PEP report, patunay ito ng malisya ng PEP.

Dahil daw ang mahalaga ay may "public interest" sa isinulat na report ng PEP at maituturing na "privileged communication."

Ayon sa Resolusyon: "If at all, the respondents were motivated to write and publish the online articles not by malice but by their duties as investigative reporters.

"On that pretext, the statements in the published online articles partook of the nature of commentaries on matters of public interest, thus privileged."

Ipinaliwanag din ng piskal na sinuri nito ang mga affidavit ng witnesses sa kampo ni Diño na nakabasa ng published FDCP report sa PEP.

Wala raw sinabi ang mga itong naapektuhan ang kanilang pagtingin kay Liza nang mabasa ang PEP report.

Kaya bigo raw si Diño mapatunayan ang inireklamo nitong "defamation."

Quezon City Office of the City Prosecutor: "Finally, this Office posits that as journalists, respondents Jo-Ann, Erwin, and Rachelle have the privilege to communicate to the public matters of public concern.

"Without proof of actual malice, this Office cannot charge them with Cyber Libel."

Dahil hindi napatunayang dapat kasuhan ng cyber libel ang PEP editors, hindi na raw kailangang pag-usapan pa ang "alleged criminal liabilities" ng iba pang respondents.

LIZA DIÑO'S CYBER LIBEL ALLEGATION

Sa resolusyon ng Quezon City (QC) Office of the City Prosecutor (OCP), isinuma ang "facts" ayon sa sinumpaang salaysay ni Liza Diño.

Idinemanda ni Diño ang PEP—pati na sina Cruz, Reyes, at Alonso—para sa five out of nine parts ng PEP investigative report.

Reklamo niya, naglalaman iyon ng 78 counts ng "defamatory remarks" na nagpapahiwatig na may "graft and corruption, malversation of public funds, and usurpation of government powers" sa panunungkulan niya bilang chairman.

Malisyoso umano ang pagpapalabas ng PEP na siya ay "incompetent, wasteful, profligate, spendthrift in handling public funds" at naging "one-woman rule" ang kanyang tenure,

Diin niya, hindi maituturing na "fair and true report and made in good faith" ang ulat ng PEP.

Ayon kay Diño:

  • Sinadya ng PEP na i-sensationalize ang FDCP report nang gawin iyong "five-part series."

  • Sinadya na hindi isama ang kanyang sagot sa e-mail ng PEP nang tanungin siya sa isyu.
  • Itinaon ang "timing" ng paglathala ng report para magkaroon ng "maximum damage" sa kanyang reputasyon habang siya ay nasa Cannes Film Festival sa France.
  • Kinukuwestiyon din niya kung bakit ginawan ng ulat ang FDCP chairmanship niya gayong wala na raw siya sa puwesto.

Katuwiran ni Diño, kahit pa raw mukhang "investigative journalistic piece" ang FDCP report ng PEP, hindi raw ito protektado ng "privilege communication" na ibinibigay ng batas sa "hard-hitting news institutions."

Kumpara raw sa mga nasabing institusyon, ayon kay Diño, "showbiz website and entity" ang "nature" ng PEP.

Para kay Diño, hindi investigative report ang PEP FDCP report kundi "communication plan" laban sa kanya.

"This is not a work of a truly journalistic endeavor but a work often done by public relations instrumentalities," saad pa ni Diño sa kanyang sinumpaang salaysay.

Samantala, idinawit niya sa cyber-libel complaint sina Tirso Cruz III at Atty. Joji Alonso.

Nakipagsabwatan umano ang mga ito sa PEP para sa inilathalang nine-part investigate report tungkol sa FDCP.

Nakita raw sa e-mail thread ang mga pangalan nina Cruz at Alonso na nag-approve umano ng release ng "confidential FDCP documents" na ginamit na basehan ng investigative report ng PEP.

Nakuha raw ni Diño ang screenshot ng e-mail thread mula sa isang "anonymous" sender.

Inireklamo rin ni Diño ng cyber libel si Joey Reyes dahil ang beteranong direktor daw ang nagparating sa PEP sa insidente sa Cannes Film Festival na sangkot si Diño at executive assistant nito.

Nabanggit daw iyon sa ulat ng PEP, at nakadagdag sa ani Liza ay paninirang-puri sa kanya.

PEP says NO ELEMENTS OF CYBER LIBEL exist IN REPORT

Sa resolusyon ng Quezon City Office of the City Prosecutor, isinuma rin ang "facts" ayon sa sinumpaang salaysay ng PEP.

Idinetalye ng PEP ang masusing proseso na dinaanan sa pagkalap, pagsiyasat, at pagbuo ng investigative report.

Mula simula ay siniguro ng PEP editors na sina Jo-Ann Maglipon, Erwin Santiago, at Rachelle Siazon na anumang impormasyong ilalathala ay corroborated ng "paper trail" o dokumentong pagbabasehan ng report.

Idinetalye ng PEP na nagsimula ang imbestigasyon sa pag-interbyu ng sources noong September 2022, at pagkalap ng mga dokumentong magko-corroborate sa impormasyon ng sources mula September 2022 hanggang May 2023.

Tumagal ng ilang buwan ang pag-draft ng report dahil sa "complexity" ng mga isyu sa FDCP.

Siniguro ng PEP na tugma sa "official receipts" at "service contracts" na isinumite sa Commission on Audit (COA) ang anumang inilabas sa investigative report.

Hindi isinama ng PEP sa FDCP investigative report ang wala pa o kulang pa ang supporting documents, patunay na hindi paninira kundi "fair" ang investigative report at lehitimong impormasyon lamang ang isinama rito.

May 17, 2022 nang makipag-ugnayan ang PEP kay Diño via e-mail para hingin ang panig nito.

Inilathala ng PEP ang sagot ni Diño—at nakahati iyon sa four-part report bilang sagot niya sa five-part series na nagtalakay sa mga isyu ng FDCP sa ilalim ng kanyang chairmanship.

Ito rin ang five-part series na inireklamo ni Diño ng cyber libel.

Nanindigan ang PEP na walang basehan ang cyber-libel complaint ni Diño. Walang malisya at hindi paninirang-puri ang inilabas nitong investigative report. Sa halip, ito ay "fair and true report, made in good faith, without any comments or remarks."

TIRSO CRUZ III CHALLENGES CYBER-LIBEL ALLEGATION

Nakasaad din sa resolusyon ang pagsusuma sa "facts" ayon sa sinumpaang salaysay ni Tirso Cruz III.

Idiniin ni Cruz na "unfounded" ang alegasyon ni Diño na siya ay nakipagsabwatan sa PEP para mailathala ang inirereklamo ni Diño na five-part FDCP report ng entertainment news site.

JOSABETH ALONSO REJECTS CYBER-LIBEL ALLEGATION

Sa resolusyon ng Quezon City Office of the City Prosecutor, isinuma rin ang "facts" ayon sa sinumpaang salaysay ni Atty. Josabeth "Joji" Alonso.

Mariing itinanggi ng abogada na pinayagan niyang aprubahan ni Cruz ang diumano'y pagbigay ng mga dokumento ng FDCP sa PEP.

Kontra pa ni Atty. Alonso, hindi naipakita ni Diño sa kanyang reklamo kung paano nasangkot ang abogada sa sinasabing release ng confidential FDCP documents.

findings of FISCAL: no prima facie evidence

Pagkatapos ng pagsusuma sa mga salaysay ng lahat ng respondents, inilabas ng Quezon City Office of the City Prosecutor (OCP) ang pagsusuri nito sa reklamo ni Liza Diño.

Ang findings ng piskalya: Sang-ayon ito kay Diño na pasok pa sa "prescriptive period" ang paghain nito ng reklamo sa piskal noong May 24, 2024.

Wala raw kasing sapat na katibayan para masabing nabasa ni Diño ang mga artikulo nang mailathala ang mga ito noong May 18 hanggang 25, 2023.

Tinanggap ng fiscal ang paninindigan ni Diño na May 24, 2023 na niya nabasa ang mga ito.

Alinsunod ang pag-establish ng "prima facie evidence with reasonable certainty of conviction" sa inilabas na 2024 Department of Justice-National Prosecution Service (DOJ-NPS) Rules on Preliminary Investigations and Inquest Proceedings.

Nakasaad sa probisyon nitong kailangan ng "prima facie evidence with reasonable certainty of conviction" o "quantum of evidence" para irekomendang kasuhan ang respondent sa isang complaint.

Makikitaan daw ng quantum of evidence ang isang reklamo base sa "evidence-at-hand, including but not limited to testimonial evidence, documentary evidence, and real evidence."

Dapat daw ma-establish din na lahat ng elemento ng isang "crime or offense and such evidence, on its own and if left uncontroverted, shall be sufficient to establish all the elements of a crime or offense charged, and consequently warrant a conviction beyond reasonable doubt."

Napirmahan ang resolusyon ng Quezon City Office of the City Prosecutor noong March 2, 2026.

Halos dalawang taon ang lumipas mula nang idemanda ni Diño ang anim na respondents.

Apat na beses dinaluhan ng PEP editors ang pagpirma at panunumpa ng kanilang mga kontra-salaysay para sa apat na hiwalay na cyber-libel complaints na isinumite ni Diño sa Quezon City Office of the City Prosecutor.

Humarap din sina Cruz, Reyes, at Alonso sa QC OCP nang sila naman ang maghain ng kani-kanilang kontra-salaysay sa cyber-libel complaint.
