Can PWDs claim discounts on group meals and online orders?

Is a person with disability eligible to get discounts when ordering group meals?

Ma-a-avail ba ng Person With Disability (PWD) ang 20 percent discount at 12 percent Value-Added Tax (VAT) exemption kung bibili ng maramihang pagkain o group meal?

Hot topic ito ngayon at naghahangad ng linaw para sa PWDs.

Sa mga social-media threads, tinalakay ang discount ng isang PWD kung o-order ito ng group meal at kung paano ito iko-compute kapag via online ang order.

Nagsimula ang usapin matapos idulog ni National Council on Disability Affairs (NCDA) Executive Director Glenda Relova sa Department of Justice (DOJ) ang inquiry ng isang PWD na mag-isang kumain sa restaurant, pero group meal ang kanyang in-order.

Batay sa ulat ng TV Patrol, nagkaproblema ang PWD sa discount. Lumalabas na hindi buo ang discount na ibinigay sa kanya ng restaurant.

Ang nais mabigyang linaw ni Relova: applicable ba ang 20% discount at ang 12% VAT-exemption kahit gaano karami ang o-order-in ng PWD na solo niyang kakainin?

Panimula ni Relova sa panayam ng TV Patrol: “Single siya at doon siya kumain sa resto.

“So definitely siyang mag-isa, pero parang ang ibinigay lang sa kanya [na discount] is a portion ng price ng group meal lang yung dineduct-an."

DOJ SAYS DISCOUNT SHOULD BE IN FULL

Sagot ng DOJ ukol sa isyu, mali na hindi buo ang discount na ibinigay sa PWD na um-order ng group meal.

“Kahit na gaano kadami iyon, basta he would be the only person who will exclusively enjoy and partake with the food, then he is entitled to the full 20 percent [discount],” ani DOJ Undersecretary Raul Vasquez.

Giit pa ni Vasquez sa kanyang TV Patrol interview, di na dapat usisain pa ang PWD kung may kasama ba siyang kakain.

“Kasi nga kung talagang ganoon ang amount ng consumption ng person with disability, because we have to consider that every individual has a different degree of fondness for food.”

Ano ba ang nakasaad sa Republic Act 10754 o An Act Expanding the Benefits and Privileges of Persons with Disability?

Saad sa Section 6 ng Benefits and Privileges of Persons with Disability:

“Persons with disability shall be entitled to the grant of 20% discount and VAT-exemption on the purchase of certain goods and services from all establishments for their exclusive use, enjoyment or availment;

“Provided, however, that the purchase of such goods and services from sellers that are not subject to Value Added Tax (VAT) shall be subject to the applicable percentage tax.”

PWD DISCOUNT FOR ONLINE AND TAKE-OUT ORDERS

Paano naman kung hindi naubos ng PWD ang group-meal order nito at ite-take out niya?

Sabi ni Relova, “Personal opinion, siyempre, since kinain naman niya doon at nagso-solo siya, I think entitled na po siya sa twenty percent discount. Kasi parang leftover na lang niya yun.”

Subalit iginiit niya na ito ay “legal opinion” lamang at puwedeng kuwestiyunin ng establishments sa korte.

Applicable pa rin ba ang 20-percent discount at VAT exemption kung o-order ng group meal ang PWD online?

Sagot ni Vasquez, ang papatawan ng discount ay ang food item at beverage item “sa highest valued item[s].”

Sabi ng undersecretary, “They compute it on the highest-valued item na food, at saka highest-valued item na beverage.

“For example, nag-order ka ng steak, ‘tapos yung iba fish, yung iba prawns…

“Pipiliin mo ngayon yung pinakamataas doon, and then titingnan mo rin yung beverage, at titingnan mo yung pinakamataas doon at ang kombinasyon ng dalawang iyon, doon ka magbe-base.”

Paliwanag pa ng DOJ, pinagbasehan nila sa computation ang kapakanan ng PWD at ang interes ng business dahil maaaring maabuso ang benefit na ito at maging dahilan ng pagkalugi ng negosyo.
