Trigger Warning: Menion of rape, sexual abuse

Panauhin ang 33-anyos na singer na si Gerald Santos sa Senate hearing nitong Agosto 19, 2024, Lunes.
Isiniwalat ni Gerald na 15-anyos pa lang siya nang halayin ng isang musical director na nakatrabaho niya sa GMA-7 noong 2005.
“Hindi po ako na-harass, hindi po ako na-abuse, na-rape po ako,” pagbubunyag niya sa isinagawang pagdinig sa Senado.
Ito ang unang pagkakataong binanggit ni Gerald ang salitang "rape."
Sa mga naunang pahayag ng singer ay "sexual harassment" at sexual abuse" ang mga ginamit niyang mga salita upang isalarawan ang masamang karanasang nangyari sa kanya.

GMA STATEMENT ON GERALD SANTOS'S ALLEGATION
Kinagabihan ay naglabas ng official statement ang GMA Network sa newscast na 24 Oras kaugnay sa usaping ito.
Pahayag ng GMA Network: “Naninindigan ang GMA Network laban sa lahat ng uri ng pang-aabuso.
“Hindi kinukunsinti ng GMA ang anumang uri ng pang-aabuso sa mga artista, personalidad, empleyado, independent contractors, at iba pang stakeholders nito.
“Alinsunod dito ang naging aksyon ng network matapos nitong matanggap ang formal complaint ni Gerald Santos noong 2010.
“Agad nagsagawa ng imbestigasyon at matapos nito ay agaran ding ipinatupad ng network ang nararapat na parusa sa inakusahan.
“Tinerminate ng GMA ang kontrata ng inakusahan, at hindi na rin siya muling kinuha o binigyan ng trabaho pagkatapos nito.
“Ngunit ang nilalaman ng formal complaint na inihain ni Gerald noong 2010 ay naiiba sa akusasyon niya ng rape na binanggit niya sa Senado.
“Ngayon lang din nakarating sa kaalaman ng pamunuan ng GMA ang bagay na ito.
“Nais ding linawin ng GMA ang naging pahayag ni Gerald na natanggal siya sa network.
“Siya mismo ang humiling ng early release mula sa kanyang management contract noong 2010, na pinagbigyan ng GMA.
“Sa parehong taon ay agad din siyang lumabas sa ibang TV network. Dagdag pa rito, sumubok ding bumalik si Gerald sa GMA matapos ang kanyang kontrata sa TV5 noong 2013.”

Ang kabuuan ng pahayag ni Gerald, “Para lang sa kalinawan matapos ang official statement ng GMA... Uulitin ko po na nagpaparelease ako sa GMA Artist Center..
“Bilang manager ko po that time ay tila wala na silang plano sa akin at walang mga projects na naka-line up para sa akin..

Kalakip ng FB post ni Gerald ang mga bahagi ng liham ng manager niyang si Rommel M. Ramilo kay Atty. Felipe Gozon, CEO at presidente ng GMA Network noon.
Ang petsa ng liham ay Pebrero 28, 2011. Natanggap iyon ni FLG kinabukasan.
Furnished ng kopya niyon si G. Gilberto Duavit Jr., COO at Vice President ng GMA Network noon.
Sa FB post ay tinakpan ang pangalan ng akusadong musical director, pati ang cellphone number ni G. Ramilo.
Ang nilalaman ng liham ni G. Ramilo kay FLG:
“Dear Sir,
“Greetings!
“It has been a year since Gerald Santos brought up the issues of sexual harassment and abuse of power against Mr. …., ultimately leading to Gerald's release not only from GMAAC but from the network itself.
“A lot of significant events have happened since then. Gerald has released an all-original album, has done four concerts and now has a regular Sunday TV show in TV5 (FANTASTIK) and a certified KAPATID.
“We are very happy with the positive turn of events even after the sudden release from the KAPUSO Network.
“We have moved on, but not quite. We still await for the resolution of the case we brought up to you, as promised to us during our meeting with you last March 2010, to finally achieve a closure to this incident.
“We need to know what measures have been done by the network to protect all the other aspiring artists against people like Mr. ...
“It has been a personal crusade of Gerald to contribute in any way, to the protection of the well-being of talented aspiring singers especially those who are products of talent searches.
“Looking back, it has been a lonely battle. Gerald was axed in Walang Tulugan without any dialogue and despite our appeal to be retained in the show.
“All his other TV guestings were cancelled and we were forced to pay a huge sum to GMAAC within such a short period of time for the back commissions from Gerald in his four years being under GMAAC or else the release from GMAAC would not take effect.
“(This was actually just a reflection of the gross inefficiency of GMAAC as a talent manager. They could not even consistently collect their commissions from their artist/s.)
“The prize for standing up for the truth has been very ugly for Gerald in his former home network whose battle cry has been ‘walang kinikilingan, walang pinoprotektahan, walang kasinungalingan, serbisyong totoo lamang.’
“Nevertheless, these incidents have certainly made Gerald a stronger and better person and artist and we are very excited of what the future has in store for him.
“Gerald will be forever grateful to GMA Network and part of him will always stay Kapuso.
“Hoping that GMA will furnish us with the official resolution of the case you investigated on last year so we can truly close this chapter.

GERALD'S MANAGER SPEAKS UP
Tinanong ng PEP Troika si G. Ramilo kung ano ang sagot ng GMA kaugnay sa nasabing liham na may petsang Pebrero 28, 2011.
Reply ng manager ni Gerald nitong Lunes din ng gabi via Messenger: “We were not furnished with the official action of the network on Gerald's complaint so I wrote them a letter one year after we filed the complaint (2011), BUT STILL NO FEEDBACK from them.
“We just relied on hearsays that the accused was out of GMA. Gerald was the aggrieved party.
“If they were really concerned with their talent, they should have also informed Gerald of their decision.
“The fact that the accused was indeed terminated, there was probable cause; a result of their own investigation.
“This could have boosted our morale to file criminal charges against the accused."
Sinagot din ni G. Ramilo ang tungkol sa pagbabago ng akusasyon ni Gerald sa akusado, mula sexual harassment ay naging rape na ito.
Saad niya: “As to the issue of change in accusation (from harassment to rape ), we reserve the right to explain/detail this to the proper courts.
“Gerald was only 15 when the crime happened. It took him 5 years to bring this out only in the network's premises.
“He needed more time to muster enough courage and strength to relive and tell what exactly happened, in full details."
Paglilinaw pa ng manager ni Gerald, “Let me make this clear. This is not a battle against GMA Network. It's a battle against the mid-level management/executives who act as gods in the network and make their undesired artists' lives miserable.
“We thank Atty Felipe Gozon for his wisdom in the course of this ordeal. To quote him, ‘Champion ka pala! Kung sisikat! ka ay dapat dito sa GMA!’
“Sadly, the implementers of his vision had other vengeful things in mind.”
GORGY RULA
Pursigido si Gerald Santos na magsampa ng kaso laban sa musical director na itinuturo niyang gumahasa diumano sa kanya.
Labinsiyam na taon na ang lumipas at hindi pa rin matahimik si Gerald. Dala-dala pa niya ang bigat sa kalooban niya.
Para sa kanya, hindi pa nabibigyan ng hustisya ang ginawa sa kanya.
Sa hearing sa Senado noong Lunes, August 19, nilinaw ni Senator Jinggoy Estrada sa taga-DOJ kung gaano katagal ang prescriptive period ng kasong rape.
Ang sabi ng taga-DOJ, 20 years ang prescriptive period ng ganoong grave offense. Pero titingnan pa raw nila kung gaano katagal itong sa kaso ni Gerald dahil minor pa siya nung ginawa itong diumano’y krimen sa kanya.
Umiiyak si Gerald na nakiusap sa Senado na sana’y tulungan siyang maituloy ang pagsasampa niya ng kaso laban sa gumawa nito sa kanya.
“Kasi ang tagal ko na po talagang gusto kong… kaya lang po natatakot po talaga ako. Wala po akong means, Your honor…
"Ako po ay naninikluhod po sa inyo, tulungan nyo po ako kasi matagal ko na po itong ano sa ano ko po, e.
“Yung after ko po na nagreklamo po ako sa GMA, nung natanggal po ako sa GMA, halos gumapang po ako, para lang po mabuhay yung career ko,” lumuluhang pahayag ni Gerald.
Pero nasaan na itong musical director na tinutukoy niya?
Sa huling pagtatanung-tanong namin ay nasa isang probinsya na ito at meron nang sariling negosyo.
Pero wala kaming update kung okay pa ba siya o dala-dala rin niya ang alaalang iyon.
May nararamdaman din kaya siyang guilt sa ginawa niya kung totoo itong kuwento ni Gerald?
May komunikasyon pa kaya siya sa mga kaibigan niyang executives ng GMA-7?
