LTO explains importance of vehicle ownership transfer

Vehicle ownership transfer may save sellers from possible lawsuits

Ipinaalam ng Land Transportation Office o LTO ang guidelines para sa pagpapatupad ng Administrative Order No. 2024-046.

Ang A.O. ay kaugnay ng vehicle ownership transfer pagdating sa sale ng second-hand cars.

Kung mabigo kasi ang buyer at seller na sumunod sa guidelines, maaaring umabot sa PHP40,000 ang multa.

Ipinaliwanag ni Attorney Greg Pua Jr., LTO executive director, kung ano ang dapat gawin.

“Nakasaad po dito for every sale, donation, or any transfer of a motor vehicle, the seller should report the same to LTO within 5 days from the date of notary o date of actual turnover of the unit, whichever comes first.

“Yun po ay obligasyon ng seller,” giit ni Pua sa One Balita interview noong October 21, 2024.

Kapag hindi ito nagawa ng seller, magmumulta siya ng PHP20,000.

Patuloy ni Pua, “Yung actual process naman na pag-transfer nung sasakyan, yung buyer naman po dito, binibigyan natin po sila ng 20 working days within which to cause the transfer of the vehicle subject of the deed of sale.”

Kung mabigo itong gawin ng buyer ay pagmumultahin din siya ng PHP20,000.

Ang A.O. No. 2024-046 ay inaprubahan noong August 30, 2024, at nag-take effect noong September 16, 2024.

Sinabi rin ni Pua na pinag-iisipan ngayon ng ahensiya na palawigin ang period of compliance para sa buyers and sellers na nagkaroon ng transaction—tulad ng nakalipas na ilang taon—bago ma-implement ang A.O. No. 2024-046.

Aniya, “Pinag-aaralan ngayong palawigin or we extend the period of compliance on the part of those nakabili po ng sasakyan before the effectivity of the administrative order.”

Tinalakay rin ni Pua kung bakit napakahalagang gawin ang vehicle ownership transfer kapag nagbenta ng second-hand cars.

Paraan daw ito para maiwasang masangkot sa possible legal issues sakaling masangkot sa aksidente o banggaan ang ibinentang sasakyan.

Sabi niya, “Importante po ito lalo na po sa mga nagbenta. That’s why we’re encouraging all the sellers to report kung naibenta na po ang sasakyan niyo and to cost the transfer…

“Kasi po, under our law, in case of accident po, ang liable po diyan is the registered owner.”

Maaari naman daw mapatunayan ng seller na naibenta na niya ang kanyang sasakyan.

“Pero ang abala po na maisama ka sa isang demanda in case of accident, malaking abala na po iyan para po sa mga nagbenta ng sasakyan.”

Para rin daw ito sa proteksiyon ng sellers.

“Puwede po kayong maging liable in case yung sasakyang ibinenta ninyo ay nakapangalan pa sa inyo at na-involve po sa aksidente.

“On the part of the buyers po, it is important po na dapat yung ORCR [official receipt and certificate of registration] ng sasakyan ninyo ay mailipat po sa inyong pangalan.”

Sabi pa ni Pua, “May kaso na binibigay sa buyer, meron lang po certification, wala pang deed of sale.

“Kapag ito po ay nahuli at na-impound, mahihirapan silang ilabas sa amin iyan dahil kailangan nilang patunayan ang pagmamay-ari ng kanilang sasakyan.”

Idinagdag ni Pua na para sa pagsusumite ng requirements, maaaring bumisita sa kanilang tanggapan o kaya naman ay ipadala ang copies via online submission sa LTO email address.
