SIM card registration bill, ibinasura ni Pangulong Duterte

Hindi nilagdaan ni Pangulong Rodrigo Duterte para maging tuluyang batas ang SIM Card Registration Act dahil walang malinaw na panuntunan at depinisyon kung bakit kailangang isama rin ang social media accounts registration.

Hindi nilagdaan ni Pangulong Rodrigo Duterte ang panukalang gawing batas ang Subscriber Identity Module (SIM) Card Registration Act.

Ito ang inihayag ng Malacañang noong April 15, 2022.

Sa press statement na inilabas ni acting Presidential Spokesperson and Communication Secretary Martin Andanar, sinabi niyang, “The President has decided to veto the consolidated Senate Bill No. 2395/House Bill No. 5793, which seeks to mandate the registration of all SIM cards and social media accounts, with the purpose of deterring electronic communication-aided crimes.”

Ayon kay Andanar, bagaman at pinahahalagahan ng Pangulo ang naging pagsisikap ng Kongreso na masolusyunan ang tumataas na bilang ng insidente ng cybercrime at iba pang usaping may kaugnayan sa information and communications technology (ICT), ayaw nitong isali ang social media accounts registration sa nasabing panukalang batas nang walang mga kaukulang panuntunan at malinaw na depinisyon.

Nangangamba ang Pangulo na malalabag lamang ang mga constitutionally protected rights ng bawat mamamayan kapag naisabatas na ang panukalang irehistro ang mga SIM cards at social media accounts.

“It is incumbent upon the Office of the President to ensure that any statute is consistent with the demands of the Constitution, such as those which guarantee individual privacy and free speech,” ayon pa kay Andanar.

Hihilingin aniya ng Pangulo ang “more thorough” na pagre-review sa proposal kung bakit kailangang isama rin ang social media accounts registration.

Paliwanag ng kalihim, “Prior versions only mandated the registration of SIM cards. The President similarly found that certain aspects of state intrusion, or the regulation thereof, have not been duly defined, discussed, or threshed out in the enrolled bill, with regard to social media registration.

“The President noted that the inclusion of social media providers in the registration requirement was not part of the original version of the bill and needs a more thorough study.”

ANO ANG SIM CARD REGISTRATION ACT?

Noong February 2, niratipikahan ng Senate at ng House of Representatives ang ulat ng bicameral conference committee report ng panukalang SIM Card Registration Act.

Sa ilalim ng nasabing panukala, kailangang iparehistro ng Public Telecommunications Entities (PTEs) ang SIM cards sa isang centralized database bilang prerequisite bago ito ibenta at i-activate.

Ang panukalang batas ay may provision na, “All social media account providers shall require (the) real name and phone number (of a user) upon creation of account.”

Parurusahan nito ang sinumang magsa-sign up para sa social media accounts na gagamit ng maling identity at pagbabayarin ng multang PHP200,000 at mabibilanggo sa loob ng anim na taon.

Ang mga direct sellers ng SIM cards ay ire-require na hanapan ang bibili ng valid identification na may kalakip na larawan, at kailangang mag-fill up ng control-numbered registration form mula sa PTE.

Ang isang indibidwal na gustong bumili ng SIM card pero hindi kayang magpa-register nang personal ay maaaring mag-authorize ng ibang tao para bumili, pero kailangan ang Special Power of Attorney at proper identification ng principal buyer at ng kanyang representative.

Sinabi ni Andanar na napuna ng Pangulo na sa original na version ng panukalang batas ay hindi kasama ang social media provider sa irerehistro, subalit sa pinal na bersiyon ay isinama.

REAKSIYON SA DESISYON NG PANGULO

Matapos ibalitang ibinasura ng Pangulo ang nasabing panukalang batas, noong April 15 ay nag-tweet si Senate President Vicente Sotto III para ihayag ang pagkadismaya.

Ang tweet ni Sotto: "Ayos! Tuloy ang mga bombings and blackmail and scams using prepaid SIMs."

Ayon naman kay Senator Panfilo Lacson sa inilabas na pahayag noong April 16, suportado niya ang naging desisyon ng Pangulo.

Aniya, “Mandating social media registration could be violative of the ‘one subject one title rule’ as defined under the 1987 Constitution, not to mention the absence of safeguards or guidelines in the said provision not even covered by the title of the measure itself.”
