Supreme Court ends SEC shutdown case against Rappler

Rappler was founded by Nobel Peace Prize laureate Maria Ressa.

The Supreme Court of the Philippines has formally dismissed the case involving a Securities and Exchange Commission (SEC) order seeking to revoke the certificates of incorporation of online new site Rappler. In a two-page notice, the Court’s Third Division said it issued a resolution on January 20, 2026, granting the Office of the Solicitor General (OSG) motion to withdraw its request for an extension.

Tinapos na ng Supreme Court (SC) ang walong taon nang kaso ng Securities and Exchange Commission (SEC) na nagpapasara sa Rappler.

Ito ay ayon sa report mismo ng nasabing online news platform kahapon, April 2, 2026.

Saad ng Rappler, natapos ang kaso nang bawiin ng Office of the Solicitor General (OSG) ang motion of extension nito sa Korte Suprema.

Ang OSG, na pinamumunuan ni Solicitor General Darlene Marie Berberabe, ang tumatayong lawyer-representative ng SEC.

Matatandaang noong January 2018, sa ilalim ng administrasyon ni dating Pangulong Rodrigo Duterte, nagtangka ang SEC na ipasara ang Rappler nang ideklara nitong unconsitutional ang Philippine Depositary Receipts (PDRs) na ginamit ng foreign investor nitong Omidyar Network.

Ang SEC ay pinamumunuan ni Emilio Benito Aquino noong panahong iyon.

Ang Omidyar Network ay isang investment firm na naka-base sa California, USA.

Ayon sa Philippine Constitution, hindi maaaring magmay-ari ng isang news network sa Pilipinas ang mga dayuhan.

Agad namang hinamon ng Rappler ang SEC sa pamamagitan ng paghahain ng kaso sa Court of Appeals (CA).

Kasabay nito, ipinagkaloob ng Omidyar ang kanilang PDRs sa mga Filipino manager ng Rappler, noong February 2018.

SEC ISSUES REVOCATION ORDER VS RAPPLER; SUPREME COURT SHUTS DOWN THE CASE

Ngunit hindi natinag ang SEC at naglabas ito ng revocation order laban sa news network noong June 28, 2022, dalawang araw bago bumaba sa puwesto si Duterte.

Noong July 2024, kinatigan ng CA ang Rappler at inutusan ang SEC na bawiin ang revocation order, ngunit nag-file ang SEC ng motion for reconsideration.

Ibinasura ng CA ang motion for reconsideration noong July 2025, kaya’t nagbigay ng senyales ang OSG na iaakyat nito ang kaso sa Korte Suprema, na binawi nito matapos ang ilang buwan.

Ang desisyong ito ng OSG ang dahilan kaya’t natapos na ang kaso ng SEC laban sa Rappler.

Ayon kay Amal Clooney, na abogado ng news website, isang importanteng tagumpay ang pangyayari para sa mga mamamahayag sa Pilipinas.

“I welcome the position taken by the Solicitor General in this case and the court rulings recognizing the paramount importance of the press in a free society,” saad niya sa isang statement.

Hiniling din niyang matapos na rin ang ilan pang kaso na kinakaharap ng news website at ng editor nito, ang Nobel Peace Prize laureate na si Maria Ressa.
